Synopsis As Introduced
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning possession of explosives or explosive or incendiary devices.

Senate Floor Amendment No. 1
Deletes reference to:
720 ILCS 5/20-2
Adds reference to:
730 ILCS 5/5-5-3.2from Ch. 38, par. 1005-5-3.2

Replaces everything after the enacting clause. Amends the Unified Code of Corrections. Provides that the court may impose an extended term sentence upon an offender who has been convicted of a felony violation of criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, criminal sexual abuse, or aggravated criminal sexual abuse when the victim of the offense is under 18 years of age at the time of the commission of the offense and, during the commission of the offense, the victim was under the influence of alcohol, regardless of whether or not the alcohol was supplied by the offender.

House Committee Amendment No. 1
Provides that in order for the court to impose the extended term sentence the offender, at the time of the commission of the offense, had to know or should have known that the victim had consumed alcohol.
