| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Firearm Owners Identification Card Act is |
| 5 | | amended by changing Section 13.1 as follows:
|
| 6 | | (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
|
| 7 | | Sec. 13.1.
It is unlawful for any unit of local government, |
| 8 | | including a home rule unit of government, to require any person |
| 9 | | to obtain training or instruction in order to own or possess a |
| 10 | | firearm for his or her personal use. It is declared to be the |
| 11 | | policy of this State that the regulation of the right to own or |
| 12 | | possess a firearm is an exclusive power and function of the |
| 13 | | State. A home rule unit may not regulate the ownership or |
| 14 | | possession of firearms. This Section is a denial and limitation |
| 15 | | of home rule powers and functions under subsection (h) of |
| 16 | | Section 6 of Article VII of the Illinois Constitution. The |
| 17 | | provisions of any ordinance enacted by any municipality which
|
| 18 | | requires registration or imposes greater restrictions or |
| 19 | | limitations on the
acquisition, possession and transfer of |
| 20 | | firearms than are imposed by this
Act, are not invalidated or |
| 21 | | affected by this Act.
