SENATE JOINT RESOLUTION

 
2    WHEREAS, The Ninety-second Congress of the United States of
3America, at its Second Session, adopted a Joint Resolution to
4amend the Constitution of the United States of America with
5language commonly referred to as the Equal Rights Amendment;
6and
 
7    WHEREAS, The proposed amendment was sent to the states for
8ratification, but was not ratified within the time period
9established by Congress; and
 
10    WHEREAS, The Illinois Constitution guarantees that equal
11protection of the laws shall not be denied or abridged on
12account of sex by the State or its units of local government
13and school districts; therefore, be it
 
14    RESOLVED, BY THE SENATE OF THE NINETY-EIGHTH GENERAL
15ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
16CONCURRING HEREIN, that we hereby apply to Congress to call a
17limited constitutional convention for the purpose of proposing
18to the states for ratification an amendment to the United
19States Constitution; and be it further
 
20    RESOLVED, That this amendment should be worded as follows,
21without substantial alteration: "The equal protection of the

1laws shall not be denied or abridged on account of sex by the
2United States or any State."; and be it further
 
3    RESOLVED, That this application constitutes a continuing
4application in accordance with Article V of the United States
5Constitution until at least two-thirds of the legislatures of
6the several states have made application for a limited
7constitutional convention; and be it further
 
8    RESOLVED, That, if the limited convention called by
9Congress is not limited to the topics proposed in this
10resolution, that this resolution calling for a convention shall
11be considered null and void and legally insufficient to be
12considered under Article V as one of the two-thirds of the
13several state resolutions necessary to call a limited
14constitutional convention; if a limited convention were to
15consider topics beyond the limited scope of this call for a
16constitutional convention, delegates, representatives, or
17participants shall be selected by the citizens of the State of
18Illinois to participate in the limited convention and shall be
19permitted to vote only on proposed amendments topically
20contained within the scope of this call and shall be instructed
21to vote against any other proposed amendments; and be it
22further
 
23    RESOLVED, That, if two-thirds of the legislatures of the

1several states make application to Congress to call a limited
2constitutional convention, the State of Illinois requests that
3such a convention be called not later than 6 months after
4Congress receives the necessary applications from state
5legislatures; and be it further
 
6    RESOLVED, That suitable copies of this resolution be
7presented to the Speaker and Clerk of the United States House
8of Representatives, the President Pro Tempore and Secretary of
9the United States Senate, the members of the Illinois
10congressional delegation, the presiding officers of each
11chamber of each state legislature in the United States, and the
12news media of the State of Illinois.
