Synopsis As Introduced
Amends the Charter Schools Law of the School Code. Requires (instead of permits) a charter to be revoked or not renewed if the school board or the State Board of Education (as the chartering entity) demonstrates that the charter school did or did not do certain acts or otherwise failed to comply with the requirements of the Law. Amends the State Mandates Act to require implementation without reimbursement.

Deletes everything after the enacting clause. Amends the Charter Schools Law of the School Code. In a provision allowing a charter to be revoked or not renewed, provides that if the charter school committed a material violation of any of the conditions, standards, or procedures set forth in the charter, failed to meet generally accepted standards of fiscal management, or violated any provision of law from which the charter school was not exempted, then the State Board of Education shall notify the charter school of the reason why the charter is subject to revocation or nonrenewal, and the charter school shall submit a written plan to the State Board to rectify the problem and implement the plan within 60 days after notification. Provides that if the charter school failed to meet or make reasonable progress toward achievement of the content standards or pupil performance standards identified in the charter, then the charter school must be held to the terms as written in the charter. Provides that if the State Board finds that the charter school has not rectified the problem, then the charter must be revoked or not renewed. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

House Floor Amendment No. 2
Provides that if the charter school committed a material violation of any of the conditions, standards, or procedures set forth in the charter, failed to meet generally accepted standards of fiscal management, or violated any provision of law from which the charter school was not exempted, then the local school board or the State Board of Education as the chartering entity (instead of the State Board) shall notify the charter school in writing (instead of just notifying the charter school) of the reason why the charter is subject to revocation or nonrenewal, and the charter school shall submit a written plan to the local school board or State Board to rectify the problem and implement the plan within 90 (instead of 60) days after notification. Provides that if the local school board or State Board as the chartering entity (instead of the State Board) finds that the charter school has not rectified the problem, then the charter must be revoked or not renewed.

Provides that the charter school shall begin implementation of (instead of implement) the plan to rectify the problem within 90 days after notification.
