AMENDMENT TO SENATE BILL 928

2    AMENDMENT NO. ______. Amend Senate Bill 928 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 11-1414.1 as follows:
 
6    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
7    Sec. 11-1414.1. School transportation of students.
8    (a) Every student enrolled in grade 12 or below in any
9entity listed in subsection (a) of Section 1-182 of this Code
10must be transported in a school bus or a vehicle described in
11subdivision (1) or (2) of subsection (b) of Section 1-182 of
12this Code for any curriculum-related school activity, except a
13student in any of grades 9 through 12 may be transported in a
14multi-function school activity bus (MFSAB) as defined in
15Section 1-148.3a-5 of this Code for any curriculum-related
16activity except for transportation on regular bus routes from

1home to school or from school to home, subject to the following
2conditions:
3        (i) A MFSAB may not be used to transport students under
4    this Section unless the driver holds a valid school bus
5    driver permit.
6        (ii) The use of a MFSAB under this Section is subject
7    to the requirements of Sections 6-106.11, 6-106.12,
8    12-707.01, 13-101, and 13-109 of this Code.
9    "Curriculum-related school activity" as used in this
10subsection (a) includes transportation from home to school or
11from school to home, tripper or shuttle service between school
12attendance centers, transportation to a vocational or career
13center or other trade-skill development site or a regional safe
14school or other school-sponsored alternative learning program,
15or a trip that is directly related to the regular curriculum of
16a student for which he or she earns credit.
17    (b) Every student enrolled in grade 12 or below in any
18entity listed in subsection (a) of Section 1-182 of this Code
19who is transported in a vehicle that is being operated by or
20for a public or private primary or secondary school, including
21any primary or secondary school operated by a religious
22institution, for an interscholastic, interscholastic-athletic,
23or school-sponsored, noncurriculum-related activity that (i)
24does not require student participation as part of the
25educational services of the entity and (ii) is not associated
26with the students' regular class-for-credit schedule shall

1transport students only in a school bus or vehicle described in
2subsection (b) of Section 1-182 of this Code. This subsection
3(b) does not apply to any second division vehicle used by an
4entity listed in subsection (a) of Section 1-182 of this Code
5for a parade, homecoming, or a similar noncurriculum-related
6school activity.
7    (c) Notwithstanding any provision of law to the contrary, a
8multifunction school activity bus may be used to transport
9students for any purpose if those students are in grades K
10through 12 and have an Individualized Education Plan with a
11staff to student ratio of 1 to 5.
