Synopsis As Introduced
Amends the Illinois Marriage and Dissolution of Marriage Act. Makes a stylistic change in provisions concerning the commencement of actions for declaration of invalidity of marriage.

Senate Floor Amendment No. 1
Deletes reference to:
750 ILCS 5/306
Adds reference to:
750 ILCS 5/601from Ch. 40, par. 601

Deletes everything after the enacting clause. Amends the Illinois Marriage and Dissolution of Marriage Act. Add to the list of persons that may file for custody of a child, a grandparent who is a parent or step-parent of the deceased parent when one of the parents is deceased, if one or more of the listed conditions existed at the time of the parent's death. Provides that the court shall, at the court's discretion or upon the request of any party entitled to petition for custody of the child, appoint a guardian ad litem to represent the best interest of the child for the duration of the custody proceeding or for any modifications of any custody orders entered. Makes other changes.

Senate Floor Amendment No. 2
Deletes everything after the enacting clause. Amends the Illinois Marriage and Dissolution of Marriage Act with provisions substantially similar to those of Senate Amendment No. 1 but with the following changes: (1) provides that a grandparent must file a petition to commence a child custody proceeding; and (2) eliminates as a circumstance under which a grandparent may commence a child custody proceeding, the fact that the child's parents were no cohabiting on a permanent or indefinite basis.
