SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/11-25

    Amends the Criminal Code of 2012. In the statute concerning grooming, defines "child" as a person under 18 years of age. Provides that the penalty for grooming is a Class 3 (rather than a Class 4) felony if the child is 14 years of age or older or if the person believed by the offender to be a child purports to be 14 years of age or older. Provides that grooming is a Class 2 felony if the child is under 14 years of age or if the person believed by the offender to be a child purports to be under 14 years of age.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 11-25 as follows:
 
6    (720 ILCS 5/11-25)
7    Sec. 11-25. Grooming.
8    (a) A person commits the offense of grooming when he or she
9knowingly uses a computer on-line service, Internet service,
10local bulletin board service, or any other device capable of
11electronic data storage or transmission to seduce, solicit,
12lure, or entice, or attempt to seduce, solicit, lure, or
13entice, a child, a child's guardian, or another person believed
14by the person to be a child or a child's guardian, to commit
15any sex offense as defined in Section 2 of the Sex Offender
16Registration Act or to otherwise engage in any unlawful sexual
17conduct with a child or with another person believed by the
18person to be a child.
19    (b) Sentence. Grooming is a Class 3 4 felony if the child
20is 14 years of age or older or if the person believed by the
21offender to be a child purports to be 14 years of age or older.
22Grooming is a Class 2 felony if the child is under 14 years of
23age or if the person believed by the offender to be a child

2    (c) As used in this Section, "child" means a person under
318 years of age.
