1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Choice of Law and Forum Act is amended by
5changing Section 5-5 as follows:
 
6    (735 ILCS 105/5-5)
7    Sec. 5-5. Choice of law. The parties to any any contract,
8agreement, or undertaking, contingent or otherwise, in
9consideration of or relating to any obligation arising out of a
10transaction covering in the aggregate not less than $250,000,
11including a transaction otherwise covered by subsection (1) of
12Section 1-105 of the Uniform Commercial Code, may agree that
13the law of this State shall govern their rights and duties in
14whole or in part, whether or not the contract, agreement, or
15undertaking bears a reasonable relation to this State. This
16Section shall not apply to any contract, agreement, or
17undertaking (i) for labor or personal services, (ii) relating
18to any transaction for personal, family, or household services,
19or (iii) to the extent provided to the contrary in subsection
20(2) of Section 1-105 of the Uniform Commercial Code. Nothing
21contained in this Section shall be construed to limit or deny
22the enforcement of any provision respecting choice of law in
23any other contract, agreement, or undertaking.
