Synopsis As Introduced
Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Illinois Vehicle Code. Authorizes the Secretary of State to suspend a person's driver's license for operating a watercraft under the influence of alcohol or other intoxicating compounds. Amends the Boat Registration and Safety Act. Provides that any person operating a watercraft in this State that is involved in a boating accident shall be deemed to have given consent to the chemical testing of their blood, breath, or urine for the purpose of determining the content of alcohol, other drug or drugs, or intoxicating compound or compounds. Provides that if the operator refuses testing, or submits to testing and the testing indicates a blood alcohol content of 0.08 or the presence of other drugs or intoxicating compounds, that person can have their driver's license suspended under the statutory suspension procedures of the Illinois Vehicle Code.

Senate Floor Amendment No. 3
Adds reference to:
625 ILCS 45/5-16

Amends the Illinois Vehicle Code and the Boat Registration and Safety Act to provide that the operator of a sailboat or non-powered watercraft can have his or her privilege to operate a watercraft suspended for refusing chemical testing of blood, breath, or urine. Provides that the new Section of the Boat Registration and Safety Act mandating chemical testing following a boating accident that results in personal injury or death only applies to the operators of motorboats (rather than any watercraft). Makes technical changes.

Removes the implied consent provision of the Boat Registration and Safety Act's limitation to sailboats or non-powered watercraft.
