105 ILCS 5/34-18.48 new

    Amends the School Code. Provides that if a student athlete has not met practice requirements for a high school sport due to the student's involvement in military training, then a waiver to participate in play in the regular season for that sport may be granted by the school board. Sets forth the waiver process. Provides for immunity from any liability for a coach, athletic director, school, school board, and school district with respect to the granting of a waiver. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.55 and 34-18.48 as follows:
 
6    (105 ILCS 5/10-20.55 new)
7    Sec. 10-20.55. Military training athletic waiver. If a
8student athlete has not met practice requirements for a high
9school sport due to the student's involvement in military
10training, then a waiver to participate in play in the regular
11season for that sport may be granted by the school board. Under
12this waiver process, the student may apply for the waiver with
13his or her respective coach or athletic director, and the coach
14or athletic director shall review the waiver and make a
15recommendation to the school board on whether to grant or deny
16the waiver. Except for an act of willful or wanton misconduct,
17a coach, athletic director, school, school board, and school
18district shall have immunity from any liability, whether civil
19or criminal or that otherwise might result from the granting of
20a waiver, and the waiver shall acknowledge that fact.
