SYNOPSIS AS INTRODUCED:
 
70 ILCS 1290/1  from Ch. 105, par. 326

    Amends the Park District Aquarium and Museum Act. Provides that any aquarium or museum in a county with a population of less than 3,000,000 inhabitants must be open to the public without charge for a period equivalent to 26 days each year. Further provides that any aquarium or museum in a county with a population of 3,000,000 or more inhabitants must be open to the public without charge for a period equivalent to 52 days each year. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Park District Aquarium and Museum Act is
5amended by changing Section 1 as follows:
 
6    (70 ILCS 1290/1)  (from Ch. 105, par. 326)
7    Sec. 1. Erect, operate, and maintain aquariums and museums.
8The corporate authorities of cities and park districts having
9the control or supervision of any public park or parks, are
10hereby authorized to purchase, erect and maintain within any
11public park or parks under the control or supervision of such
12corporate authorities, edifices to be used as aquariums or as
13museums of art, industry, science or natural or other history,
14or to permit the directors or trustees of any corporation or
15society organized for the construction or maintenance and
16operation of an aquarium or museum as hereinabove described to
17erect, enlarge, ornament, build, rebuild, rehabilitate,
18improve, maintain and operate its aquarium or museum or museums
19within any public park now or hereafter under the control or
20supervision of any city or park district, and to contract with
21any such directors or trustees of any such aquarium, museum or
22museums relative to the erection, enlargement, ornamentation,
23building, rebuilding, rehabilitation, improvement, maintenance

1and operation thereof. Any city or park district may charge, or
2permit such an aquarium or museum to charge, an admission fee.
3Any such aquarium or museum, however, shall be open without
4charge, when accompanied by a teacher, to the children in
5actual attendance upon grades kindergarten through twelve in
6any of the schools in this State at all times. Any such
7aquarium or museum in a county with a population of less than
83,000,000 inhabitants, however, must be open to persons who
9reside in this State without charge for a period equivalent to
1026 52 days, at least 6 of which must be during the period from
11June through August, each year. Any such aquarium or museum in
12a county with a population of 3,000,000 or more inhabitants,
13however, must be open to the public without charge for a period
14equivalent to 52 days, at least 6 of which must be during the
15period from June through August, each year. Notwithstanding
16said provisions, charges may be made at any time for special
17services and for admission to special facilities within any
18aquarium or museum for the education, entertainment or
19convenience of visitors. The proceeds of such admission fees
20and charges for special services and special facilities shall
21be devoted exclusively to the purposes for which the tax
22authorized by Section 2 hereof may be used. If any owner or
23owners of any lands or lots abutting or fronting on any such
24public park, or adjacent thereto, have any private right,
25easement, interest or property in such public park appurtenant
26to their lands or lots or otherwise, which would be interfered

1with by the erection and maintenance of any aquarium or museum
2as hereinbefore provided, or any right to have such public park
3remain open or vacant and free from buildings, the corporate
4authorities of the city or park district having control of such
5park, may condemn the same in the manner prescribed for the
6exercise of the right of eminent domain under the Eminent
7Domain Act.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
