SYNOPSIS AS INTRODUCED:
 

 
  
770 ILCS 60/6  from Ch. 82, par. 6

     Amends the Mechanics Lien Act. Provides that, to obtain a lien under the Act, the work shall be done or the material furnished: within 3 years from the commencement of the work or the
commencement of furnishing the material in the case of work done or material
furnished as to owner-occupied residential property; and within 5 years from the commencement of the work or the
commencement of furnishing the material in the case of work done or material
furnished as to any other type of  property. Provides that the changes made by the  amendatory Act become inoperative 3 years after the effective date of the  amendatory Act.

1    AN ACT concerning civil law.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Mechanics Lien Act is amended  by changing 
5Section 6 as follows:

7    Sec. 6. 
In no event shall it be necessary to fix or 
8stipulate in any
contract a time for the completion or a time 
9for payment in order to obtain
a lien under this act, provided, 
10that the work is done or material
furnished within three years 
11from the commencement of said work or the
commencement of 
12furnishing said material in the case of work done or material 
13furnished as to owner-occupied residential property; and 
14within 5 years from the commencement of said work or the 
15commencement of furnishing said material in the case of work 
16done or material furnished as to any other type of property. 
17The changes made by this  amendatory Act of the 97th General 
18Assembly become inoperative 3 years after the effective date of 
19this amendatory Act of the 97th General Assembly.
