Synopsis As Introduced
Amends the Illinois Wage Payment and Collection Act. Establishes requirements for the use of payroll cards by employers. Provides that receipt of wages by means of a payroll card may not be a condition of employment. Requires certain disclosures to be made to employees before using payroll cards. Requires the offer of an alternative means of payment to be available. Establishes limits on fees. Effective January 1, 2015.

House Floor Amendment No. 1
Replaces everything after the enacting clause to amend the Illinois Wage Payment and Collection Act with provisions similar to those contained in the introduced bill. Revises definitions to exclude an employer from the definition of the term "payroll card issuer". Removes the requirement that an employer obtain an employee's written consent to receive wages by payroll card. Requires disclosures to employees to be clear and conspicuous rather than in plain language. Replaces a requirement that employers offer payment by paper check or direct deposit with a requirement that the employer offer payment by other means in compliance with the Act. Replaces requirement that a no-cost ATM withdrawal be allowed with a provision that an employee be allowed at least one no-cost method of withdrawing the employee's full net wages every 2 weeks. Removes the prohibition on inactivity fees. Provides that a payroll card program offered by an employer shall provide the employee with protections from unauthorized use of the payroll card in accordance with State and federal law concerning electronic fund transfers. Makes other changes. Effective January 1, 2015.

Replaces everything after the enacting clause. Replaces everything after the enacting clause to amend the Illinois Wage Payment and Collection Act with provisions similar to those contained in the engrossed bill. Requires disclosure to employees to include that payment by payroll card is voluntary and list other methods of payment available. Requires an explanation of how an employee may obtain, at no cost, information concerning the employee's account. Requires a payroll card system to allow withdrawal of wages at least twice a month. Provides that an employer's obligations regarding payroll cards to end 180 days after the employer-employee relationship ends. Requires certain disclosures upon termination of the employer-employee relationship. Effective January 1, 2015.

Senate Floor Amendment No. 2
Provides that an employer's obligations cease 60 rather than 180 days after the employer-employee relationship ends. Makes a change regarding notice an employer must give to an employee at the termination of an employer-employee relationship to remove the requirement that the employer provide contact information for a payroll card issuer.

Senate Floor Amendment No. 4
Makes changes concerning ascertaining account balances and declined transaction fees. Provides that a payroll card program must provide for telephone access to ascertain the account balance at any time without incurring a fee. Provides that a declined transaction must be allowed twice per month without fee. Authorizes commercially reasonable fees with regard to additional declined transactions during that month.
