1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Military Code of Illinois is amended by
5changing Sections 22-2, 22-3, 22-6, 48, and 49 as follows:
 
6    (20 ILCS 1805/22-2)  (from Ch. 129, par. 220.22-2)
7    Sec. 22-2. The Adjutant General shall have the power and
8authority to sell, at a fair market price, Illinois National
9Guard facilities armories and lands under his jurisdiction when
10in his judgment such facilities armories and lands are
11obsolete, inadequate, unusable or no longer required for
12Illinois National Guard purposes. All such sales shall be
13subject to the written approval of the Governor. Where the sale
14price of the facility armory exceeds 3.5 million dollars, and
15the facility armory is located in any county with a population
16of l million or more, the authorization of the General Assembly
17will be required for the sale of such facility armory.

20    Sec. 22-3. All monies received from the sale of Illinois
21National Guard facilities armories and lands pursuant to

1State Treasury without delay and shall be covered into a
2special fund to be known as the Illinois National Guard Armory
3Construction Fund. The monies in this fund shall be used
4exclusively by the Adjutant General for the purpose of
5acquiring building sites and constructing new facilities
6armories. Expenditures from this fund shall be subject to
7appropriation by the General Assembly and written release by
8the Governor.

11    Sec. 22-6. All monies received from the transfer or
12exchange of any realty under the control of the Department
13pursuant to authority contained in Section 22-5 of this Act
14shall be paid into the State Treasury without delay and shall
15be covered into a special fund to be known as the Illinois
16National Guard Armory Construction Fund. The monies in this
17fund shall be used exclusively by the Adjutant General for the
18purpose of acquiring building sites and constructing new
19facilities armories. Expenditures from this fund shall be
20subject to appropriation by the General Assembly and written
21release by the Governor.

24    Sec. 48. When in active service of the State, under orders

1of the Commander-in-Chief, officers and warrant officers of the
2Illinois National Guard shall receive all the same pay as
3provided by law for officers and warrant officers of the armed
4forces of the United States of like grade and longevity.
5However, no officer or warrant officer shall receive less than
6$75 per day for each day's service performed.

9    Sec. 49. When in active service of the State, under orders
10of the Commander-in-Chief, enlisted personnel of the Illinois
11National Guard shall receive all the same pay as provided by
12law for enlisted personnel of the armed forces of the United
13States of like grade and longevity. However, no enlisted person
14shall receive less than $75 per day for each day's service
15performed.
