SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/29-6.3

    Amends the Transportation Article of the School Code. Provides that the Section concerning transportation to and from specified interscholastic or school-sponsored activities does not apply to students with disabilities who are eligible under the federal Individuals with Disabilities Education Act and the Children with Disabilities Article of the Code and who are receiving transportation for curriculum-related activities as part of the student's individualized educational program.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
529-6.3 as follows:
 
6    (105 ILCS 5/29-6.3)
7    Sec. 29-6.3. Transportation to and from specified
8interscholastic or school-sponsored activities.
9    (a) Any school district transporting students in grade 12
10or below for an interscholastic, interscholastic athletic, or
11school-sponsored, noncurriculum-related activity that (i) does
12not require student participation as part of the educational
13services of the district and (ii) is not associated with the
14students' regular class-for-credit schedule or required 5
15clock hours of instruction shall transport the students only in
16a school bus, a vehicle manufactured to transport not more than
1710 persons, including the driver, or a multifunction
18school-activity bus manufactured to transport not more than 15
19persons, including the driver.
20    (a-5) A student in any of grades 9 through 12 may be
21transported in a multi-function school activity bus (MFSAB) as
22defined in Section 1-148.3a-5 of the Illinois Vehicle Code for
23any curriculum-related activity except for transportation on

1regular bus routes from home to school or from school to home,
2subject to the following conditions:
3        (i) A MFSAB may not be used to transport students under
4    this Section unless the driver holds a valid school bus
5    driver permit.
6        (ii) The use of a MFSAB under this Section is subject
7    to the requirements of Sections 6-106.11, 6-106.12,
8    12-707.01, 13-101, and 13-109 of the Illinois Vehicle Code.
9    (b) Any school district furnishing transportation for
10students under the authority of this Section shall insure
11against any loss or liability of the district resulting from
12the maintenance, operation, or use of the vehicle.
13    (c) Vehicles used to transport students under this Section
14may claim a depreciation allowance of 20% over 5 years as
15provided in Section 29-5 of this Code.
16    (d) This Section does not apply to students with
17disabilities who are eligible under the federal Individuals
18with Disabilities Education Act and Article 14 of this Code and
19who are receiving transportation for curriculum-related
20activities as part of the student's individualized educational
21program.
