Synopsis As Introduced
Creates the Mercury Thermostat Collection Act. Requires thermostat manufacturers to establish and maintain a program for the collection and recycling of mercury thermostats. Sets forth requirements for the program. Requires that mercury thermostats be handled as universal waste. Prohibits wholesalers, retailers, and technicians from selling or distributing non-mercury thermostats if they have not taken certain actions with respect to the disposal of mercury thermostats. Sets forth penalties for violations of the Act. Requires the Environmental Protection Agency to publish certain information and make recommendations to the Governor and General Assembly concerning the collection of mercury thermostats. Contains other provisions. Effective immediately.

Senate Floor Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill with the following changes. Requires thermostat manufacturers' collection plans to provide for a financial incentive of $5 for each mercury thermostat that is returned. Increases the Agency approval period from 90 to 120 days. Deletes a provision that required Agency approved collection programs to be designed to achieve certain collection goals. Deletes remaining references to mercury thermostat collection goals. Deletes a provision that prohibited any thermostat manufacturer that is in violation of the Act from selling offering to sell, distributing, or offering to distribute non-mercury thermometers. Provides that only technicians who take mercury-containing thermostats out of service have a duty to deliver those thermostats to a person participating in the program as a collection point. Removes the requirement for the Agency to provide certain educational materials. Inserts a provision requiring the Agency to post a list of persons who participate in the program as a collection point on its website.

Deletes everything after the enacting clause. Reinserts only the short title provision of the engrossed bill.
