    Amends the Tanning Facility Permit Act. Provides that the Department of Public Health may deny a permit under the Act, or refuse to renew a permit, in the case of an owner or operator who is certified by the Department of Healthcare and Family Services as being more than 30 days delinquent in complying with a child support order or who is certified by a court as being in violation of the Non-Support Punishment Act for more than 60 days.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Tanning Facility Permit Act is amended by
5changing Sections 10 and 15 as follows:
 
6    (210 ILCS 145/10)  (from Ch. 111 1/2, par. 8351-10)
7    Sec. 10. Permit; fees; application.
8    (a) A permit issued by the Department shall be required
9prior to the operation of any tanning facility used by the
10public for a fee or other compensation. The owner of the
11facility shall file an application for a permit with the
12Department on a form prescribed by the Department that shall
13include at least the following information:
14        (1) Applicant's (owner) name, address, telephone
15    number.
16        (2) Name of the tanning facility, address, telephone
17    number.
18        (3) Type and year of manufacture of equipment proposed
19    to be used for such tanning devices.
20        (4) Primary function of the business in which the
21    tanning facility is located.
22        (5) Operating procedures to be used in the facility.
23    (b) A fee of $250 shall be submitted with the application

1to the Department.
2    (c) If the owner owns or operates more than one tanning
3facility, the owner shall file a separate application for each
4facility owned or operated.
5    (d) Within 90 days of receipt of an application, the
6Department's personnel shall complete the initial inspection
7of the premises of the tanning facility and ensure that the
8premises and the tanning facilities are installed and will be
9operated in accordance with this ordinance.
10    (e) Except as provided in subsection (e-5), upon Upon
11submission of the application and the required fee, and if the
12initial inspection of the premises indicates that the premises
13and the tanning facilities are installed and will be operated
14in accordance with this Act, the Department shall issue a
15permit to the owner or operator.
16    (e-5) The Department may deny a permit to an owner or
17operator who is certified by the Department of Healthcare and
18Family Services as being more than 30 days delinquent in
19complying with a child support order or who is certified by a
20court as being in violation of the Non-Support Punishment Act
21for more than 60 days.
22    (f) The permit issued by the Department shall be effective
23for one year following the date of issuance. The Department may
24stagger permit renewal dates on a quarterly basis with an
25initial permit being effective from 9 months to 15 months. The
26permit is valid only for the location and owner stated on the

1permit and is not transferable.
2    (g) The permit shall be displayed in a place within sight
3of the public when entering the premises of the tanning
4facility.
5    (h) In the event of a change of ownership, the new owner
6will be required to apply for a permit to own and operate a
7tanning facility prior to taking possession of the property. A
8provisional license may be issued by the Department until an
9initial inspection for a permit can be performed by the
10Department.

13    Sec. 15. Permit renewal procedures; inspections.
14    (a) All permits issued by the Department under this Act
15shall expire on a specified date and may be renewed by
16submission to the Department at least 30 days before the
17expiration date a permit renewal application and the annual
18renewal fee of $150.
19    (b) The Department may refuse to renew the permit of any
20owner or operator who has been found to be in violation of this
21Act for the safe operation of tanning facilities.
22    (b-5) The Department may refuse to renew the permit of an
23owner or operator who is certified by the Department of
24Healthcare and Family Services as being more than 30 days
25delinquent in complying with a child support order or who is

1certified by a court as being in violation of the Non-Support
2Punishment Act for more than 60 days.
3    (c) Each tanning facility shall be inspected at least once
4each year after the initial year in which the facility was
5granted a permit.
