Synopsis As Introduced
Amends the Probation and Probation Officers Act. Provides that beginning January 1, 2011, minimum qualifications of probation officers shall include at least 30 hours per year in training or continuing education, provided that such training or continuing education programs have been approved in advance by the Division of Probation Services. Provides that beginning January 1, 2014, such minimum qualifications shall include at least 40 hours per year in training or continuing education, provided that such training or continuing education programs have been approved in advance by the Division of Probation Services.

Replaces everything after the enacting clause. Amends the Code of Criminal Procedure of 1963. Abolishes the death penalty. Provides that all unobligated and unexpended moneys remaining in the Capital Litigation Trust Fund shall be transferred into the Death Penalty Abolition Fund, a special fund in the State treasury, to be expended by the Illinois Criminal Justice Information Authority, subject to appropriation, for services for families of victims of homicide or murder and for training of law enforcement personnel. Amends the State Finance Act to create the Fund. Repeals the Capital Crimes Litigation Act. Provides for severability. Effective July 1, 2011, except that the provision repealing the Capital Crimes Litigation Act takes effect January 1, 2012.
