1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Constitutional Amendment Act is
5amended by changing Sections 6 and 7 as follows:
 
6    (5 ILCS 20/6)  (from Ch. 1, par. 108)
7    Sec. 6. The county canvassing boards of the counties
8respectively shall at the time it opens the returns and makes
9abstracts of the votes cast at such elections for officers,
10also make abstracts in duplicate of the votes cast for and
11against such proposed amendment or amendments to the
12constitution. And immediately after the completion of the
13abstracts the county canvassing boards shall inclose one of the
14same in a sealed envelope, and indorse thereon the words
15"Abstract of votes for and against amendment of the
16constitution," and address and mail the same to the State Board
17of Elections secretary of state, and shall file the other of
18the abstracts in the county clerk's office.

21    Sec. 7. The State Board of Elections created by The
22Election Code shall proceed, within 31 20 days after the

1election and sooner if all the returns are received, to canvass
2the votes given for and against said amendment or amendments,
3as shown by said abstracts, and if it appears that a majority
4of the electors voting in the election or 3/5 of the electors
5voting on any such proposed amendment have voted for the
6proposed amendment or amendments, the same shall by said board
7be declared adopted, and become a part of the constitution of
8this state, and the governor shall cause proclamation to be
9made of the result of the vote, and that said amendment has
10become a part of the constitution, by publication in at least 2
11newspapers published at the seat of government.

13    Section 10. The Election Code is amended by changing
14Sections 7-11, 7-12, 7-59, 7-60, 8-10, 8-17, 10-1, 10-11.1,
1510-14, 17-16.1, 18-9.1, and 28-5 as follows:

17    Sec. 7-11. Any candidate for President of the United States
18may have his name printed upon the primary ballot of his
19political party by filing in the office of the State Board of
20Elections not more than 113 and not less than 106 days prior to
21the date of the general primary, in any year in which a
22Presidential election is to be held, a petition signed by not
23less than 3000 or more than 5000 primary electors, members of
24and affiliated with the party of which he is a candidate, and

1no candidate for President of the United States, who fails to
2comply with the provisions of this Article shall have his name
3printed upon any primary ballot: Provided, however, that if the
4rules or policies of a national political party conflict with
5such requirements for filing petitions for President of the
6United States in a presidential preference primary, the
7Chairman of the State central committee of such national
8political party shall notify the State Board of Elections in
9writing, citing by reference the rules or policies of the
10national political party in conflict, and in such case the
11Board shall direct such petitions to be filed not more than 78
1269 and not less than 71 62 days prior to the date of the general
13primary, in any year in which a Presidential election is to be
14held. Provided, further, unless rules or policies of a national
15political party otherwise provide, the vote for President of
16the United States, as herein provided for, shall be for the
17sole purpose of securing an expression of the sentiment and
18will of the party voters with respect to candidates for
19nomination for said office, and the vote of the state at large
20shall be taken and considered as advisory to the delegates and
21alternates at large to the national conventions of respective
22political parties; and the vote of the respective congressional
23districts shall be taken and considered as advisory to the
24delegates and alternates of said congressional districts to the
25national conventions of the respective political parties.

1    (10 ILCS 5/7-12)  (from Ch. 46, par. 7-12)
2    Sec. 7-12. All petitions for nomination shall be filed by
3mail or in person as follows:
4        (1) Where the nomination is to be made for a State,
5    congressional, or judicial office, or for any office a
6    nomination for which is made for a territorial division or
7    district which comprises more than one county or is partly
8    in one county and partly in another county or counties,
9    then, except as otherwise provided in this Section, such
10    petition for nomination shall be filed in the principal
11    office of the State Board of Elections not more than 113
12    and not less than 106 days prior to the date of the
13    primary, but, in the case of petitions for nomination to
14    fill a vacancy by special election in the office of
15    representative in Congress from this State, such petition
16    for nomination shall be filed in the principal office of
17    the State Board of Elections not more than 57 days and not
18    less than 50 days prior to the date of the primary.
19        Where a vacancy occurs in the office of Supreme,
20    Appellate or Circuit Court Judge within the 3-week period
21    preceding the 106th day before a general primary election,
22    petitions for nomination for the office in which the
23    vacancy has occurred shall be filed in the principal office
24    of the State Board of Elections not more than 92 nor less
25    than 85 days prior to the date of the general primary

1    election.
2        Where the nomination is to be made for delegates or
3    alternate delegates to a national nominating convention,
4    then such petition for nomination shall be filed in the
5    principal office of the State Board of Elections not more
6    than 113 and not less than 106 days prior to the date of
7    the primary; provided, however, that if the rules or
8    policies of a national political party conflict with such
9    requirements for filing petitions for nomination for
10    delegates or alternate delegates to a national nominating
11    convention, the chairman of the State central committee of
12    such national political party shall notify the Board in
13    writing, citing by reference the rules or policies of the
14    national political party in conflict, and in such case the
15    Board shall direct such petitions to be filed in accordance
16    with the time period set forth in the delegate selection
17    plan for the State central committee that is approved by
18    the national political party not more than 83 and not less
19    than 76 days prior to the date of the primary.
20        (2) Where the nomination is to be made for a county
21    office or trustee of a sanitary district then such petition
22    shall be filed in the office of the county clerk not more
23    than 113 nor less than 106 days prior to the date of the
24    primary.
25        (3) Where the nomination is to be made for a municipal
26    or township office, such petitions for nomination shall be

1    filed in the office of the local election official, not
2    more than 99 nor less than 92 days prior to the date of the
3    primary; provided, where a municipality's or township's
4    boundaries are coextensive with or are entirely within the
5    jurisdiction of a municipal board of election
6    commissioners, the petitions shall be filed in the office
7    of such board; and provided, that petitions for the office
8    of multi-township assessor shall be filed with the election
9    authority.
10        (4) The petitions of candidates for State central
11    committeeman shall be filed in the principal office of the
12    State Board of Elections not more than 113 nor less than
13    106 days prior to the date of the primary.
14        (5) Petitions of candidates for precinct, township or
15    ward committeemen shall be filed in the office of the
16    county clerk not more than 113 nor less than 106 days prior
17    to the date of the primary.
18        (6) The State Board of Elections and the various
19    election authorities and local election officials with
20    whom such petitions for nominations are filed shall specify
21    the place where filings shall be made and upon receipt
22    shall endorse thereon the day and hour on which each
23    petition was filed. All petitions filed by persons waiting
24    in line as of 8:00 a.m. on the first day for filing, or as
25    of the normal opening hour of the office involved on such
26    day, shall be deemed filed as of 8:00 a.m. or the normal

1    opening hour, as the case may be. Petitions filed by mail
2    and received after midnight of the first day for filing and
3    in the first mail delivery or pickup of that day shall be
4    deemed as filed as of 8:00 a.m. of that day or as of the
5    normal opening hour of such day, as the case may be. All
6    petitions received thereafter shall be deemed as filed in
7    the order of actual receipt. Where 2 or more petitions are
8    received simultaneously, the State Board of Elections or
9    the various election authorities or local election
10    officials with whom such petitions are filed shall break
11    ties and determine the order of filing, by means of a
12    lottery or other fair and impartial method of random
13    selection approved by the State Board of Elections. Such
14    lottery shall be conducted within 9 days following the last
15    day for petition filing and shall be open to the public.
16    Seven days written notice of the time and place of
17    conducting such random selection shall be given by the
18    State Board of Elections to the chairman of the State
19    central committee of each established political party, and
20    by each election authority or local election official, to
21    the County Chairman of each established political party,
22    and to each organization of citizens within the election
23    jurisdiction which was entitled, under this Article, at the
24    next preceding election, to have pollwatchers present on
25    the day of election. The State Board of Elections, election
26    authority or local election official shall post in a

1    conspicuous, open and public place, at the entrance of the
2    office, notice of the time and place of such lottery. The
3    State Board of Elections shall adopt rules and regulations
4    governing the procedures for the conduct of such lottery.
5    All candidates shall be certified in the order in which
6    their petitions have been filed. Where candidates have
7    filed simultaneously, they shall be certified in the order
8    determined by lot and prior to candidates who filed for the
9    same office at a later time.
10        (7) The State Board of Elections or the appropriate
11    election authority or local election official with whom
12    such a petition for nomination is filed shall notify the
13    person for whom a petition for nomination has been filed of
14    the obligation to file statements of organization, reports
15    of campaign contributions, and annual reports of campaign
16    contributions and expenditures under Article 9 of this Act.
17    Such notice shall be given in the manner prescribed by
18    paragraph (7) of Section 9-16 of this Code.
19        (8) Nomination papers filed under this Section are not
20    valid if the candidate named therein fails to file a
21    statement of economic interests as required by the Illinois
22    Governmental Ethics Act in relation to his candidacy with
23    the appropriate officer by the end of the period for the
24    filing of nomination papers unless he has filed a statement
25    of economic interests in relation to the same governmental
26    unit with that officer within a year preceding the date on

1    which such nomination papers were filed. If the nomination
2    papers of any candidate and the statement of economic
3    interest of that candidate are not required to be filed
4    with the same officer, the candidate must file with the
5    officer with whom the nomination papers are filed a receipt
6    from the officer with whom the statement of economic
7    interests is filed showing the date on which such statement
8    was filed. Such receipt shall be so filed not later than
9    the last day on which nomination papers may be filed.
10        (9) Any person for whom a petition for nomination, or
11    for committeeman or for delegate or alternate delegate to a
12    national nominating convention has been filed may cause his
13    name to be withdrawn by request in writing, signed by him
14    and duly acknowledged before an officer qualified to take
15    acknowledgments of deeds, and filed in the principal or
16    permanent branch office of the State Board of Elections or
17    with the appropriate election authority or local election
18    official, not later than the date of certification of
19    candidates for the consolidated primary or general primary
20    ballot. No names so withdrawn shall be certified or printed
21    on the primary ballot. If petitions for nomination have
22    been filed for the same person with respect to more than
23    one political party, his name shall not be certified nor
24    printed on the primary ballot of any party. If petitions
25    for nomination have been filed for the same person for 2 or
26    more offices which are incompatible so that the same person

1    could not serve in more than one of such offices if
2    elected, that person must withdraw as a candidate for all
3    but one of such offices within the 5 business days
4    following the last day for petition filing. If he fails to
5    withdraw as a candidate for all but one of such offices
6    within such time his name shall not be certified, nor
7    printed on the primary ballot, for any office. For the
8    purpose of the foregoing provisions, an office in a
9    political party is not incompatible with any other office.
10        (10)(a) Notwithstanding the provisions of any other
11    statute, no primary shall be held for an established
12    political party in any township, municipality, or ward
13    thereof, where the nomination of such party for every
14    office to be voted upon by the electors of such township,
15    municipality, or ward thereof, is uncontested. Whenever a
16    political party's nomination of candidates is uncontested
17    as to one or more, but not all, of the offices to be voted
18    upon by the electors of a township, municipality, or ward
19    thereof, then a primary shall be held for that party in
20    such township, municipality, or ward thereof; provided
21    that the primary ballot shall not include those offices
22    within such township, municipality, or ward thereof, for
23    which the nomination is uncontested. For purposes of this
24    Article, the nomination of an established political party
25    of a candidate for election to an office shall be deemed to
26    be uncontested where not more than the number of persons to

1    be nominated have timely filed valid nomination papers
2    seeking the nomination of such party for election to such
3    office.
4        (b) Notwithstanding the provisions of any other
5    statute, no primary election shall be held for an
6    established political party for any special primary
7    election called for the purpose of filling a vacancy in the
8    office of representative in the United States Congress
9    where the nomination of such political party for said
10    office is uncontested. For the purposes of this Article,
11    the nomination of an established political party of a
12    candidate for election to said office shall be deemed to be
13    uncontested where not more than the number of persons to be
14    nominated have timely filed valid nomination papers
15    seeking the nomination of such established party for
16    election to said office. This subsection (b) shall not
17    apply if such primary election is conducted on a regularly
18    scheduled election day.
19        (c) Notwithstanding the provisions in subparagraph (a)
20    and (b) of this paragraph (10), whenever a person who has
21    not timely filed valid nomination papers and who intends to
22    become a write-in candidate for a political party's
23    nomination for any office for which the nomination is
24    uncontested files a written statement or notice of that
25    intent with the State Board of Elections or the local
26    election official with whom nomination papers for such

1    office are filed, a primary ballot shall be prepared and a
2    primary shall be held for that office. Such statement or
3    notice shall be filed on or before the date established in
4    this Article for certifying candidates for the primary
5    ballot. Such statement or notice shall contain (i) the name
6    and address of the person intending to become a write-in
7    candidate, (ii) a statement that the person is a qualified
8    primary elector of the political party from whom the
9    nomination is sought, (iii) a statement that the person
10    intends to become a write-in candidate for the party's
11    nomination, and (iv) the office the person is seeking as a
12    write-in candidate. An election authority shall have no
13    duty to conduct a primary and prepare a primary ballot for
14    any office for which the nomination is uncontested unless a
15    statement or notice meeting the requirements of this
16    Section is filed in a timely manner.
17        (11) If multiple sets of nomination papers are filed
18    for a candidate to the same office, the State Board of
19    Elections, appropriate election authority or local
20    election official where the petitions are filed shall
21    within 2 business days notify the candidate of his or her
22    multiple petition filings and that the candidate has 3
23    business days after receipt of the notice to notify the
24    State Board of Elections, appropriate election authority
25    or local election official that he or she may cancel prior
26    sets of petitions. If the candidate notifies the State

1    Board of Elections, appropriate election authority or
2    local election official, the last set of petitions filed
3    shall be the only petitions to be considered valid by the
4    State Board of Elections, election authority or local
5    election official. If the candidate fails to notify the
6    State Board of Elections, election authority or local
7    election official then only the first set of petitions
8    filed shall be valid and all subsequent petitions shall be
9    void.
10        (12) All nominating petitions shall be available for
11    public inspection and shall be preserved for a period of
12    not less than 6 months.

15    Sec. 7-59. (a) The person receiving the highest number of
16votes at a primary as a candidate of a party for the nomination
17for an office shall be the candidate of that party for such
18office, and his name as such candidate shall be placed on the
19official ballot at the election then next ensuing; provided,
20that where there are two or more persons to be nominated for
21the same office or board, the requisite number of persons
22receiving the highest number of votes shall be nominated and
23their names shall be placed on the official ballot at the
24following election.
25    Except as otherwise provided by Section 7-8 of this Act,

1the person receiving the highest number of votes of his party
2for State central committeeman of his congressional district
3shall be declared elected State central committeeman from said
4congressional district.
5    Unless a national political party specifies that delegates
6and alternate delegates to a National nominating convention be
7allocated by proportional selection representation according
8to the results of a Presidential preference primary, the
9requisite number of persons receiving the highest number of
10votes of their party for delegates and alternate delegates to
11National nominating conventions from the State at large, and
12the requisite number of persons receiving the highest number of
13votes of their party for delegates and alternate delegates to
14National nominating conventions in their respective
15congressional districts shall be declared elected delegates
16and alternate delegates to the National nominating conventions
17of their party.
18    A political party which elects the members to its State
19Central Committee by Alternative B under paragraph (a) of
20Section 7-8 shall select its congressional district delegates
21and alternate delegates to its national nominating convention
22by proportional selection representation according to the
23results of a Presidential preference primary in each
24congressional district in the manner provided by the rules of
25the national political party and the State Central Committee,
26when the rules and policies of the national political party so

1require.
2    A political party which elects the members to its State
3Central Committee by Alternative B under paragraph (a) of
4Section 7-8 shall select its at large delegates and alternate
5delegates to its national nominating convention by
6proportional selection representation according to the results
7of a Presidential preference primary in the whole State in the
8manner provided by the rules of the national political party
9and the State Central Committee, when the rules and policies of
10the national political party so require.
11    The person receiving the highest number of votes of his
12party for precinct committeeman of his precinct shall be
13declared elected precinct committeeman from said precinct.
14    The person receiving the highest number of votes of his
15party for township committeeman of his township or part of a
16township as the case may be, shall be declared elected township
17committeeman from said township or part of a township as the
18case may be. In cities where ward committeemen are elected, the
19person receiving the highest number of votes of his party for
20ward committeeman of his ward shall be declared elected ward
21committeeman from said ward.
22    When two or more persons receive an equal and the highest
23number of votes for the nomination for the same office or for
24committeeman of the same political party, or where more than
25one person of the same political party is to be nominated as a
26candidate for office or committeeman, if it appears that more

1than the number of persons to be nominated for an office or
2elected committeeman have the highest and an equal number of
3votes for the nomination for the same office or for election as
4committeeman, the election authority by which the returns of
5the primary are canvassed shall decide by lot which of said
6persons shall be nominated or elected, as the case may be. In
7such case the election authority shall issue notice in writing
8to such persons of such tie vote stating therein the place, the
9day (which shall not be more than 5 days thereafter) and the
10hour when such nomination or election shall be so determined.
11    (b) Write-in votes shall be counted only for persons who
12have filed notarized declarations of intent to be write-in
13candidates with the proper election authority or authorities
14not later than 68 61 days prior to the primary. However,
15whenever an objection to a candidate's nominating papers or
16petitions for any office is sustained under Section 10-10 after
17the 68th 61st day before the election, then write-in votes
18shall be counted for that candidate if he or she has filed a
19notarized declaration of intent to be a write-in candidate for
20that office with the proper election authority or authorities
21not later than 7 days prior to the election.
22    Forms for the declaration of intent to be a write-in
23candidate shall be supplied by the election authorities. Such
24declaration shall specify the office for which the person seeks
25nomination or election as a write-in candidate.
26    The election authority or authorities shall deliver a list

1of all persons who have filed such declarations to the election
2judges in the appropriate precincts prior to the primary.
3    (c) (1) Notwithstanding any other provisions of this
4Section, where the number of candidates whose names have been
5printed on a party's ballot for nomination for or election to
6an office at a primary is less than the number of persons the
7party is entitled to nominate for or elect to the office at the
8primary, a person whose name was not printed on the party's
9primary ballot as a candidate for nomination for or election to
10the office, is not nominated for or elected to that office as a
11result of a write-in vote at the primary unless the number of
12votes he received equals or exceeds the number of signatures
13required on a petition for nomination for that office; or
14unless the number of votes he receives exceeds the number of
15votes received by at least one of the candidates whose names
16were printed on the primary ballot for nomination for or
17election to the same office.
18    (2) Paragraph (1) of this subsection does not apply where
19the number of candidates whose names have been printed on the
20party's ballot for nomination for or election to the office at
21the primary equals or exceeds the number of persons the party
22is entitled to nominate for or elect to the office at the
23primary.

1    Sec. 7-60. Not less than 74 days before the date of the
2general election, the State Board of Elections shall certify to
3the county clerks the names of each of the candidates who have
4been nominated as shown by the proclamation of the State Board
5of Elections as a canvassing board or who have been nominated
6to fill a vacancy in nomination and direct the election
7authority to place upon the official ballot for the general
8election the names of such candidates in the same manner and in
9the same order as shown upon the certification, except as
10otherwise provided in this Section.
11    Not less than 68 days before the date of the general
12election, each county clerk shall certify the names of each of
13the candidates for county offices who have been nominated as
14shown by the proclamation of the county election authority or
15who have been nominated to fill a vacancy in nomination and
16declare that the names of such candidates for the respective
17offices shall be placed upon the official ballot for the
18general election in the same manner and in the same order as
19shown upon the certification, except as otherwise provided by
20this Section. Each county clerk shall place a copy of the
21certification on file in his or her office and at the same time
22issue to the State Board of Elections a copy of such
23certification. In addition, each county clerk in whose county
24there is a board of election commissioners shall, not less than
2562 68 days before the date of the general election, issue to
26such board a copy of the certification that has been filed in

1the county clerk's office, together with a copy of the
2certification that has been issued to the clerk by the State
3Board of Elections, with directions to the board of election
4commissioners to place upon the official ballot for the general
5election in that election jurisdiction the names of all
6candidates that are listed on such certifications, in the same
7manner and in the same order as shown upon such certifications,
8except as otherwise provided in this Section.
9    Whenever there are two or more persons nominated by the
10same political party for multiple offices for any board, the
11name of the candidate of such party receiving the highest
12number of votes in the primary election as a candidate for such
13office, as shown by the official election returns of the
14primary, shall be certified first under the name of such
15offices, and the names of the remaining candidates of such
16party for such offices shall follow in the order of the number
17of votes received by them respectively at the primary election
18as shown by the official election results.
19    No person who is shown by the final proclamation to have
20been nominated or elected at the primary as a write-in
21candidate shall have his or her name certified unless such
22person shall have filed with the certifying office or board
23within 10 days after the election authority's proclamation a
24statement of candidacy pursuant to Section 7-10, a statement
25pursuant to Section 7-10.1, and a receipt for the filing of a
26statement of economic interests in relation to the unit of

1government to which he or she has been elected or nominated.
2    Each county clerk and board of election commissioners shall
3determine by a fair and impartial method of random selection
4the order of placement of established political party
5candidates for the general election ballot. Such determination
6shall be made within 30 days following the canvass and
7proclamation of the results of the general primary in the
8office of the county clerk or board of election commissioners
9and shall be open to the public. Seven days written notice of
10the time and place of conducting such random selection shall be
11given, by each such election authority, to the County Chairman
12of each established political party, and to each organization
13of citizens within the election jurisdiction which was
14entitled, under this Article, at the next preceding election,
15to have pollwatchers present on the day of election. Each
16election authority shall post in a conspicuous, open and public
17place, at the entrance of the election authority office, notice
18of the time and place of such lottery. However, a board of
19election commissioners may elect to place established
20political party candidates on the general election ballot in
21the same order determined by the county clerk of the county in
22which the city under the jurisdiction of such board is located.
23    Each certification shall indicate, where applicable, the
24following:
25        (1) The political party affiliation of the candidates
26    for the respective offices;

1        (2) If there is to be more than one candidate elected
2    to an office from the State, political subdivision or
3    district;
4        (3) If the voter has the right to vote for more than
5    one candidate for an office;
6        (4) The term of office, if a vacancy is to be filled
7    for less than a full term or if the offices to be filled in
8    a political subdivision are for different terms.
9    The State Board of Elections or the county clerk, as the
10case may be, shall issue an amended certification whenever it
11is discovered that the original certification is in error.

15the primary, the State Board of Elections shall certify to the
16county clerk for each county, the names of all candidates for

20affiliation of each candidate for nomination, as specified in

10    Sec. 8-17. The death of any candidate prior to, or on, the
11date of the primary shall not affect the canvass of the
12ballots. If the result of such canvass discloses that such

15    In the event that a candidate of a party who has been
16nominated under the provisions of this Article shall die before
17election (whether death occurs prior to, or on, or after, the
18date of the primary) or decline the nomination or should the

1election, unless the legislative or representative committee
2of the party nominates a candidate to fill the vacancy in
3nomination within 75 days after the date of the general primary
4election a vacancy in nomination shall be filled only by a
5person nominated by the legislative or representative
6committee of the political party and only if that nominated
7person filed nominating petitions with the number of signatures
8required for an established party candidate for that office
9within 75 days after the date of the general primary. The
10circulation period for those petitions begins on the day the
11appropriate committee nominates the person. The person shall
12file his or her nominating petitions, statements of candidacy,
13resolution to fill a vacancy in nomination by the appropriate
14committee, and receipt of filing his or her statement of
15economic interests together. These documents shall be filed at
16the same location as provided in Section 7-12. The electoral
17boards having jurisdiction under Section 10-9 to hear and pass
18upon objections to nominating petitions also shall hear and
19pass upon objections to nomination petitions filed by
20candidates under this paragraph. Vacancies in nomination
21occurring under this Article shall be filled by the appropriate
22legislative or representative committee in accordance with the
23provisions of Section 7-61 of this Code. In proceedings to fill
24the vacancy in nomination, the voting strength of the members
25of the legislative or representative committee shall be as
26provided in Section 8-6.

3    Sec. 10-1. Application of Article to minor political
4parties.
5    (a) Political parties as defined in this Article and
6individual voters to the number and in the manner specified in
7this Article may nominate candidates for public offices whose
8names shall be placed on the ballot to be furnished, as
9provided in this Article. No nominations may be made under this
10Article 10, however, by any established political party which,
11at the general election next preceding, polled more than 5% of
12the entire vote cast in the State, district, or unit of local
13government for which the nomination is made. Those nominations
14provided for in Section 45-5 of the Township Code shall be made
15as prescribed in Sections 45-10 through 45-45 of that Code for
16nominations by established political parties, but minor
17political parties and individual voters are governed by this
18Article. Any convention, caucus, or meeting of qualified voters
19of any established political party as defined in this Article
20may, however, make one nomination for each office therein to be
21filled at any election for officers of a municipality with a
22population of less than 5,000 by causing a certificate of
23nomination to be filed with the municipal clerk no earlier than
24113 78 and no later than 106 71 days before the election at
25which the nominated candidates are to be on the ballot. The

1municipal caucuses shall be conducted on the first Monday in
2December of even-numbered years immediately preceding the
3first day for filing caucus certificates of nomination in each
4year in which municipal officers are to be elected, except
5that, when that Monday is a holiday or the eve of a holiday,
6the caucuses shall be held on the next business day following
7the holiday. Every certificate of nomination shall state the
8facts required in Section 10-5 of this Article and shall be
9signed by the presiding officer and by the secretary of the
10convention, caucus, or meeting, who shall add to their
11signatures their places of residence. The certificates shall be
12sworn to by them to be true to the best of their knowledge and
13belief, and a certificate of the oath shall be annexed to the
14certificate of nomination.
15    (b) Publication of the time and place of holding the caucus
16shall be given by the municipal clerk. For municipalities of
17over 500 population, notice of the caucus shall be published in
18a newspaper published in the municipality. If there is no such
19newspaper, then the notice shall be published in a newspaper
20published in the county and having general circulation in the
21municipality. For municipalities of 500 population or less,
22notice of the caucus shall be given by the municipal clerk by
23posting the notice in 3 of the most public places in the
24municipality. The publication or posting shall be given at
25least 10 days before the caucus.
26    (c) As provided in Sections 3.1-25-20 through 3.1-25-60 of

1the Illinois Municipal Code, a village may adopt a system of
2nonpartisan primary and general elections for the election of
3village officers.
4    (d) Any city, village, or incorporated town with a
5population of 5,000 or less may, by ordinance, determine that
6established political parties shall nominate candidates for
7municipal office in the city, village, or incorporated town by
8primary in accordance with Article 7.
9    (e) Only those voters who reside within the territory for
10which the nomination is made shall be permitted to vote or take
11part in the proceedings of any convention, caucus, or meeting
12of individual voters or of any political party held under this
13Section. No voter shall vote or take part in the proceedings of
14more than one convention, caucus, or meeting to make a
15nomination for the same office.

12        (3) (Blank). If a vacancy in office occurs prior to the
13    first day provided in Section 10-6 for filing nomination
14    papers for new political party candidates for the next
15    ensuing general election, new political party candidates
16    for such office shall file their nomination papers during
17    the filing period as set forth in Section 10-6 as otherwise
18    provided in this Article.
19        (4) If the vacancy in office occurs during the time
20    provided in Section 10-6 for filing nomination papers for
21    new political party candidates for the next ensuing general
22    election, the time for independent and new political party
23    candidates to file nomination papers for such office shall
24    be not more than 92 days nor less than 85 days prior to the
25    date of the general election.
26        (5) If the vacancy in office occurs after the last day

1    provided in Section 10-6 for filing nomination papers for
2    new political party candidates, independent and new
3    political party candidates shall be nominated as provided

7judicial review, shall also apply to and govern objections to
8nomination papers filed pursuant to this Section.
9    Unless otherwise specified herein, the nomination and
10election provided for in this Section shall be governed by this
11Code.

6election, each county clerk shall certify the names of each of
7the candidates for county offices whose nomination papers,
8certificates of nomination or resolutions to fill a vacancy in
9nomination have been filed with such clerk and declare that the
10names of such candidates for the respective offices shall be
11placed upon the official ballot for the general election in the
12same manner and in the same order as shown upon the
13certification. Each county clerk shall place a copy of the
14certification on file in his or her office and at the same time
15issue to the State Board of Elections a copy of such
16certification. In addition, each county clerk in whose county
17there is a board of election commissioners shall, not less than
1862 69 days before the election, certify to the board of
19election commissioners the name of the person or persons
20nominated for such office as shown by the certificate of the
21State Board of Elections, together with the names of all other
22candidates as shown by the certification of county officers on
23file in the clerk's office, and in the order so certified. The
24county clerk or board of election commissioners shall print the
25names of the nominees on the ballot for each office in the
26order in which they are certified to or filed with the county

1clerk; provided, that in printing the name of nominees for any
2office, if any of such nominees have also been nominated by one
3or more political parties pursuant to this Act, the location of
4the name of such candidate on the ballot for nominations made
5under this Article shall be precisely in the same order in
6which it appears on the certification of the State Board of
7Elections to the county clerk.
8    For the general election, the candidates of new political
9parties shall be placed on the ballot for said election after
10the established political party candidates and in the order of
11new political party petition filings.
12    Each certification shall indicate, where applicable, the
13following:
14        (1) The political party affiliation if any, of the
15    candidates for the respective offices;
16        (2) If there is to be more than one candidate elected
17    to an office from the State, political subdivision or
18    district;
19        (3) If the voter has the right to vote for more than
20    one candidate for an office;
21        (4) The term of office, if a vacancy is to be filled
22    for less than a full term or if the offices to be filled in
23    a political subdivision are for different terms.
24    The State Board of Elections or the county clerk, as the
25case may be, shall issue an amended certification whenever it
26is discovered that the original certification is in error.

910-10 after the 68th 61st day before the election, then
10write-in votes shall be counted for that candidate if he or she
11has filed a notarized declaration of intent to be a write-in

13authorities not later than 7 days prior to the election.
14    Forms for the declaration of intent to be a write-in
15candidate shall be supplied by the election authorities. Such
16declaration shall specify the office for which the person seeks

18    The election authority or authorities shall deliver a list
19of all persons who have filed such declarations to the election
20judges in the appropriate precincts prior to the election.
21    A candidate for whom a nomination paper has been filed as a
22partisan candidate at a primary election, and who is defeated
23for his or her nomination at the primary election is ineligible
24to file a declaration of intent to be a write-in candidate for
25election in that general or consolidated election.

8candidates are nominated at a primary election on a nonpartisan
9basis and who is defeated for his or her nomination at the
10primary election is ineligible to file a declaration of intent

9scheduled election, each local election official shall certify
10the public questions to be submitted to the voters of or within
11his political subdivision at that election which have been
12initiated by petitions filed in his office or by action of the
13governing board of his political subdivision.
14    Not less than 68 61 days before a regularly scheduled
15election, each circuit court clerk shall certify the public
16questions to be submitted to the voters of a political
17subdivision at that election which have been ordered to be so
18submitted by the circuit court pursuant to law. Not less than
1930 days before the date set by the circuit court for the
20conduct of an emergency referendum pursuant to Section 2A-1.4,
21the circuit court clerk shall certify the public question as

3    Not less than 68 61 days before the next regular election,
4the county clerk shall certify the public questions to be
5submitted to the voters of the entire county at that election,
6which have been initiated by petitions filed in his office or
7by action of the county board, to the board of election
8commissioners, if any, in his county.
9    Not less than 74 67 days before the general election, the
10State Board of Elections shall certify any questions proposing
11an amendment to Article IV of the Constitution pursuant to
12Section 3, Article XIV of the Constitution and any advisory
13public questions to be submitted to the voters of the entire
14State, which have been initiated by petitions received or filed
15at its office, to the respective county clerks. Not less than
1662 61 days before the general election, the county clerk shall
17certify such questions to the board of election commissioners,
18if any, in his county.
19    The certifications shall include the form of the public
20question to be placed on the ballot, the date on which the
21public question was initiated by either the filing of a
22petition or the adoption of a resolution or ordinance by a
23governing body, as the case may be, and a certified copy of any
24court order or political subdivision resolution or ordinance
25requiring the submission of the public question.

1disconnection from, or formation of political subdivisions or
2for other purposes shall include a description of the territory
3in which the proposition is required to be submitted, whenever
4such territory is not coterminous with an existing political
5subdivision.
6    The certification of a public question described in
7subsection (b) of Section 28-6 shall include the precincts
8included in the territory concerning which the public question
9is to be submitted, as well as a common description of such
10territory, in plain and nonlegal language, and specify the
11election at which the question is to be submitted. The
12description of the territory shall be prepared by the local
13election official as set forth in the resolution or ordinance
14initiating the public question.
15    Whenever a local election official, an election authority,
16or the State Board of Elections is in receipt of an initiating
17petition, or a certification for the submission of a public
18question at an election at which the public question may not be
19placed on the ballot or submitted because of the limitations of
20Section 28-1, such officer or board shall give notice of such
21prohibition, by registered mail, as follows:
22        (a) in the case of a petition, to any person designated
23    on a certificate attached thereto as the proponent or as
24    the proponents' attorney for purposes of notice of
25    objections;
26        (b) in the case of a certificate from a local election

1    authority, to such local election authority, who shall
2    thereupon give notice as provided in subparagraph (a), or
3    notify the governing board which adopted the initiating
4    resolution or ordinance;
5        (c) in the case of a certification from a circuit court
6    clerk of a court order, to such court, which shall
7    thereupon give notice as provided in subparagraph (a) and
8    shall modify its order in accordance with the provisions of
9    this Act.
10    If the petition, resolution or ordinance initiating such
11prohibited public question did not specify a particular
12election for its submission, the officer or board responsible
13for certifying the question to the election authorities shall
14certify or recertify the question, in the manner required
15herein, for submission on the ballot at the next regular
16election no more than one year, or 15 months in the case of a
17back door referendum as defined in subsection (f) of Section
1828-2, subsequent to the filing of the initiating petition or
19the adoption of the initiating resolution or ordinance and at
20which the public question may be submitted, and the appropriate
21election authorities shall submit the question at such
22election, unless the public question is ordered submitted as an
23emergency referendum pursuant to Section 2A-1.4 or is withdrawn
24as may be provided by law.

1    Section 15. The Counties Code is amended by changing
2Section 2-5013 as follows:

4    Sec. 2-5013. Discontinuance of county executive form of
5government. Any county which has adopted the county executive
6form of government may discontinue that form of government only
7as provided in this Section. The board upon receipt of a
8petition, not less than 92 78 days before a general election,
9calling for discontinuance of the county executive form of
10government and signed by a number of registered voters of the
11county equal to or greater than 5% of the number who voted in
12the last regular election held in the county at which county
13officers were elected shall provide by resolution for
14submission of the proposition for discontinuance to the
15electors of the county at the next general election. The board
16shall certify the resolution and the proposition to the proper
17election officials who shall submit the proposition at the next
18general election in accordance with the general election law.

2    If a majority of the voters voting on the proposition vote
3in favor of discontinuance of the county executive form of
4government, the office of county executive shall be abolished
5as of the first Monday in December following the holding of the
6election and the board elected in the county shall meet,
7organize and resume the conduct of the affairs of the county
8wholly as the county board. A referendum under this Section may
9be held in any county only once within any 47-month period.

15    (a) On the first second Tuesday in December January
16preceding the date of the regular township election, a caucus
17shall be held by the voters of each established political party
18in a township to nominate its candidates for the various
19offices to be filled at the election. Notice of the caucus
20shall be given at least 10 days before it is held by
21publication in some newspaper having a general circulation in
22the township. Not less than 30 days before the caucus, the
23township clerk shall notify the chairman or membership of each
24township central committee by first-class mail of the

1chairman's or membership's obligation to report the time and
2location of the political party's caucus. Not less than 20 days
3before the caucus, each chairman of the township central

7conflict, the township clerk shall establish, by a fair and
8impartial public lottery, the time and location for each
9caucus.
10    (b) Except as provided in this Section, the township board
11shall cause notices of the caucuses to be published. The notice
12shall state the time and place where the caucus for each
13political party will be held. The board shall fix a place
14within the township for holding the caucus for each established
15political party. When a new township has been established under
16Section 10-25, the county board shall cause notice of the
17caucuses to be published as required by this Section and shall
18fix the place within the new township for holding the caucuses.

7in the general election law. The nomination papers shall be
8filed in the office of the township clerk, except that if the
9township is entirely within the corporate limits of a city,
10village, or incorporated town under the jurisdiction of a board
11of election commissioners, the nomination papers shall be filed
12in the office of the board of election commissioners instead of
13the township clerk.
14    (c) The township clerk shall certify the candidates so
15nominated to the proper election authorities not less than 61
16days before the township election. The election shall be
17conducted in accordance with the general election law.

1    (b) For purposes of this Code, the multi-township central
2committee of each established political party shall consist of
3the elected or appointed precinct committeemen of each
4established political party within the multi-township district
5and shall promulgate rules of procedure under Section 45-50.
6    (c) The multi-township central committee of each
7established political party shall cause notices of the caucuses
8to be published. The notices shall state the time and place
9where the caucus for each established political party will be
10held within the multi-township district and shall be published
11in a newspaper of general circulation in the district 10 days
12before the caucuses are held. Not less than 30 days before the
13caucus, the multi-township clerk shall notify the chairman or
14membership of each multi-township central committee by
15first-class mail of the chairman's or membership's obligation
16to report the time and location of the political party's
17caucus. Not less than 20 days before the caucus, each chairman
18of the multi-township central committee shall notify the
19multi-township clerk by first-class mail of the time and
20location of the political party's caucus. If the time and
21location of 2 or more political party caucuses conflict, the
22multi-township clerk shall establish, by a fair and impartial
23public lottery, the time and location for each caucus.
24    (d) The result of the election shall be canvassed in the
25manner provided by the general election law.
26    (e) The chairman of the multi-township central committee

1shall, not more than 113 78 nor less than 106 71 days before
2the multi-township election, file nomination papers as
3provided in this Section. The nomination papers shall consist
4of (i) a certification by the chairman of the names of all
5candidates for office in the township nominated at the caucus
6and (ii) a statement of candidacy by each candidate in the form
7prescribed in the general election law. The nomination papers
8shall be filed in the office of the election authority. The
9election shall be conducted in accordance with the general
10election law.

8The votes shall be recorded as "Yes" or "No".
9    (c) If a majority of the voters voting on the proposition
10vote in favor of it, there shall be elected in each township in
11the county at the next regular election for township offices
12one township collector. The collector shall hold office until
13the date of the expiration of the term of office of township
14collectors in Cook County as provided in Section 50-10, and
15until a successor is elected and qualified. Successors shall
16hold office for a term of 4 years and until their successors
17are elected and qualified.

21vote in favor of the discontinuance of the office of township
22collector, no township collectors shall thereafter be elected
23in the county unless there has again been submitted to the
24voters of the county and approved by them a proposition to
25establish the office of township collector.

1    Section 25. The Illinois Municipal Code is amended by
2changing Sections 3.1-10-50, 3.1-20-45, 3.1-25-20, 3.1-25-60,
37-2-7, and 8-3-7a as follows:
 
4    (65 ILCS 5/3.1-10-50)
5    Sec. 3.1-10-50. Events upon which an elective office
6becomes vacant in municipality with population under 500,000.
7    (a) Vacancy by resignation. A resignation is not effective
8unless it is in writing, signed by the person holding the
9elective office, and notarized.
10        (1) Unconditional resignation. An unconditional
11    resignation by a person holding the elective office may
12    specify a future date, not later than 60 days after the
13    date the resignation is received by the officer authorized
14    to fill the vacancy, at which time it becomes operative,
15    but the resignation may not be withdrawn after it is
16    received by the officer authorized to fill the vacancy. The
17    effective date of a resignation that does not specify a
18    future date at which it becomes operative is the date the
19    resignation is received by the officer authorized to fill
20    the vacancy. The effective date of a resignation that has a
21    specified future effective date is that specified future
22    date or the date the resignation is received by the officer
23    authorized to fill the vacancy, whichever date occurs
24    later.

1        (2) Conditional resignation. A resignation that does
2    not become effective unless a specified event occurs can be
3    withdrawn at any time prior to the occurrence of the
4    specified event, but if not withdrawn, the effective date
5    of the resignation is the date of the occurrence of the
6    specified event or the date the resignation is received by
7    the officer authorized to fill the vacancy, whichever date
8    occurs later.
9        (3) Vacancy upon the effective date. For the purpose of
10    determining the time period that would require an election
11    to fill the vacancy by resignation or the commencement of
12    the 60-day time period referred to in subsection (e), the
13    resignation of an elected officer is deemed to have created
14    a vacancy as of the effective date of the resignation.
15        (4) Duty of the clerk. If a resignation is delivered to
16    the clerk of the municipality, the clerk shall forward a
17    certified copy of the written resignation to the official
18    who is authorized to fill the vacancy within 7 business
19    days after receipt of the resignation.
20    (b) Vacancy by death or disability. A vacancy occurs in an
21office by reason of the death of the incumbent. The date of the
22death may be established by the date shown on the death
23certificate. A vacancy occurs in an office by permanent
24physical or mental disability rendering the person incapable of
25performing the duties of the office. The corporate authorities
26have the authority to make the determination whether an officer

1is incapable of performing the duties of the office because of
2a permanent physical or mental disability. A finding of mental
3disability shall not be made prior to the appointment by a
4court of a guardian ad litem for the officer or until a duly
5licensed doctor certifies, in writing, that the officer is
6mentally impaired to the extent that the officer is unable to
7effectively perform the duties of the office. If the corporate
8authorities find that an officer is incapable of performing the
9duties of the office due to permanent physical or mental
10disability, that person is removed from the office and the
11vacancy of the office occurs on the date of the determination.
12    (c) Vacancy by other causes.
13        (1) Abandonment and other causes. A vacancy occurs in
14    an office by reason of abandonment of office; removal from
15    office; or failure to qualify; or more than temporary
16    removal of residence from the municipality; or in the case
17    of an alderman of a ward or councilman or trustee of a
18    district, more than temporary removal of residence from the
19    ward or district, as the case may be. The corporate
20    authorities have the authority to determine whether a
21    vacancy under this subsection has occurred. If the
22    corporate authorities determine that a vacancy exists, the
23    office is deemed vacant as of the date of that
24    determination for all purposes including the calculation
25    under subsections (e), (f), and (g).
26        (2) Guilty of a criminal offense. An admission of guilt

1    of a criminal offense that upon conviction would disqualify
2    the municipal officer from holding the office, in the form
3    of a written agreement with State or federal prosecutors to
4    plead guilty to a felony, bribery, perjury, or other
5    infamous crime under State or federal law, constitutes a
6    resignation from that office, effective on the date the
7    plea agreement is made. For purposes of this Section, a
8    conviction for an offense that disqualifies a municipal
9    officer from holding that office occurs on the date of the
10    return of a guilty verdict or, in the case of a trial by
11    the court, on the entry of a finding of guilt.
12        (3) Election declared void. A vacancy occurs on the
13    date of the decision of a competent tribunal declaring the
14    election of the officer void.
15    (d) Election of an acting mayor or acting president. The
16election of an acting mayor or acting president pursuant to
17subsection (f) or (g) does not create a vacancy in the original
18office of the person on the city council or as a trustee, as
19the case may be, unless the person resigns from the original
20office following election as acting mayor or acting president.
21If the person resigns from the original office following
22election as acting mayor or acting president, then the original
23office must be filled pursuant to the terms of this Section and
24the acting mayor or acting president shall exercise the powers
25of the mayor or president and shall vote and have veto power in
26the manner provided by law for a mayor or president. If the

1person does not resign from the original office following
2election as acting mayor or acting president, then the acting
3mayor or acting president shall exercise the powers of the
4mayor or president but shall be entitled to vote only in the
5manner provided for as the holder of the original office and
6shall not have the power to veto. If the person does not resign
7from the original office following election as acting mayor or
8acting president, and if that person's original term of office
9has not expired when a mayor or president is elected and has
10qualified for office, the acting mayor or acting-president
11shall return to the original office for the remainder of the
12term thereof.
13    (e) Appointment to fill alderman or trustee vacancy. An
14appointment by the mayor or president or acting mayor or acting
15president, as the case may be, of a qualified person as
16described in Section 3.1-10-5 of this Code to fill a vacancy in
17the office of alderman or trustee must be made within 60 days
18after the vacancy occurs. Once the appointment of the qualified
19person has been forwarded to the corporate authorities, the
20corporate authorities shall act upon the appointment within 30
21days. If the appointment fails to receive the advice and
22consent of the corporate authorities within 30 days, the mayor
23or president or acting mayor or acting president shall appoint
24and forward to the corporate authorities a second qualified
25person as described in Section 3.1-10-5. Once the appointment
26of the second qualified person has been forwarded to the

1corporate authorities, the corporate authorities shall act
2upon the appointment within 30 days. If the appointment of the
3second qualified person also fails to receive the advice and
4consent of the corporate authorities, then the mayor or
5president or acting mayor or acting president, without the
6advice and consent of the corporate authorities, may make a
7temporary appointment from those persons who were appointed but
8whose appointments failed to receive the advice and consent of
9the corporate authorities. The person receiving the temporary
10appointment shall serve until an appointment has received the
11advice and consent and the appointee has qualified or until a
12person has been elected and has qualified, whichever first
13occurs.
14    (f) Election to fill vacancies in municipal offices with
154-year terms. If a vacancy occurs in an elective municipal
16office with a 4-year term and there remains an unexpired
17portion of the term of at least 28 months, and the vacancy
18occurs at least 130 days before the general municipal election
19next scheduled under the general election law, then the vacancy
20shall be filled for the remainder of the term at that general
21municipal election. Whenever an election is held for this
22purpose, the municipal clerk shall certify the office to be
23filled and the candidates for the office to the proper election
24authorities as provided in the general election law. If a
25vacancy occurs with less than 28 months remaining in the
26unexpired portion of the term or less than 130 days before the

1general municipal election, then:
2        (1) Mayor or president. If the vacancy is in the office
3    of mayor or president, the vacancy must be filled by the
4    corporate authorities electing one of their members as
5    acting mayor or acting president. Except as set forth in
6    subsection (d), the acting mayor or acting president shall
7    perform the duties and possess all the rights and powers of
8    the mayor or president until a mayor or president is
9    elected at the next general municipal election and has
10    qualified. However, in villages with a population of less
11    than 5,000, if each of the trustees either declines the
12    election as acting president or is not elected by a
13    majority vote of the trustees presently holding office,
14    then the trustees may elect, as acting president, any other
15    village resident who is qualified to hold municipal office,
16    and the acting president shall exercise the powers of the
17    president and shall vote and have veto power in the manner
18    provided by law for a president.
19        (2) Alderman or trustee. If the vacancy is in the
20    office of alderman or trustee, the vacancy must be filled
21    by the mayor or president or acting mayor or acting
22    president, as the case may be, in accordance with
23    subsection (e).
24        (3) Other elective office. If the vacancy is in any
25    elective municipal office other than mayor or president or
26    alderman or trustee, the mayor or president or acting mayor

1    or acting president, as the case may be, must appoint a
2    qualified person to hold the office until the office is
3    filled by election, subject to the advice and consent of
4    the city council or the board of trustees, as the case may
5    be.
6    (g) Vacancies in municipal offices with 2-year terms. In
7the case of an elective municipal office with a 2-year term, if
8the vacancy occurs at least 165 130 days before the general
9municipal election next scheduled under the general election
10law, the vacancy shall be filled for the remainder of the term
11at that general municipal election. If the vacancy occurs less
12than 165 130 days before the general municipal election, then:
13        (1) Mayor or president. If the vacancy is in the office
14    of mayor or president, the vacancy must be filled by the
15    corporate authorities electing one of their members as
16    acting mayor or acting president. Except as set forth in
17    subsection (d), the acting mayor or acting president shall
18    perform the duties and possess all the rights and powers of
19    the mayor or president until a mayor or president is
20    elected at the next general municipal election and has
21    qualified. However, in villages with a population of less

11    alderman or trustee, the mayor or president or acting mayor
12    or acting president, as the case may be, must appoint a
13    qualified person to hold the office until the office is
14    filled by election, subject to the advice and consent of

17    (h) In cases of vacancies arising by reason of an election
18being declared void pursuant to paragraph (3) of subsection
19(c), persons holding elective office prior thereto shall hold
20office until their successors are elected and qualified or
21appointed and confirmed by advice and consent, as the case may
22be.
23    (i) This Section applies only to municipalities with
24populations under 500,000.

1    (65 ILCS 5/3.1-20-45)
2    Sec. 3.1-20-45. Nonpartisan primary elections; uncontested
3office. A city incorporated under this Code that elects
4municipal officers at nonpartisan primary and general
5elections shall conduct the elections as provided in the
6Election Code, except that no office for which nomination is
7uncontested shall be included on the primary ballot and no
8primary shall be held for that office. For the purposes of this
9Section, an office is uncontested when not more than 4 persons
10to be nominated for each office have timely filed valid
11nominating papers seeking nomination for the election to that
12office.
13    Notwithstanding the preceding paragraph, when a person (i)
14who has not timely filed valid nomination papers and (ii) who
15intends to become a write-in candidate for nomination for any
16office for which nomination is uncontested files a written
17statement or notice of that intent with the proper election
18official with whom the nomination papers for that office are
19filed, if the write-in candidate becomes the fifth candidate
20filed, a primary ballot must be prepared and a primary must be
21held for the office. The statement or notice must be filed on
22or before the certification date provided in the Election Code
2361st day before the consolidated primary election. The
24statement must contain (i) the name and address of the person
25intending to become a write-in candidate, (ii) a statement that
26the person intends to become a write-in candidate, and (iii)

7    Sec. 3.1-25-20. Primary election. A village incorporated
8under this Code shall nominate and elect candidates for
9president and trustees in nonpartisan primary and general
10elections as provided in Sections 3.1-25-20 through 3.1-25-55
11until the electors of the village vote to require the partisan
12election of the president and trustees at a referendum in the
13manner provided in Section 3.1-25-65 after January 1, 1992. The
14provisions of Sections 3.1-25-20 through 3.1-25-55 shall apply
15to all villages incorporated under this Code that have operated
16under those Sections without the adoption of those provisions
17by the referendum provided in Section 3.1-25-60 as well as
18those villages that have adopted those provisions by the
19referendum provided in Section 3.1-25-60 until the electors of
20those villages vote to require the partisan election of the
21president and trustees in the manner provided in Section
223.1-25-65. Villages that have nominated and elected candidates
23for president and trustees in partisan elections prior to
24January 1, 1992, may continue to hold partisan elections
25without conducting a referendum in the manner provided in

1Section 3.1-25-65. All candidates for nomination to be voted
2for at all general municipal elections at which a president or
3trustees, or both, are to be elected under this Article shall
4be nominated from the village at large by a primary election.
5    Notwithstanding any other provision of law, no primary
6shall be held in any village when the nomination for every
7office to be voted upon by the electors of the village is
8uncontested. If the nomination of candidates is uncontested as
9to one or more, but not all, of the offices to be voted upon by
10the electors of the village, then a primary must be held in the
11village, provided that the primary ballot shall not include
12those offices in the village for which the nomination is
13uncontested. For the purposes of this Section, an office is
14uncontested when not more than the number of persons to be
15nominated to the office have timely filed valid nominating
16papers seeking nomination for election to that office.
17    Notwithstanding the preceding paragraph, when a person (i)
18who has not timely filed valid nomination papers and (ii) who
19intends to become a write-in candidate for nomination for any
20office for which nomination is uncontested files a written
21statement or notice of that intent with the proper election
22official with whom the nomination papers for that office are
23filed, a primary ballot must be prepared and a primary must be
24held for the office. The statement or notice must be filed on
25or before the certification date provided in the Election Code

6clerk and signed by electors of the village equal in number to
7at least 10% of the number of votes cast for the candidates for
8president at the last preceding general municipal election. The
9proposition shall be in substantially the following form:
10        Shall candidates for president and trustees of (name of
11    village) be elected in nonpartisan primary and general
12    elections?
13    If a majority of the electors in the village voting on the
14question vote in the affirmative, candidates for president and
15trustees of the village shall be elected as provided in
16Sections 3.1-25-20 through 3.1-25-55.
17    No referendum held (i) before any primary election to be
18held within the municipality affected thereby and after the
19first day for circulation of petitions for candidates for
20nomination to any office to be chosen at the primary election
21or (ii) within 60 days before any general election to be held
22within the municipality shall be effective until the day after
23the date of the primary or general election, as the case may
24be.

3    (b) Municipalities under this Section may contract with any
4not-for-profit corporation, subject to the General Not for
5Profit Corporation Act and incorporated primarily for the
6purpose of providing transportation to elderly and handicapped
7persons, for such corporation to provide
8transportation-related services for the purposes of this
9Section. Municipalities should utilize where possible existing
10facilities and systems already operating for the purposes
11outlined in this Section.
12    (c) Taxes authorized under this Section may be used only
13for the purpose of financing a transportation system for
14elderly and handicapped persons as authorized in this Section.
15    (d) For purposes of this Section, "handicapped person"
16means any individual who, by reason of illness, injury, age,
17congenital malfunction, or other permanent or temporary
18disability, is unable without special public transportation
19facilities or special planning or design to utilize ordinary
20public transportation facilities and services as effectively
21as persons who are not so affected.
22"Public transportation for elderly and handicapped" means a
23transportation system for persons who have mental or physical
24difficulty in accessing or using the conventional public mass
25transportation system, or for any other reason.

1    Section 30. The Park District Code is amended by changing
2Section 2-25 as follows:
 
3    (70 ILCS 1205/2-25)  (from Ch. 105, par. 2-25)
4    Sec. 2-25. Whenever any member of the governing board of
5any park district (i) dies, (ii) resigns, (iii) becomes under
6legal disability, (iv) ceases to be a legal voter in the
7district, (v) is convicted of any infamous crime, (vi) refuses
8or neglects to take his or her oath of office, (vii) neglects
9to perform the duties of his or her office or attend meetings
10of the board for the length of time as the board fixes by
11ordinance, or (viii) for any other reason specified by law,
12that office may be declared vacant. Vacancies shall be filled
13by appointment by a majority of the remaining members of the
14board. Any person so appointed shall hold his or her office
15until the next regular election for this office, at which a
16member shall be elected to fill the vacancy for the unexpired
17term, subject to the following conditions:
18        (1) If the vacancy occurs with less than 28 months
19    remaining in the term, the person appointed to fill the
20    vacancy shall hold his or her office until the expiration
21    of the term for which he or she has been appointed, and no
22    election to fill the vacancy shall be held.
23        (2) If the vacancy occurs with more than 28 months left

7    Section 35. The Public Library District Act of 1991 is
8amended by changing Section 30-25 as follows:
 
9    (75 ILCS 16/30-25)
10    Sec. 30-25. Vacancies.
11    (a) Vacancies shall be declared in the office of trustee by
12the board when an elected or appointed trustee (i) declines,
13fails, or is unable to serve, (ii) becomes a nonresident of the
14district, (iii) is convicted of a misdemeanor by failing,
15neglecting, or refusing to discharge any duty imposed upon him
16or her by this Act, or (iv) has failed to pay the library taxes
17levied by the district. Absence without cause from all regular
18board meetings for a period of one year shall be a basis for
19declaring a vacancy.
20    (b) All vacancies shall be filled by appointment by the
21remaining trustees until the next regular library election, at
22which time a trustee shall be elected for the remainder of the
23unexpired term. If, however, the vacancy occurs with less than
2428 months remaining in the term, and if the vacancy occurs less

1than 123 88 days before the next regular scheduled election for
2this office, then the person so appointed shall serve the

9    Section 40. The School Code is amended by changing Section
1010-10 as follows:
 
11    (105 ILCS 5/10-10)  (from Ch. 122, par. 10-10)
12    Sec. 10-10. Board of education; Term; Vacancy. All school
13districts having a population of not fewer than 1,000 and not
14more than 500,000 inhabitants, as ascertained by any special or
15general census, and not governed by special Acts, shall be
16governed by a board of education consisting of 7 members,
17serving without compensation except as herein provided. Each
18member shall be elected for a term of 4 years for the initial
19members of the board of education of a combined school district
20to which that subsection applies. If 5 members are elected in
211983 pursuant to the extension of terms provided by law for
22transition to the consolidated election schedule under the
23general election law, 2 of those members shall be elected to
24serve terms of 2 years and 3 shall be elected to serve terms of

14 years; their successors shall serve for a 4 year term. When
2the voters of a district have voted to elect members of the
3board of education for 6 year terms, as provided in Section
49-5, the terms of office of members of the board of education

6not later than 7 days after such election. If at the regular
7school election held in the first odd-numbered year after the
8determination to elect members for 6 year terms 2 members are
9elected, they shall serve for a 6 year term; and of the members
10elected at the next regular school election 3 shall serve for a
11term of 6 years and 2 shall serve a term of 2 years. Thereafter
12members elected in such districts shall be elected to a 6 year
13term. If at the regular school election held in the first
14odd-numbered year after the determination to elect members for
156 year terms 3 members are elected, they shall serve for a 6
16year term; and of the members elected at the next regular
17school election 2 shall serve for a term of 2 years and 2 shall
18serve for a term of 6 years. Thereafter members elected in such
19districts shall be elected to a 6 year term. If at the regular
20school election held in the first odd-numbered year after the
21determination to elect members for 6 year terms 4 members are
22elected, 3 shall serve for a term of 6 years and one shall
23serve for a term of 2 years; and of the members elected at the
24next regular school election 2 shall serve for terms of 6 years
25and 2 shall serve for terms of 2 years. Thereafter members
26elected in such districts shall be elected to a 6 year term. If

1at the regular school election held in the first odd-numbered
2year after the determination to elect members for a 6 year term
35 members are elected, 3 shall serve for a term of 6 years and 2

66 years and 2 shall serve for terms of 2 years. Thereafter
7members elected in such districts shall be elected to a 6 year
8term. An election for board members shall not be held in school
9districts which by consolidation, annexation or otherwise
10shall cease to exist as a school district within 6 months after
11the election date, and the term of all board members which
12would otherwise terminate shall be continued until such
13district shall cease to exist. Each member, on the date of his
14or her election, shall be a citizen of the United States of the
15age of 18 years or over, shall be a resident of the State and
16the territory of the district for at least one year immediately
17preceding his or her election, shall be a registered voter as
18provided in the general election law, shall not be a school
19trustee, and shall not be a child sex offender as defined in
20Section 11-9.3 of the Criminal Code of 1961. When the board of
21education is the successor of the school directors, all rights
22of property, and all rights regarding causes of action existing
23or vested in such directors, shall vest in it as fully as they
24were vested in the school directors. Terms of members are
25subject to Section 2A-54 of the Election Code.
26    Nomination papers filed under this Section are not valid

1unless the candidate named therein files with the secretary of
2the board of education or with a person designated by the board
3to receive nominating petitions a receipt from the county clerk
4showing that the candidate has filed a statement of economic
5interests as required by the Illinois Governmental Ethics Act.
6Such receipt shall be so filed either previously during the
7calendar year in which his nomination papers were filed or
8within the period for the filing of nomination papers in
9accordance with the general election law.
10    Whenever a vacancy occurs, the remaining members shall
11notify the regional superintendent of that vacancy within 5
12days after its occurrence and shall proceed to fill the vacancy
13until the next regular school election, at which election a
14successor shall be elected to serve the remainder of the
15unexpired term. However, if the vacancy occurs with less than
16868 days remaining in the term, or if the vacancy occurs less
17than 123 88 days before the next regularly scheduled election
18for this office then the person so appointed shall serve the
19remainder of the unexpired term, and no election to fill the
20vacancy shall be held. Should they fail so to act, within 45
21days after the vacancy occurs, the regional superintendent of
22schools under whose supervision and control the district is
23operating, as defined in Section 3-14.2 of this Act, shall
24within 30 days after the remaining members have failed to fill
25the vacancy, fill the vacancy as provided for herein. Upon the
26regional superintendent's failure to fill the vacancy, the

1vacancy shall be filled at the next regularly scheduled
2election. Whether elected or appointed by the remaining members
3or regional superintendent, the successor shall be an
4inhabitant of the particular area from which his or her

6contained in Section 10-10.5 or 12-2 of this Code apply.
7    A board of education may appoint a student to the board to
8serve in an advisory capacity. The student member shall serve
9for a term as determined by the board. The board may not grant
10the student member any voting privileges, but shall consider
11the student member as an advisor. The student member may not
12participate in or attend any executive session of the board.

14    Section 45. The Public Community College Act is amended by
15changing Section 3-7 as follows:
 
16    (110 ILCS 805/3-7)  (from Ch. 122, par. 103-7)
17    Sec. 3-7. (a) The election of the members of the board of
18trustees shall be nonpartisan and shall be held at the time and
19in the manner provided in the general election law.
20    (b) Unless otherwise provided in this Act, members shall be
21elected to serve 6 year terms. The term of members elected in
221985 and thereafter shall be from the date the member is
23officially determined to be elected to the board by a canvass
24conducted pursuant to the Election Code, to the date that the

1winner of the seat is officially determined by the canvass
2conducted pursuant to the Election Code the next time the seat
3on the board is to be filled by election.
4    (c) A board of trustees of a community college district
5which is contiguous or has been contiguous to an experimental
6community college district as authorized and defined by Article
7IV of this Act may, on its own motion, or shall, upon the
8petition of the lesser of 1/10 or 2,000 of the voters
9registered in the district, order submitted to the voters of
10the district at the next general election the proposition for
11the election of board members by trustee district rather than
12at large, and such proposition shall thereupon be certified by
13the secretary of the board to the proper election authority in
14accordance with the general election law for submission.
15    If the proposition is approved by a majority of those
16voting on the proposition, the State Board of Elections, in
171991, shall reapportion the trustee districts to reflect the
18results of the last decennial census, and shall divide the
19community college district into 7 trustee districts, each of
20which shall be compact, contiguous and substantially equal in
21population to each other district. In 2001, and in the year
22following each decennial census thereafter, the board of
23trustees of community college District #522 shall reapportion
24the trustee districts to reflect the results of the census, and
25shall divide the community college district into 7 trustee
26districts, each of which shall be compact, contiguous, and

1substantially equal in population to each other district. The
2division of the community college district into trustee
3districts shall be completed and formally approved by a
4majority of the members of the board of trustees of community
5college District #522 in 2001 and in the year following each
6decennial census. At the same meeting of the board of trustees,
7the board shall, publicly by lot, divide the trustee districts
8as equally as possible into 2 groups. Beginning in 2003 and
9every 10 years thereafter, trustees or their successors from
10one group shall be elected for successive terms of 4 years and
116 years; and members or their successors from the second group
12shall be elected for successive terms of 6 years and 4 years.
13One member shall be elected from each such trustee district.
14Each member elected in 2001 shall be elected at the 2001
15consolidated election from the trustee districts established
16in 1991. The term of each member elected in 2001 shall end on
17the date that the trustees elected in 2003 are officially
18determined by a canvass conducted pursuant to the Election
19Code.
20    (d) In Community College District No. 526, the election of
21board members shall be by trustee district rather than at large
22beginning with the consolidated election in 2005.
23    For the 2005, 2007, and 2009 consolidated elections, the
24community college district is divided into 7 trustee districts

10All counties, townships, census tracts, block groups, blocks,
11annexations, and natural boundaries are those that appear on
12maps published by the United States Bureau of the Census for
13the 2000 census and maps produced by the Department of Revenue.
14The term "tract" means census tract. Trustee districts created
15by this subsection (d) for the purpose of electing board
16members shall not be altered by operation of any other statute,
17ordinance, or resolution. Any part of the community college
18district that has not been described as included in one of the
19trustee districts described in this subsection (d) is included
20within the trustee district that (i) is contiguous to the part
21and (ii) contains the least population of all trustee districts
22contiguous to the part according to the 2000 decennial census
23of Illinois. If any part of the community college district is
24described in this subsection (d) as being in more than one
25trustee district, the part is included within the trustee

1district that (i) is one of the trustee districts in which that
2part is listed in this subsection (d), (ii) is contiguous to
3that part, and (iii) contains the least population according to
4the 2000 decennial census of Illinois. If any part of the
5community college district (i) is described in this subsection
6(d) as being in one trustee district and (ii) is entirely
7surrounded by another trustee district, then the part shall be
8incorporated into the trustee district that surrounds the part.
9If any part of the community college district (i) is described
10in this subsection (d) as being in one trustee district and
11(ii) is not contiguous to another part of that trustee
12district, then the part is included within the contiguous
13trustee district that contains the least population according
14to the 2000 decennial census of Illinois. The Speaker of the
15House, the Minority Leader of the House, the President of the
16Senate, and the Minority Leader of the Senate shall by joint
17letter of transmittal present to the Secretary of State for
18deposit into the State Archives an official set of United
19States Bureau of the Census maps and descriptions used for
20conducting the 2000 census, and those maps shall serve as the
21official record of all counties, townships, census tracts,
22block groups, and blocks referred to in this subsection (d).
23The State Board of Elections shall prepare and make available
24to the public a metes and bounds description of the trustee
25districts created under this subsection (d). The State Board of
26Elections shall adjust census tract boundaries, municipal and

1township annexations, and natural boundaries to make compact
2and contiguous districts.
3    For each at-large seat on the board that is to be filled by
4election in 2005 or 2007, the seat shall be filled by a trustee
5elected from a trustee district. The State Board shall
6determine which trustee district seat is to replace which
7at-large seat by lot. The term of each trustee elected at the
82005 or 2007 consolidated election shall end on the date that
9the trustees elected in 2009 are officially determined by a
10canvass conducted pursuant to the Election Code. For the 2009
11consolidated election, one trustee shall be elected from each
12trustee district to serve a 4-year term.
13    At least one year prior to the 2013 consolidated election,
14the board shall meet to, publicly by lot, divide the trustee
15districts as equally as possible into 3 groups. Beginning with
16the 2013 consolidated election and the consolidated election
17every 10 years thereafter, trustees or their successors from
18the first group shall be elected for successive terms of 2
19years, 4 years, and 4 years; trustees or their successors from
20the second group shall be elected for successive terms of 4
21years, 2 years, and 4 years; and trustees or their successors
22from the third group shall be elected for successive terms of 4
23years, 4 years, and 2 years.
24    (e) Each member must on the date of his election be a
25citizen of the United States, of the age of 18 years or over,
26and a resident of the State and the territory which on the date

1of the election is included in the community college district
2for at least one year immediately preceding his election. In
3Community College District No. 526, each member elected at the
4consolidated election in 2005 or thereafter must also be a
5resident of the trustee district he or she represents for at
6least one year immediately preceding his or her election,
7except that in the first consolidated election for each trustee
8district following reapportionment by the General Assembly, a
9candidate for the board may be elected from any trustee
10district that contains a part of the trustee district in which
11he or she resided at the time of the reapportionment and may be
12reelected if a resident of the new trustee district he or she
13represents for one year prior to reelection. In the event a
14person who is a member of a common school board is elected or
15appointed to a board of trustees of a community college
16district, that person shall be permitted to serve the remainder
17of his or her term of office as a member of the common school
18board. Upon the expiration of the common school board term,
19that person shall not be eligible for election or appointment
20to a common school board during the term of office with the
21community college district board of trustees.
22    (f) Whenever a vacancy occurs, the remaining members shall
23fill the vacancy, and the person so appointed shall serve until
24a successor is elected at the next regular election for board
25members and is certified in accordance with Sections 22-17 and
2622-18 of the Election Code. If the remaining members fail so to

1act within 60 days after the vacancy occurs, the chairman of
2the State Board shall fill that vacancy, and the person so
3appointed shall serve until a successor is elected at the next
4regular election for board members and is certified in
5accordance with Sections 22-17 and 22-18 of the Election Code.
6The person appointed to fill the vacancy shall have the same
7residential qualifications as his predecessor in office was
8required to have. In either instance, if the vacancy occurs
9with less than 5 4 months remaining before the next scheduled
10consolidated election, and the term of office of the board
11member vacating the position is not scheduled to expire at that
12election, then the term of the person so appointed shall extend
13through that election and until the succeeding consolidated
14election. If the term of office of the board member vacating
15the position is scheduled to expire at the upcoming
16consolidated election, the appointed member shall serve only
17until a successor is elected and qualified at that election.
18    (g) Members of the board shall serve without compensation
19but shall be reimbursed for their reasonable expenses incurred
20in connection with their service as members. Compensation, for
21purposes of this Section, means any salary or other benefits
22not expressly authorized by this Act to be provided or paid to,
23for or on behalf of members of the board. The board of each
24community college district may adopt a policy providing for the
25issuance of bank credit cards, for use by any board member who
26requests the same in writing and agrees to use the card only

1for the reasonable expenses which he or she incurs in
2connection with his or her service as a board member. Expenses
3charged to such credit cards shall be accounted for separately
4and shall be submitted to the chief financial officer of the
5district for review prior to being reported to the board at its
6next regular meeting.
7    (h) Except in an election of the initial board for a new
8community college district created pursuant to Section 6-6.1,
9the ballot for the election of members of the board for a
10community college district shall indicate the length of term
11for each office to be filled. In the election of a board for
12any community college district, the ballot shall not contain
13any political party designation.

15    Section 50. The Liquor Control Act of 1934 is amended by
16changing Sections 9-2 and 9-10 as follows:

18    Sec. 9-2. When any legal voters of a precinct in any city,
19village or incorporated town of more than 200,000 inhabitants,
20as determined by the last preceding Federal census, desire to
21pass upon the question of whether the sale at retail of
22alcoholic liquor shall be prohibited in the precinct or at a
23particular street address within the precinct, they shall, at
24least 104 days before an election, file in the office of the

1clerk of such city, village or incorporated town, a petition
2directed to the clerk, containing the signatures of not less
3than 25% of the legal voters registered with the board of
4election commissioners or county clerk, as the case may be,
5from the precinct. Provided, however, that when the petition
6seeks to prohibit the sale at retail of alcoholic liquor at a
7particular street address of a licensed establishment within
8the precinct the petition shall contain the signatures of not
9less than 40% of the legal voters requested from that precinct.
10The petition shall request that the proposition "Shall the sale
11at retail of alcoholic liquor be prohibited in (or at) ....?"
12be submitted to the voters of the precinct at the next ensuing
13election at which such proposition may be voted upon. The
14submission of the question to the voters of such precinct at
15such election shall be mandatory when the petition has been
16filed in proper form with the clerk. If more than one set of
17petitions are presented to the clerk for submission at the same
18election, the petition presented first shall be given
19preference; however, the clerk shall provisionally accept any
20other set of petitions setting forth the same (or substantially
21the same) proposition. If the first set of petitions for a
22proposition is found to be in proper form and is not found to
23be invalid, it shall be accepted by the clerk and all
24provisionally accepted sets of petitions setting forth the same
25(or substantially the same) proposition shall be rejected by
26the clerk. If the first set of petitions for a proposition is

1found not to be in proper form or is found to be invalid, the
2clerk shall (i) reject the first set of petitions, (ii) accept
3the first provisionally accepted set of petitions that is in
4proper form and is not found to be invalid, and (iii) reject
5all other provisionally accepted sets of petitions setting
6forth the same (or substantially the same) proposition. Notice
7of the filing of the petition and the result of the election
8shall be given to the Secretary of State at his offices in
9both, Chicago and Springfield, Illinois. A return of the result
10of the election shall be made to the clerk of the city, village
11or incorporated town in which the precinct is located. If a
12majority of the voters voting upon such proposition vote "YES",
13the sale at retail of alcoholic liquor shall be prohibited in
14the precinct or at the street address. If the sale at retail of
15alcoholic liquor at a particular street address is prohibited
16pursuant to this Section, the license for any establishment at
17that street address shall be void, and no person may apply for
18a license for the sale at retail of alcoholic liquor at an
19establishment at that street address unless such prohibition is
20discontinued pursuant to Section 9-10.
21    In cities, villages and incorporated towns of 200,000 or
22less population, as determined by the last preceding Federal
23census, the vote upon the question of prohibiting the sale at
24retail of alcoholic liquor, or alcoholic liquor other than beer
25containing not more than 4% of alcohol by volume, or alcoholic
26liquor containing more than 4% of alcohol by weight in the

1original package and not for consumption on the premises, shall
2be by the voters of the political subdivision as a unit. When
3any legal voters of such a city, village or incorporated town
4desire to pass upon the question of whether the sale at retail
5of alcoholic liquor shall be prohibited in the municipality,
6they shall, at least 104 days before an election, file in the
7office of the clerk of the municipality, a petition directed to
8the clerk, containing the signatures of not less than 25% of
9the legal voters registered with the board of election
10commissioners or county clerk, as the case may be, from the
11municipality. The petition shall request that the proposition,
12"Shall the sale at retail of alcoholic liquor be prohibited
13in....?" be submitted to the voters of the municipality at the
14next ensuing election at which the proposition may be voted
15upon. The submission of the question to the voters of the
16municipality at such election shall be mandatory when the
17petition has been filed in proper form with the clerk. If more
18than one set of petitions are presented to the clerk for
19submission at the same election, setting forth the same or
20different propositions, the petition presented first shall be
21given preference and the clerk shall refuse to accept any other
22set of petitions. Notice of the filing of the petition and the
23result of the election shall be given to the Secretary of State
24at his offices in both Chicago and Springfield, Illinois. A
25return of the result of the election shall be made to the clerk
26of the city, village or incorporated town. If a majority of the

1voters voting upon the proposition vote "Yes", the sale at
2retail of alcoholic liquor shall be prohibited in the
3municipality.
4    In the event a municipality does not vote to prohibit the
5sale at retail of alcoholic liquor, the council or governing
6body shall ascertain and determine what portions of the
7municipality are predominantly residence districts. No license
8permitting the sale of alcoholic liquors shall be issued by the
9local liquor commissioner or licensing officer permitting the
10sale of alcoholic liquors at any place within the residence
11district so determined, unless the owner or owners of at least
12two-thirds of the frontage, 200 feet in each direction along
13the street and streets adjacent to the place of business for
14which a license is sought, file with the local liquor
15commissioner or licensing officer, his or their written consent
16to the use of such place for the sale of alcoholic liquors.
17    In each township or road district lying outside the
18corporate limits of a city, village or incorporated town, or in
19a part of a township or road district lying partly within and
20partly outside a city, village or incorporated town, the vote
21of such township, road district or part thereof, shall be as a
22unit. When any legal voters of any such township, or part
23thereof, in counties under township organization, or any legal
24voters of such road district or part thereof, in counties not
25under township organization, desire to vote upon the
26proposition as to whether the sale at retail of alcoholic

1liquor shall be prohibited in such township or road district or
2part thereof, they shall, at least 104 90 days before an
3election, file in the office of the township or road district
4clerk, of the township or road district within which the
5election is to be held, a petition directed to the clerk and
6containing the signatures of not less than 25% of the legal
7voters registered with the county clerk from such township or
8road district or part thereof. The submission of the question
9to the voters of the township, road district or part thereof,
10at the next ensuing election shall be mandatory when the
11petition has been filed in proper form with the clerk. If more
12than one set of petitions are presented to the clerk for
13submission at the same election, setting forth the same or
14different propositions, the petition presented first shall be
15given preference and the clerk shall refuse to accept any other
16set of petitions. A return of the result of such election shall
17be made to the clerk of the township or road district in which
18the territory is situated, and shall also be made to the
19Secretary of State at his offices in both Chicago and
20Springfield, Illinois.

6alcoholic liquor containing more than 4% of alcohol by weight
7except in the original package and not for consumption on the
8premises, or a petition directed to such clerk containing the
9signatures of not less than 25% of the legal voters of a
10municipality within which such territory is located, to submit
11to the voters thereof the proposition to continue such
12prohibition, the clerk shall certify such proposition to the
13proper election officials, who shall submit the proposition at
14such election to the voters of such political subdivision or
15precinct. Where such proposition is submitted pursuant to a
16petition signed by not less than 25% of the legal voters of a
17municipality within which such territory is located, the legal
18voters of the entire municipality may vote on the proposition.
19For the purposes of this Section, the number of legal voters
20shall be computed upon the same basis as is provided in Section
219-2 for the filing of a petition for referendum on the question
22of whether the sale at retail of alcoholic liquor shall be
23prohibited. So far as applicable, the provisions of Sections
249-1, 9-4, 9-5, 9-6 and 9-7 shall apply. The proposition shall
25be in the following form:

12In a precinct referendum, the referendum ballot shall also
13contain a common description of the precinct in plain and
14nonlegal language, which may be prepared by the election
15official or adopted from the description on the petition,
16unless the election official responsible for conducting the
17election determines that a description cannot be included
18within the space limitations on the ballots to be used in the
19election. If the description is not to be included on the
20ballot, the clerk shall prepare large printed copies of the
21description of the precinct together with a notice of the
22proposition which shall be prominently displayed in the
23precinct polling place at the election. If a majority of the
24voters voting upon such last mentioned proposition in any such
25political subdivision or precinct vote "NO", such prohibition
26shall cease in such political subdivision or precinct or at the

1applicable licensed establishment; and where such political
2subdivision or precinct is a city, village or incorporated town
3situated wholly or partly within the boundaries of a township
4or road district having a similar prohibition, a majority vote
5of the voters voting "NO" upon such proposition as above
6described will result in the prohibition ceasing in that part
7of the township or road district situated within such city,
8village or incorporated town. In the event the boundaries of
9such political subdivision or precinct have been altered or the
10numbers of any precincts have been changed subsequent to the
11original election making the territory prohibited territory
12and prior to the filing of such petition for resubmission of
13the question, only those voters actually residing in the
14prohibited territory shall be eligible as signers of such
15resubmission petition, except that this limitation shall not
16apply in the case of a resubmission petition signed by at least
1725% of the legal voters of a municipality in which the
18prohibited territory is located. The petition mentioned in this
19Section shall be a public document and shall be subject to
20inspection by the public.
