SYNOPSIS AS INTRODUCED:
 
725 ILCS 5/110-13  from Ch. 38, par. 110-13

    Amends the Code of Criminal Procedure of 1963. Provides that an attorney at law or an official authorized to admit another to bail or to accept bail may furnish any part of any security for bail if the bail security was derived from donations collected by a nonprofit organization which receives donations from the public on behalf of the defendant to provide bail security for the defendant and neither the attorney at law nor official or an immediate family member of the attorney at law or the official: (1) donated funds or other property to the nonprofit organization on behalf of the defendant for his or her bail security; or (2) is an officer or director of the nonprofit organization.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Code of Criminal Procedure of 1963 is
5amended by changing Section 110-13 as follows:
 
6    (725 ILCS 5/110-13)  (from Ch. 38, par. 110-13)
7    Sec. 110-13. Persons prohibited from furnishing bail
8security.
9    No attorney at law practicing in this State and no official
10authorized to admit another to bail or to accept bail shall
11furnish any part of any security for bail in any criminal
12action or any proceeding nor shall any such person act as
13surety for any accused admitted to bail. Nothing in this
14Section prohibits an attorney at law or an official authorized
15to admit another to bail or to accept bail from furnishing any
16part of any security for bail if the bail security was derived
17from donations collected by a nonprofit organization which
18receives donations from the public on behalf of the defendant
19to provide bail security for the defendant and neither the
20attorney at law nor official or an immediate family member of
21the attorney at law or the official: (1) donated funds or other
22property to the nonprofit organization on behalf of the
23defendant for his or her bail security; or (2) is an officer or

1director of the nonprofit organization. As used in this
2Section, "immediate family member" means a spouse, child,
3sibling, parent, grandparent, or grandchild, and includes
4step-parents, step-children, step-siblings, or adoptive
5relationships.
