AMENDMENT TO HOUSE BILL 183

2    AMENDMENT NO. ______. Amend House Bill 183, AS AMENDED, by
3replacing Section 1-100 with the following:
 
4    "Section 1-100. Home rule; exception.
5    (a) The regulation and licensing of the carrying of
6firearms are exclusive powers and functions of the State,
7except as provided in subsection (b) or (c) of this Section.
8This Section is a denial and limitation of home rule powers and
9functions under subsection (h) of Section 6 of Article VII of
10the Illinois Constitution.
11    (b) Within 6 months from the effective date of this Act:
12        (1) A home rule unit may adopt a resolution or
13    ordinance prohibiting the carrying of handguns in places or
14    locations within the municipality in addition to the
15    prohibited places or locations provided in Section 1-70 of
16    this Act.
17        (2) A home rule unit contiguous to a municipality with

1    a population of more than 2 million may adopt a resolution
2    or ordinance prohibiting the carrying of concealed
3    handguns by persons who do not have an endorsement issued
4    by the municipality with a population of more than 2
5    million as provided in Section 1-22 of this Act.
6    A home rule unit that chooses to adopt a resolution or
7ordinance in accordance with this Section must notify the
8Department within 10 days of its adoption. A home rule unit
9that amends a resolution or ordinance adopted under paragraph
10(1) of this subsection (b) after the 6 month period must notify
11the Department within 10 days of the change. A home rule unit
12that adopts a resolution or ordinance under paragraph (2) of
13this subsection (b) may not thereafter amend it. A home rule
14unit that does not adopt a resolution or ordinance within the 6
15month period may not thereafter adopt a resolution or ordinance
16under either paragraph (1) or (2) of this subsection (b).
17    (c) A municipality that becomes a home rule unit either by
18population or referendum after the effective date of this Act
19may within 6 months of becoming a home rule unit:
20        (1) May adopt a resolution or ordinance prohibiting the
21    carrying of handguns in place or locations within the
22    municipality in addition to the prohibited places or
23    locations provided in Section 1-70 of this Act and must
24    comply with the notification requirements provided in
25    subsection (b).
26        (2) If it is contiguous to a municipality with a

1    population of more than 2 million, may adopt a resolution
2    or ordinance prohibiting the carrying of concealed
3    handguns by persons who do not have an endorsement issued
4    by the municipality with a population of more than 2

7    subsection (b).".
