Deletes all. Amends the Counties Code and Capital Crimes Litigation Act. Provides that moneys in the Capital Litigation Trust Fund may be used for funding post-conviction proceedings in capital cases and for petitions for relief from judgments in capital cases. Amends the Code of Criminal Procedure of 1963 relating to post-conviction petitions. Provides that if a defendant does not file a direct appeal, the post-conviction petition shall be filed no later than 3 years from the date of conviction, unless the petitioner alleges facts showing that the delay was not due to his or her culpable negligence. Effective immediately.
