Synopsis As Introduced
Contains a preamble concerning COVID-19, the Gubernatorial Disaster Proclamations declaring all counties in the State of Illinois as a disaster area, and other matters. Pursuant to the Illinois Emergency Management Agency Act, orders the following for the duration of the Gubernatorial Disaster Proclamations: (1) the Department of Public Health shall exercise discretion regarding enforcement of all provisions of the Hospital Licensing Act, the Emergency Medical Services (EMS) Systems Act, the Department of Public Health Powers and Duties Law, the Illinois Adverse Health Care Events Reporting Law of 2005, and specified rules in recognition of the need for hospitals and healthcare providers to make accommodations in response to the COVID-19 pandemic and to ensure patient safety; (2) specified hospital licensing requirements of the Hospital Licensing Act are suspended; specified rules are also suspended or modified as set forth in emergency rules; (3) all provisions of the Hospital Report Card Act are suspended with specified exceptions; (4) specified provisions of the Department of Public Health Powers and Duties Law and specified rules are suspended; (5) all reporting deadlines in the Illinois Adverse Health Care Events Reporting Law of 2005 and specified rules are suspended; this does not suspend the obligation to report, only the timing of such report; the deadlines shall resume upon the termination of all Gubernatorial Disaster Proclamations; (6) the Emergency Medical Services (EMS) Systems Act and specified rules are suspended to the extent necessary to permit EMS personnel or services to transport patients to an alternate care facility authorized by this Executive Order; (7) (i) hospitals licensed by the Department of Public Health or (ii) the State of Illinois, through one of its agencies or in cooperation with one or more federal or local governmental bodies, may establish an alternate care facility to provide room and board, nursing, and diagnosis or treatment to COVID-19 patients or non-COVID-19 patients to increase regional hospital capacity to respond to COVID-19 under rules adopted by the Department of Public Health; the Hospital Licensing Act and specified rules are suspended in their entirety as applicable to alternate care facilities if the alternate care facilities meet the standards in emergency rules. Provides that the Department of Public Health shall file additional emergency rules as needed to effectuate the intent of this Executive Order. Provides that this Executive Order and any emergency rules shall be interpreted consistent with any waivers, regulations, other official guidance issued by the federal Centers for Medicare and Medicaid Services or the Department of Health and Human Services pertaining to specified matters. Provides that the provisions of this Executive Order are severable.
