AMENDMENT TO SENATE BILL 3513

2    AMENDMENT NO. ______. Amend Senate Bill 3513 as follows:
 
3on page 17, immediately below line 20, by inserting the
4following:
 
5    "(225 ILCS 65/80-25 new)
6    Sec. 80-25. Department rules. The Department shall be
7required to implement any rules adopted under this Article 80
8within 120 days after the effective date of this amendatory Act
9of the 98th General Assembly."; and
 
10by replacing line 9 on page 36 through line 2 on page 38 with
11the following:
12    "(n) A practical nurse licensed by a party state under the
13Nurse Licensure Compact under Article 80 of this Act is granted
14the privilege to practice practical nursing in this State. The
15employer of a practical nurse exercising the practice privilege

1afforded under this subsection (n) who provides direct patient
2care in Illinois shall file a report with the Department as
3determined by rule. The report shall be in a form and manner
4designated by the Department and shall include without
5limitation the name, address, social security number, and
6current licensure information of the nurse and any other
7information deemed necessary by the Department, as defined by
8rule. The Department may revoke or limit the multistate
9licensure privilege of any practical nurse to practice in
10Illinois necessary to protect the health and safety of the
11public.
12    (o) A practical nurse licensed by a party state under the
13Nurse Licensure Compact under Article 80 of this Act shall be
14denied the privilege to practice by the Department if he or
15she: (1) has been convicted of a criminal act that requires
16registration under the Sex Offender Registration Act; (2) has
17been convicted of a criminal battery against any patient in the
18course of patient care or treatment, including any offense
19based on sexual conduct or sexual penetration; (3) has been
20convicted of a forcible felony; (4) is required as a part of a
21criminal sentence to register under the Sex Offender
22Registration Act; or (5) is convicted of any other crime or
23engages in any conduct that would be grounds for discipline
24under subsection (a) of Section 2105-165 of the Department of
25Professional Regulation Law of the Civil Administrative Code of
26Illinois.

1    (p) Each practical nurse licensed by a party state under
2the Nurse Licensure Compact under Article 80 of this Act who
3intends to provide direct patient care in this State shall be
4subject to the requirements of Section 50-35 of this Act and
5shall have his or her fingerprints submitted to the Department
6of State Police in accordance with the requirements of Section
750-35. Fingerprints shall be submitted within 60 days prior to
8practice in this State."; and
 
9by replacing line 16 on page 46 through line 9 on page 48 with
10the following:
11    "(n) A registered nurse licensed by a party state under the
12Nurse Licensure Compact under Article 80 of this Act is granted
13the privilege to practice registered nursing in this State. The
14employer of a registered nurse exercising the practice
15privilege afforded under this subsection (n) who provides
16direct patient care in Illinois shall file a report with the
17Department as determined by rule. The report shall be in a form
18and manner designated by the Department and shall include
19without limitation the name, address, social security number,
20and current licensure information of the nurse and any other
21information deemed necessary by the Department, as defined by
22rule. The Department may revoke or limit the multistate
23licensure privilege of any registered nurse to practice in
24Illinois necessary to protect the health and safety of the
