SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 2

    Proposes to amend the Finance Article of the Illinois Constitution. Provides that the General Assembly by law shall provide sufficient transportation revenues to ensure that the State's transportation infrastructure is maintained in a good condition. Provides that the General Assembly shall provide by law that all transportation related revenues and fees shall be deposited into a Transportation Trust Fund. Sets forth the purposes for which Transportation Trust Fund moneys may be used. Effective upon being declared adopted.

3    RESOLVED, BY THE SENATE OF THE NINETY-NINTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to amend Section 2 of Article
9VIII of the Illinois Constitution as follows:

13SECTION 2. STATE FINANCE
14    (a) The Governor shall prepare and submit to the General
15Assembly, at a time prescribed by law, a State budget for the
16ensuing fiscal year. The budget shall set forth the estimated
17balance of funds available for appropriation at the beginning
18of the fiscal year, the estimated receipts, and a plan for
19expenditures and obligations during the fiscal year of every
20department, authority, public corporation and quasi-public
21corporation of the State, every State college and university,
22and every other public agency created by the State, but not of
23units of local government or school districts. The budget shall

1also set forth the indebtedness and contingent liabilities of
2the State and such other information as may be required by law.
3Proposed expenditures shall not exceed funds estimated to be
4available for the fiscal year as shown in the budget.
5    (b) The General Assembly by law shall make appropriations
6for all expenditures of public funds by the State.
7Appropriations for a fiscal year shall not exceed funds
8estimated by the General Assembly to be available during that
9year.
10    (c) Roads, bridges, and public transportation are an
11essential public purpose for which public funds must be
12expended and are vital to the economy of the State of Illinois.
13As such, the General Assembly by law shall provide sufficient
14transportation revenues to ensure that the State's
15transportation infrastructure is maintained in a good
16condition. To achieve that goal, the General Assembly shall
17provide by law that all transportation related revenues and
18fees, including the State motor fuel tax and vehicle
19registration and license fees, shall be deposited into a
20Transportation Trust Fund. Moneys in the Transportation Trust
21Fund may be used only:
22        (1) for the purpose of paying the principal of and
23    interest on transportation bonds as they become due and
24    payable; and
25        (2) after meeting debt service requirements for
26    transportation bonds, for any lawful purpose related to

1    transportation, including the construction and maintenance
2    of adequate highways, roads, bridges, and public transit
3    systems in the State.
4    Moneys in the Transportation Trust Fund may not be
5transferred to the General Revenue Fund or any other fund or
6special fund of the State.

SCHEDULE
9    This Constitutional Amendment takes effect upon being
10declared adopted in accordance with Section 7 of the Illinois
11Constitutional Amendment Act.
