HOUSE RESOLUTION

 
2    WHEREAS, The Drycleaner Environmental Response Trust Fund
3Council has delegated many of its programmatic
4responsibilities under the Drycleaner Environmental Response
5Trust Fund Act, including the duty to receive and process
6license applications and the duty to receive and process
7claims, to a private company, Williams and Company Consulting,
8Inc.; and
 
9    WHEREAS, This delegation of programmatic duties
10potentially threatens the integrity of the regulatory scheme
11established under the Drycleaner Environmental Response Trust
12Fund Act; therefore, be it
 
13    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
14NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that,
15when conducting the next scheduled annual audit of the
16Drycleaner Environmental Response Trust Fund Council, we urge
17the Auditor General to investigate and report on:
18        (1) whether Williams and Company Consulting, Inc., is
19    administering the Council's programmatic responsibilities
20    in a manner that is consistent with the requirements of the
21    Drycleaner Environmental Response Trust Fund Act and rules
22    adopted under that Act, as well as all relevant State
23    procurement laws;

1        (2) the gross revenues of the Drycleaner Environmental
2    Response Trust Fund during each of the last 14 years, as
3    well as the total expenditures from the Fund for remedial
4    actions of drycleaning solvent releases at drycleaning
5    facilities in the State during each of those years;
6        (3) expenses that Williams and Company Consulting,
7    Inc., has billed for acting as the administrator of the
8    Fund during each of the years of its current contract with
9    the Drycleaner Environmental Response Trust Fund Council;
10        (4) the amount paid from the Fund to each State agency,
11    as defined in the Illinois State Auditing Act, during each
12    of the last 14 years;
13        (5) any ancillary charges that Williams and Company,
14    Inc., imposes against owners and operators for the
15    administrative services that it provides; and
16        (6) the number of Illinois drycleaners whose
17    properties are in need of remedial action and whose
18    participation in the State's drycleaner environmental
19    cleanup insurance system has been terminated for
20    noncompliance with the Drycleaner Environmental Response
21    Trust Fund Act and rules adopted under that Act; and be it
22    further
 
23    RESOLVED, That the Auditor General commence its next annual
24audit of the Council as soon as possible and report the
25findings and recommendations upon completion in accordance

1with the Illinois State Auditing Act; and be it further
 
2    RESOLVED, That the Drycleaner Environmental Response Trust
3Fund Council and Williams and Company Consulting, Inc., shall
4provide all needed information that the Auditor General deems
5necessary; and be it further
 
6    RESOLVED, That copies of this resolution be delivered to
7the Auditor General and to each of the member of the Drycleaner
8Environmental Response Trust Fund Council.
