Synopsis As Introduced
Amends the Counties Code. Provides that any county may provide electronic access to public records through the Internet. Provides that a county board may establish a reasonable fee to cover the operational expenses of providing that electronic access and may establish the basis for charging the fee. Provides that the fee must be paid to the county treasurer and deposited into a fund designated as the County Automation Fund. Effective immediately.

House Committee Amendment No. 1
Further amends the Counties Code. Requires the county board to prepare a statement of the costs of providing electronic access to county public records. Provides that all supporting documents for this statement must be public record and subject to public examination and audit. Provides that all direct and indirect costs may be considered in determining the cost of providing electronic access. Provides that fees for electronic access shall be charged only to commercial users and shall be permitted only when the data requested consist of multiple records that have been manipulated or sorted in a specific manner beyond the reporting requirements of State law.

House Floor Amendment No. 2
Deletes everything. Allows a county to provide Internet access to public records maintained in electronic form at no charge to the public and, if the county provides this access, allows the county to enter into a contractual arrangement for the dissemination of the data in bulk or compiled form and to impose a fee for the dissemination of electronic data in bulk or compiled form. Defines "electronic data in bulk form" and "electronic data in compiled form". Effective immediately.
