SYNOPSIS AS INTRODUCED:

    Amends the Southern Illinois University Management Act. Provides that on the effective date of the amendatory Act, the terms of office of the members of the Board of Trustees of Southern Illinois University serving on that effective date shall terminate and the Board shall be reconstituted. With regard to the 7 members of the Board appointed by the Governor, by and with the advice and consent of the Senate, specifies that after the effective date of the amendatory Act, the 7 members shall be appointed as follows: at least 3 appointees shall hold an undergraduate or graduate degree from the Southern Illinois University at Edwardsville campus and at least 3 appointees shall hold an undergraduate or graduate degree from the Southern Illinois University at Carbondale campus. Includes one additional voting student member and deletes provisions concerning the designation of a voting student member and a nonvoting student member; makes related changes. Sets forth provisions concerning the expiration of the terms of the 7 initial members appointed by the Governor, by and with the advice and consent of the Senate, pursuant to the amendatory Act.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Southern Illinois University Management Act
5is amended by changing Sections 2, 4, and 5 as follows:
 
6    (110 ILCS 520/2)  (from Ch. 144, par. 652)
7    Sec. 2. On the effective date of this amendatory Act of the
898th General Assembly, the terms of office of the members of
9the Board serving on that effective date shall terminate and
10the Board shall be reconstituted. After the effective date of
11this amendatory Act of the 98th General Assembly, the The Board
12shall consist of 7 members appointed by the Governor, by and
13with the advice and consent of the Senate, as follows: at least
143 appointees shall hold an undergraduate or graduate degree
15from the Southern Illinois University at Edwardsville campus
16and at least 3 appointees shall hold an undergraduate or
17graduate degree from the Southern Illinois University at
18Carbondale campus. The Board shall also consist of the
19Superintendent of Public Instruction, or his chief assistant
20for liaison with higher education when designated to serve in
21his place, ex-officio, and 2 one voting student members. member
22designated by the Governor from one campus of the University
23and one nonvoting student member from the campus of the

1University not represented by the voting student member. The
2Governor shall designate one of the student members serving on
3the Board to serve as the voting student member. Each student
4member shall be selected chosen by the respective campuses of
5Southern Illinois University at Carbondale and Edwardsville.
6The method of selecting choosing these student members shall be
7by campus-wide student election, and any student designated by
8the Governor to be a voting student member shall be one of the
9students chosen by this method. The student members shall serve
10terms of one year beginning on July 1 of each year, except that
11the student members initially selected shall serve a term
12beginning on the date of such selection and expiring on the
13next succeeding June 30. To be eligible for selection as a
14student member and to be eligible to remain as a voting or
15nonvoting student member of the Board, a student member must be
16a resident of this State, must have and maintain a grade point
17average that is equivalent to at least 2.5 on a 4.0 scale, and
18must be a full time student enrolled at all times during his or
19her term of office except for that part of the term which
20follows the completion of the last full regular semester of an
21academic year and precedes the first full regular semester of
22the succeeding academic year at the university (sometimes
23commonly referred to as the summer session or summer school).
24If a voting or nonvoting student member serving on the Board
25fails to continue to meet or maintain the residency, minimum
26grade point average, or enrollment requirement established by

1this Section, his or her membership on the Board shall be
2deemed to have terminated by operation of law. No more than 4
3of the members appointed by the Governor shall be affiliated
4with the same political party. Each member appointed by the
5Governor must be a resident of this State. A failure to meet or
6maintain this residency requirement constitutes a resignation
7from and creates a vacancy in the Board. The terms of the
8members appointed by the Governor, by and with the advice and
9consent of the Senate, pursuant to this amendatory Act of the
1098th General Assembly shall expire as follows: the terms of one
11member each from the Southern Illinois University at
12Edwardsville campus and the Southern Illinois University at
13Carbondale campus shall expire on the third Monday in January
142016; the terms of one member each from the Southern Illinois
15University at Edwardsville campus and the Southern Illinois
16University at Carbondale campus shall expire on the third
17Monday in January 2018; and the terms of the remaining 3
18members shall expire on the third Monday in January 2020. Upon
19the expiration of the terms of members appointed by the
20Governor, their respective successors shall be appointed for
21terms of 6 years from the third Monday in January of each
22odd-numbered year and until their respective successors are
23appointed for like terms. If the Senate is not in session
24appointments shall be made as in the case of vacancies.

2    Sec. 4. Members of the Board shall serve without
3compensation but shall be entitled to reasonable amounts for
4expenses necessarily incurred in the performance of their
5duties. Such expenses incurred by any non-voting student member
6may, at the discretion of the Chairman of the Board, be
7provided for by advance payment to such member, who shall
8account therefor to the Board immediately after each meeting.
9    No member of the Board shall hold or be employed in or
10appointed to any office or place under the authority of the
11Board, nor shall any member of the Board be directly or
12indirectly interested in any contract made by the Board, nor
13shall he be an employee of the State Government. This section
14does not prohibit the student members of the Board from
15maintaining normal and official status as enrolled students or
16normal student employment at Southern Illinois University.

19    Sec. 5. Members of the Board shall elect annually by secret
20ballot from their own number a chairman who shall preside over
21meetings of the Board and a secretary.
22    Meetings of the Board shall be held at least once each
23quarter on a campus of Southern Illinois University. At all
24regular meetings of the Board, a majority of its voting members

1shall constitute a quorum. The student members shall have all
2of the privileges of membership, including the right to make
3and second motions and to attend executive sessions and , other
4than the right to vote, except that the student member
5designated by the Governor as the voting student member shall
6have the right to vote on all Board matters except those
7involving faculty tenure, faculty promotion, or any issue on
8which the student member has a direct conflict of interest. A
9student member who is not entitled to vote on a measure at a
10meeting of the Board or any of its committees shall not be
11considered a member for the purpose of determining whether a
12quorum is present at the time that measure is voted upon. No
13action of the Board shall be invalidated by reason of any
14vacancies on the Board, or by reason of any failure to select a
15student member.
16    Special meetings of the Board may be called by the chairman
17of the Board or by any 3 members of the Board.
18    At each regular and special meeting that is open to the
19public, members of the public and employees of the University
20shall be afforded time, subject to reasonable constraints, to
21make comments to or ask questions of the Board.
