Synopsis As Introduced
Amends the Illinois Public Aid Code. Provides that every provider of long-term care services under the Code shall return to the vendor pharmacy from which the drug product was purchased, for repackaging and reimbursement to the Department of Public Aid, every drug product that (i) was dispensed to a resident of the provider's long-term care facility and not used and (ii) meets certain other criteria. Provides for a civil penalty of $30,000 for each incident of a provider's noncompliance. Provides for collection of a penalty by means of a civil action brought by the Attorney General or by means of an offset against amounts due to the provider from the Department. Provides for the deposit of penalty moneys into the General Revenue Fund and credited to the Medicaid account. Amends the Pharmacy Practice Act of 1987, the Wholesale Drug Distribution Licensing Act, the Senior Pharmaceutical Assistance Act, the Illinois Food, Drug and Cosmetic Act, the Illinois Controlled Substances Act, and the Cannabis and Controlled Substances Tort Claims Act to provide that persons engaged in repackaging or labeling prescription drugs to the extent required under the Illinois Public Aid Code provisions are exempt from provisions added by the bill of those other Acts that might prohibit or otherwise regulate such activity.
