Synopsis As Introduced
Amends the Agricultural Areas Conservation and Protection Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Cannabis Control Act. Defines industrial hemp. Provides that the Department of Agriculture and any institution of higher learning authorized by the Department of Agriculture may grow and cultivate industrial hemp for agricultural research. Provides that the Department of Agriculture may adopt rules to implement these provisions. Provides that upon receipt of a request from an institution of higher learning for permission to grow or cultivate industrial hemp for research purposes, the Department of Agriculture shall use emergency rule making powers to authorize and regulate the institution's growth and cultivation of industrial hemp.

Replaces everything after the enacting clause. Amends the Cannabis Control Act. Provides that an institution of higher education or the Department of Agriculture may grow or cultivate industrial hemp if (1) the industrial hemp is grown or cultivated for purposes of research conducted under an agricultural pilot program or other agricultural or academic research, (2) the pilot program studies the growth, cultivation, or marketing of industrial hemp, and (3) any site used for the growing or cultivating of industrial hemp is certified by, and registered with, the Department of Agriculture. Provides that if an institution of higher education decides to conduct research, then, prior to conducting the research, the institution of higher education shall notify the Department of Agriculture and any local law enforcement agency in writing. Provides that the institution of higher education shall provide quarterly reports and an annual report to the Department of Agriculture on the research and the research program shall be subject to random inspection by the Department of Agriculture, the Department of State Police, or local law enforcement agencies. Provides that the Department of Agriculture may adopt rules to implement these provisions. Provides that upon receipt of a request from an institution of higher education for permission to grow or cultivate industrial hemp for research purposes, the Department of Agriculture may use emergency rule making powers to authorize and regulate the institution's growth and cultivation of industrial hemp. Defines "institution of higher education" and "industrial hemp".
