AMENDMENT TO SENATE BILL 387

2    AMENDMENT NO. ______. Amend Senate Bill 387 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
510-20.58 as follows:
 
6    (105 ILCS 5/10-20.58 new)
7    Sec. 10-20.58. School police force; Peoria School District
8150.
9    (a) The board of education of Peoria School District 150
10may employ a police force, as may be required, and may define
11and prescribe such employees' respective duties and
12compensation. After receiving a certificate attesting to the
13successful completion of a training course administered by the
14Illinois Law Enforcement Training Standards Board, school
15police officers employed under this Section shall be
16conservators of the peace within and upon the schools,

1boulevards, driveways, and property controlled by the school
2district and shall have the power to make arrests, subject to
3subsections (b) and (c) of this Section.
4    (b) Each school police officer employed under this Section
5is vested with police powers, is authorized to act as a
6conservator of the peace within the school district, and may
7arrest or cause to be arrested, with or without a warrant, any
8person who breaks the peace or who violates any ordinance of
9the city where the school district is located or any criminal
10law of this State. The authority granted under this subsection
11(b) is expressly limited to school district property and shall
12not be construed to extend to any other jurisdiction, except in
13cases of fresh pursuit or under a validly executed
14intergovernmental cooperation agreement.
15    An arrest may be made by a school police officer without a
16warrant when a criminal offense is committed or attempted in
17his or her presence or when a criminal offense has been
18committed and the officer has reasonable ground for believing
19that the person to be arrested has committed it. Any person so
20arrested shall, without unnecessary delay, be taken by the
21officer before the circuit court of the county having
22jurisdiction, and the officer shall file a complaint in writing
23under oath, charging the defendant with a violation of a
24statute or ordinance.
25    (c) A school police officer employed under this Section
26shall comply with the requirements of the Illinois Police

1Training Act. In addition, before carrying a firearm, each
2officer shall complete a training course under the Peace
3Officer and Probation Officer Firearm Training Act.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
