SYNOPSIS AS INTRODUCED:
 
730 ILCS 125/11  from Ch. 75, par. 111

    Amends the County Jail Act. Provides that a minor who is transferred to adult jurisdiction may be confined in a county jail if he or she is properly classified and supervised to comply with the federal Prison Rape Elimination Act of 2003 as nearly as possible.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The County Jail Act is amended by changing
5Section 11 as follows:
 
6    (730 ILCS 125/11)  (from Ch. 75, par. 111)
7    Sec. 11. Debtors and witnesses shall not be confined in the
8same room with other prisoners; male and female prisoners shall
9not be kept in the same room; minors shall be kept separate
10from those previously convicted of a felony or other infamous
11crime; and persons charged with an offense shall not be
12confined in the same cell as those convicted of a crime. The
13confinement of those persons convicted of a misdemeanor or
14felony shall be in accordance with a classification system
15developed and implemented by the local jail authority.
16    A minor who is transferred to adult jurisdiction may be
17confined in a county jail if he or she is properly classified
18and supervised to comply with the federal Prison Rape
19Elimination Act of 2003 as nearly as possible.
