AMENDMENT TO SENATE BILL 26

2    AMENDMENT NO. ______. Amend Senate Bill 26 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Open Meetings Act is amended by adding
5Section 2.03.5 as follows:
 
6    (5 ILCS 120/2.03.5 new)
7    Sec. 2.03.5. Internet posting requirements.
8    (a) A public body that serves a population of less than
91,000,000 that maintains an Internet website other than a
10social media website or social networking website shall, within
1190 days of the effective date of this amendatory Act of the
1299th General Assembly, post to its website for the current
13calendar year a mechanism, such as a uniform single email
14address, for members of the public to electronically
15communicate with elected officials of that public body, unless
16such officials have an individual email address for that

1purpose.
2    (b) In addition to any requirement to publish in any
3newspaper notices, agendas, records, or other information or
4material that is required to be published in a newspaper by law
5or court order including, but not limited to, this Act, the
6Illinois Municipal Budget Law, the Intergovernmental
7Cooperation Act, the Counties Code, the Township Code, the
8Illinois Municipal Code, the Election Code, the School Code,
9the Airport Authorities Act, or the Civic Center Code, a public
10body that maintains a website shall also publish this
11information on its website.
12    (c) For the purposes of this Section "Internet website"
13shall not include any social media website, social networking
14website, or any other social media presence that a public body
15maintains.
16    (d) A hyperlink to the information required to be posted
17under this Section must be easily accessible from the public
18body's home page.
19    (e) The postings required by this Section are in addition
20to any other posting requirements required by law or ordinance.
21    (f) No home rule unit may adopt posting requirements that
22are less restrictive than this Section. This Section is a
23limitation under subsection (i) of Section 6 of Article VII of
24the Illinois Constitution on the concurrent exercise by home
25rule units of powers and functions exercised by the State.
