SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-31 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that no later than 30 days after the effective date of this amendatory Act, the Department of Healthcare and Family Services shall seek a waiver from the United States Department of Health and Human Services of the federal Medicaid Maintenance of Effort requirements under the Affordable Care Act in order to allow the Department to immediately implement the changes made by Public Act 96-1501 concerning eligibility standards, methodology, and procedures as applied to the medical assistance programs or other health benefit programs administered by the Department, including the Children's Health Insurance Program Act and the Covering ALL KIDS Health Insurance Act. Provides that no later than 60 days after the effective date of this amendatory Act, the Department shall submit to the federal Centers for Medicare and Medicaid Services any and all State Plan amendments necessary to implement all provisions enacted by Public Act 96-1501. Effective immediately.

2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-31 as follows:
 
6    (305 ILCS 5/5-31 new)
7    Sec. 5-31. Maintenance of Effort (MOE) requirements;
8waiver. No later than 30 days after the effective date of this
9amendatory Act of the 97th General Assembly, the Department of
10Healthcare and Family Services (Department) shall seek a waiver
11from the United States Department of Health and Human Services
12of the federal Medicaid Maintenance of Effort requirements
13under the Affordable Care Act in order to allow the Department
14to immediately implement the changes made by Public Act 96-1501
