Synopsis As Introduced
Amends the Farm Nuisance Suit Act. Makes a technical change to the Section concerning the short title.

Deletes reference to:
740 ILCS 70/0.01
Adds reference to:
740 ILCS 110/10from Ch. 91 1/2, par. 810

Deletes everything after the enacting clause. Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that records and communications made to or by a therapist in the course of court-ordered treatment to render the recipient fit to stand trial or in the course of an assessment, diagnosis, screening, or treatment at an outpatient facility, a residential treatment facility, or a local jail or detention center may be disclosed to a court-appointed therapist, psychologist, or psychiatrist (instead of in the course of court-ordered treatment to render the recipient fit to stand trial) for use in determining a person's fitness to stand trial. Provides that the records and communications shall be admissible only as to issues involving the recipient's physical or mental condition and only to the extent that these are germane to such proceedings.

Senate Committee Amendment No. 1
Further amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that a recipient's records and communications may be disclosed to a court-appointed therapist, psychologist, or psychiatrist for use in determining a person's fitness to stand trial if the records were made within the 180-day period before the date of the mental health professional's court appointment (instead of if the records and communications were made to or by a therapist in the course of court-ordered treatment to render the recipient fit to stand trial or in the course of an assessment, diagnosis, screening, or treatment at an outpatient facility, a residential treatment facility, or a local jail or detention center). Provides that these records and communications shall be admissible only as to the issue of the person's fitness to stand trial (instead of only as to issues involving the recipient's physical or mental condition and only to the extent that these are germane to such proceedings).
