Synopsis As Introduced
Amends the Environmental Protection Act. Provides that, on and after January 1, 2011, a person may not (i) use a weight or other product to balance a vehicle wheel or tire if the weight or other product contains lead or mercury or (ii) sell, offer to sell, distribute, or offer to distribute a weight or other product for balancing a vehicle wheel or tire if the weight or other product contains lead or mercury. Also provides that, on and after January 1, 2012, a person may not sell a new vehicle equipped with a weight or other product used to balance a vehicle wheel or tire if the weight or other product contains lead or mercury. Effective immediately.

Senate Committee Amendment No. 1
Provides that, on and after July 1, 2011 (rather than January 1, 2011), a person may not (i) use a weight or other product to balance a vehicle wheel or tire if the weight or other product contains lead or mercury or (ii) sell, offer to sell, distribute, or offer to distribute a weight or other product for balancing a vehicle wheel or tire if the weight or other product contains lead or mercury.

Senate Floor Amendment No. 3
Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill, as amended, with the following changes: (1) delays the date upon which certain prohibitions take effect, (2) prohibits the sale, distribution, and, in certain circumstances, use of a weight or other product to balance a vehicle wheel or tire if the weight or product contains mercury that was intentionally added during the manufacturing process or more than 0.1 percent lead by weight (rather than if the weight or product contains mercury or lead), and (3) prohibits the sale of a new vehicle equipped with a weight or other product used to balance a vehicle wheel or tire if the weight or other product contains mercury that was intentionally added during the manufacturing process or contains more than 0.1 percent lead by weight (rather than if the weight or other product contains mercury or lead). Effective immediately.
