Synopsis As Introduced
Amends the Code of Civil Procedure. Provides that: a motion to quash must be filed within 30 days after a defendant or other party files an appearance; a motion to quash must be filed within 30 days after a hearing in which a defendant or other party appears in court, without filing an appearance, and participates in a hearing before a judge; and a motion to quash not filed within the applicable 30-day time limit is barred. Effective immediately.

Deletes reference to:
735 ILCS 5/2-301
Adds reference to:
735 ILCS 5/15-1505.6 new

Replaces everything after the enacting clause. Amends the Code of Civil Procedure. Provides that in any residential foreclosure action, the deadline for filing a motion to dismiss or to quash service that objects to the court's jurisdiction over the person, unless extended by the court for good cause shown, is 60 days after the earlier of these events: (i) the date that the moving party filed an appearance; or (ii) the date that the moving party participated in a hearing without filing an appearance. Provides that in any residential foreclosure action, if the objecting party files a responsive pleading or a motion prior to the filing of a motion objecting to personal jurisdiction, that party waives all objections to the court's jurisdiction over the party's person. Effective immediately.
