SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-31 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides for a minimum monthly personal needs allowance, subject to appropriation, for persons who are inpatients in a facility licensed under the ID/DD Community Care Act and who are eligible for Medicaid. Provides that the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act, so that the person's total monthly personal needs allowance from both State and federal sources equals $50. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-31 as follows:
 
6    (305 ILCS 5/5-31 new)
7    Sec. 5-31. Personal needs allowance. Subject to
8appropriation, for a person who is an inpatient in a facility
9licensed under the ID/DD Community Care Act for which payments
10are made under this Article throughout a month and who is
11determined to be eligible for medical assistance under this
12Article, the State shall pay an amount in addition to the
13minimum monthly personal needs allowance authorized under
14Section 1902(q) of Title XIX of the Social Security Act (42
15U.S.C. 1396a(q)), so that the person's total monthly personal
16needs allowance from both State and federal sources equals $50.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
