AMENDMENT TO SENATE BILL 3099

2    AMENDMENT NO. ______. Amend Senate Bill 3099 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Services Assurance Act for FY2008 is
5amended by adding Section 3-25 as follows:
 
6    (5 ILCS 382/3-25 new)
7    Sec. 3-25. Language access services.
8    (a) As used in this Section:
9    "Executive branch State agency" or "agency" means each
10Department of State government created under the Civil
11Administrative Code of Illinois.
12    "Having limited English proficiency" means indicated on
13the most recent federal decennial census as speaking a language
14other than English and speaking English "not well" or "not at
15all".
16    "Important documents" means application or informational

1materials, notices, and complaint forms offered by executive
2branch State agencies, as defined by rule by the appropriate
3executive branch State agency. "Important documents" does not
4include applications and examinations related to the
5licensure, certification, or registration of businesses and
6professionals.
7    "Sufficient number of qualified bilingual persons in
8public contact positions" means the number of qualified
9bilingual persons required in order to provide the same level
10of service to non-English-speaking persons as is available to
11English-speaking persons seeking the same service.
12    (b) Each executive branch State agency shall take
13reasonable steps to provide the following in each county where
14the number of residents in a single language group is more than
155% of all residents of that county as measured by the most
16recent federal decennial census:
17        (1) Having a sufficient number of qualified bilingual
18    persons in public contact positions or as interpreters in
19    at least one office in the county, determined by the agency
20    to be in an area of need, to assist in providing services
21    to individuals having limited English proficiency.
22        (2) Having available in at least one office in the
23    county, determined by the agency to be in an area of need,
24    personnel to interpret, upon request, important documents
25    ordinarily provided to the public.
26    (c) Nothing in this Section requires an executive branch

1State agency to establish an office in a county where it would
2not otherwise maintain an office.
3    (d) Each executive branch State agency shall adopt rules
4regarding the requirements of this Section not less than 6
5months after the date that this Act takes effect, or as soon
6thereafter as possible.
7    (e) The Illinois Human Rights Commission shall implement a
8process to address disputes arising under this Section,
9including, but not limited to, disputes concerning the
10interpretation of "important documents" and "sufficient number
11of qualified bilingual persons in public contact positions" and
12agency determinations of the offices where the services are
13provided, not less than 6 months after the date that this
14amendatory Act of the 98th General Assembly takes effect, or as
15soon thereafter as possible.".
