SYNOPSIS AS INTRODUCED:
 
70 ILCS 1325/5 new

    Amends the Park District Police Act. Provides that a park district may employ auxiliary police officers and use auxiliary police officers when it is impractical for members of the regular park district police force to perform their normal and regular police duties. Provides that the auxiliary officers may not carry firearms without permission of the chief of police. Provides for hiring and training requirements for the auxiliary officers. Further provides that the Line of Duty Compensation Act shall be applicable to auxiliary officers upon their death in the line of duty. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Police Act is amended by
5adding Section 5 as follows:
 
6    (70 ILCS 1325/5 new)
7    Sec. 5. Auxiliary police officers.
8    (a) Auxiliary police officers shall not be members of the
9police force of the park district. Auxiliary police officers
10shall not supplement members of the regular police force of any
11park district in the performance of their assigned and normal
12duties, except as otherwise provided in this Code. When it is
13impractical for members of the regular police force to perform
14normal and regular police duties, the chief of police of the
15regular police force may assign auxiliary police officers to
16perform those normal and regular police duties. Identification
17symbols worn by auxiliary police officers shall be different
18and distinct from those used by members of the regular police
19force. Auxiliary police officers shall at all times during the
20performance of their duties be subject to the direction and
21control of the chief of police of the park district. Auxiliary
22police officers shall not carry firearms, except with the
23permission of the chief of police and while in uniform and in

1the performance of their duties. Auxiliary police officers,
2when on duty, shall also be conservators of the peace and shall
3have the powers specified in Section 3.1-15-25 of the Illinois
4Municipal Code.
5    (b) Auxiliary police officers, before entering upon any of
6their duties, shall receive a course of training in the use of
7weapons and other police procedures appropriate for the
8exercise of the powers conferred upon them. The training and
9course of study shall be determined and provided by the
10corporate authorities of each park district employing
11auxiliary police officers. Before being permitted to carry a
12firearm, however, an auxiliary police officer must have the
13same course of training as required of peace officers under
14Section 2 of the Peace Officer and Probation Officer Firearm
15Training Act. The park district authorities may require that
16all auxiliary police officers be residents of a municipality
17near the park district. Before the appointment of an auxiliary
18police officer, the person's fingerprints shall be taken, and
19no person shall be appointed as an auxiliary police officer if
20that person has been convicted of a felony or other crime
21involving moral turpitude.
22    (c) The Line of Duty Compensation Act shall be applicable
23to auxiliary police officers upon their death in the line of
24duty described in subsection (e) of Section 2 of that Act.
 
25    Section 99. Effective date. This Act takes effect upon
26becoming law.
