SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/7-202  from Ch. 121, par. 7-202
605 ILCS 5/7-202.23 new

    Amends the Illinois Highway Code. Provides that motor fuel tax funds allotted to municipalities may be used for the treatment or removal of trees infected with Dutch elm disease or ash trees infected with the emerald ash borer from any parcel of public or private property within the municipality.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Section 7-202 and by adding Section 7-202.23 as follows:
 
6    (605 ILCS 5/7-202)  (from Ch. 121, par. 7-202)
7    Sec. 7-202. Motor fuel tax funds allotted to the several
8municipalities shall be used for one or more of the purposes
9stated in Sections 7-202.1 through 7-202.23 7-202.22.

12    Sec. 7-202.23. Treatment or removal of elm trees infected
13with Dutch elm disease or ash trees infected with the emerald
14ash borer (Agrilus planipennis Fairmaire) from any parcel of
15public or private property within the municipality. Moneys used
16for the treatment or removal of trees on private property under
17this Section are eligible for reimbursement under Section
1811-20-12 of the Illinois Municipal Code.
