AMENDMENT TO HOUSE BILL 1047

2    AMENDMENT NO. ______. Amend House Bill 1047 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Wildlife Code is amended by changing
5Sections 1.13, 2.6, 2.7, and 2.13 as follows:
 
6    (520 ILCS 5/1.13)  (from Ch. 61, par. 1.13)
7    Sec. 1.13. The Department is authorized to issue a "Public
8Hunting Grounds for Waterfowl" daily usage stamp at a fee not
9to exceed $10 for duck hunting areas, and not to exceed $15 for
10Canada goose hunting areas; and assess a daily "Public Hunting
11Grounds for Game Birds Pheasants" fee not to exceed $25 ($35
12for non-residents) in 2008 and increasing by $5 every third
13year until the maximum fee is $50 ($60 for non-residents). Each
14person shall obtain such a stamp from the Department to be
15attached to the permit assigned to a person, or pay the daily
16fee to hunt game birds pheasants, under the provisions of the

1rules and regulations made by the Department for the operation
2of State Public Hunting Grounds. Rulemaking authority to
3implement this amendatory Act of the 95th General Assembly, if
4any, is conditioned on the rules being adopted in accordance
5with all provisions of the Illinois Administrative Procedure
6Act and all rules and procedures of the Joint Committee on
7Administrative Rules; any purported rule not so adopted, for
8whatever reason, is unauthorized.
9    The Department is authorized to permit hunters to harvest
10both male and female hand reared pheasants, bobwhite quail,
11chukar partridge, and gray partridge released on such public
12hunting grounds. The Department is further authorized to permit
13hunters to harvest hand-reared game birds on State Public
14Hunting Grounds during a season set by administrative rule
15between the dates of September 1 and March 31, both inclusive.
16    The Department shall cause an administrative rule, setting
17forth the rules and regulations for the operation of Public
18Hunting Areas on lands and waters owned or leased by this
19State.

22    Sec. 2.6. Pheasant season; limits.
23    It shall be unlawful for any person to take cock pheasants
24except with shotgun or bow and arrow during the open season
25which will be set annually by the Director between the dates of

1October 15--January 31st, both inclusive, except as provided in
2Section 1.13. Dogs may be used in hunting with either shotgun
3or bow and arrow.
4    It shall be unlawful to take or possess more than the daily
5limit and possession limit of cock pheasants. The daily and
6possession limits for cock pheasants shall be set annually by
7the Director of the Department and shall not exceed a daily
8limit of 3 and a possession limit of 6, except as provided by
9Sections 1.13, 3.27 and 3.28 of this Act.
10    It is unlawful to remove plumage of pheasants in the field
11or while being transported from the field to one's home or to a
12commercial preservation facility.
13    It shall be unlawful to take or possess hen pheasants at
14any time, except as provided in Section 2.4, 3.23 or 3.27.
15    The provisions of this Section are subject to modification
16by administrative rule.

20except with shotgun, or bow and arrow, and only during the open
21season which will be set annually by the Director between the
22dates of October 15th - January 31st, both inclusive, except as
23provided in Section 1.13. Dogs may be used in hunting with
24either shotgun or bow and arrow.

1limit and possession limit of bobwhite quail that shall be set
2annually by the Director of the Department which cannot exceed
3a daily take limit of 10 and a possession limit of 20.
4    The provisions of this Section are subject to modification
5by administrative rule.

8    Sec. 2.13. It shall be unlawful for any person to take
9Hungarian partridge except with shotgun, or bow and arrow,
10during the open season which will be set annually by the
11Director between the dates of October 15th - January 31st, both
12inclusive, except as provided in Section 1.13.
13    It shall be unlawful to take or possess more than the daily
14limit and possession limit of Hungarian partridge that will be
15set annually by the Director of the Department which cannot
16exceed a daily take limit of 6 and a possession limit of 12.
17Dogs may be used in hunting with either gun or bow and arrow.
