SYNOPSIS AS INTRODUCED:

    Amends the Election Code. Makes changes concerning petitions for nomination, write-in votes, special elections, certification of candidates by the county clerk, vacancy in nomination, meetings of various electoral boards, and various other provisions. Makes changes concerning various time limits. Amends the Counties Code. Provides that a petition for discontinuance of the county executive form of government must be submitted to the Board not less than 92 days before the general election. Amends the Township Code. Makes changes concerning the time period for filing nomination papers and caucuses. Amends the Park District Code, the Public Library District Act, and the School Code. Makes changes concerning vacancies in office. Makes numerous other changes. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Constitutional Amendment Act is
5amended by changing Sections 6 and 7 as follows:
 
6    (5 ILCS 20/6)  (from Ch. 1, par. 108)
7    Sec. 6. The county canvassing boards of the counties
8respectively shall at the time it opens the returns and makes
9abstracts of the votes cast at such elections for officers,
10also make abstracts in duplicate of the votes cast for and
11against such proposed amendment or amendments to the
12constitution. And immediately after the completion of the
13abstracts the county canvassing boards shall inclose one of the
14same in a sealed envelope, and indorse thereon the words
15"Abstract of votes for and against amendment of the
16constitution," and address and mail the same to the State Board
17of Elections secretary of state, and shall file the other of
18the abstracts in the county clerk's office.

21    Sec. 7. The State Board of Elections created by The
22Election Code shall proceed, within 31 20 days after the

1election and sooner if all the returns are received, to canvass
2the votes given for and against said amendment or amendments,
3as shown by said abstracts, and if it appears that a majority
4of the electors voting in the election or 3/5 of the electors
5voting on any such proposed amendment have voted for the
6proposed amendment or amendments, the same shall by said board
7be declared adopted, and become a part of the constitution of
8this state, and the governor shall cause proclamation to be
9made of the result of the vote, and that said amendment has
10become a part of the constitution, by publication in at least 2
11newspapers published at the seat of government.

13    Section 10. The Election Code is amended by changing
14Sections 7-11, 7-12, 7-59, 7-60, 7-61, 8-10, 8-17, 10-1, 10-10,
1510-11.1, 10-14, 17-16.1, 18-9.1, and 28-5 as follows:

17    Sec. 7-11. Any candidate for President of the United States
18may have his name printed upon the primary ballot of his
19political party by filing in the office of the State Board of
20Elections not more than 113 and not less than 106 days prior to
21the date of the general primary, in any year in which a
22Presidential election is to be held, a petition signed by not
23less than 3000 or more than 5000 primary electors, members of
24and affiliated with the party of which he is a candidate, and

1no candidate for President of the United States, who fails to
2comply with the provisions of this Article shall have his name
3printed upon any primary ballot: Provided, however, that if the
4rules or policies of a national political party conflict with
5such requirements for filing petitions for President of the
6United States in a presidential preference primary, the
7Chairman of the State central committee of such national
8political party shall notify the State Board of Elections in
9writing, citing by reference the rules or policies of the
10national political party in conflict, and in such case the
11Board shall direct such petitions to be filed not more than 78
1269 and not less than 71 62 days prior to the date of the general
13primary, in any year in which a Presidential election is to be
14held. Provided, further, unless rules or policies of a national
15political party otherwise provide, the vote for President of
16the United States, as herein provided for, shall be for the
17sole purpose of securing an expression of the sentiment and
18will of the party voters with respect to candidates for
19nomination for said office, and the vote of the state at large
20shall be taken and considered as advisory to the delegates and
21alternates at large to the national conventions of respective
22political parties; and the vote of the respective congressional
23districts shall be taken and considered as advisory to the
24delegates and alternates of said congressional districts to the
25national conventions of the respective political parties.

1    (10 ILCS 5/7-12)  (from Ch. 46, par. 7-12)
2    Sec. 7-12. All petitions for nomination shall be filed by
3mail or in person as follows:
4        (1) Where the nomination is to be made for a State,
5    congressional, or judicial office, or for any office a
6    nomination for which is made for a territorial division or
7    district which comprises more than one county or is partly
8    in one county and partly in another county or counties,
9    then, except as otherwise provided in this Section, such
10    petition for nomination shall be filed in the principal
11    office of the State Board of Elections not more than 113
12    and not less than 106 days prior to the date of the
13    primary, but, in the case of petitions for nomination to
14    fill a vacancy by special election in the office of
15    representative in Congress from this State, such petition
16    for nomination shall be filed in the principal office of
17    the State Board of Elections not more than 57 days and not
18    less than 50 days prior to the date of the primary.
19        Where a vacancy occurs in the office of Supreme,
20    Appellate or Circuit Court Judge within the 3-week period
21    preceding the 106th day before a general primary election,
22    petitions for nomination for the office in which the
23    vacancy has occurred shall be filed in the principal office
24    of the State Board of Elections not more than 92 nor less
25    than 85 days prior to the date of the general primary

1    election.
2        Where the nomination is to be made for delegates or
3    alternate delegates to a national nominating convention,
4    then such petition for nomination shall be filed in the
5    principal office of the State Board of Elections not more
6    than 113 and not less than 106 days prior to the date of
7    the primary; provided, however, that if the rules or
8    policies of a national political party conflict with such
9    requirements for filing petitions for nomination for
10    delegates or alternate delegates to a national nominating
11    convention, the chairman of the State central committee of
12    such national political party shall notify the Board in
13    writing, citing by reference the rules or policies of the
14    national political party in conflict, and in such case the
15    Board shall direct such petitions to be filed not more than
16    78 83 and not less than 71 76 days prior to the date of the
17    primary.
18        (2) Where the nomination is to be made for a county
19    office or trustee of a sanitary district then such petition
20    shall be filed in the office of the county clerk not more
21    than 113 nor less than 106 days prior to the date of the
22    primary.
23        (3) Where the nomination is to be made for a municipal
24    or township office, such petitions for nomination shall be
25    filed in the office of the local election official, not
26    more than 99 nor less than 92 days prior to the date of the

1    primary; provided, where a municipality's or township's
2    boundaries are coextensive with or are entirely within the
3    jurisdiction of a municipal board of election
4    commissioners, the petitions shall be filed in the office
5    of such board; and provided, that petitions for the office
6    of multi-township assessor shall be filed with the election
7    authority.
8        (4) The petitions of candidates for State central
9    committeeman shall be filed in the principal office of the
10    State Board of Elections not more than 113 nor less than
11    106 days prior to the date of the primary.
12        (5) Petitions of candidates for precinct, township or
13    ward committeemen shall be filed in the office of the
14    county clerk not more than 113 nor less than 106 days prior
15    to the date of the primary.
16        (6) The State Board of Elections and the various
17    election authorities and local election officials with
18    whom such petitions for nominations are filed shall specify
19    the place where filings shall be made and upon receipt
20    shall endorse thereon the day and hour on which each
21    petition was filed. All petitions filed by persons waiting
22    in line as of 8:00 a.m. on the first day for filing, or as
23    of the normal opening hour of the office involved on such
24    day, shall be deemed filed as of 8:00 a.m. or the normal
25    opening hour, as the case may be. Petitions filed by mail
26    and received after midnight of the first day for filing and

1    in the first mail delivery or pickup of that day shall be
2    deemed as filed as of 8:00 a.m. of that day or as of the
3    normal opening hour of such day, as the case may be. All
4    petitions received thereafter shall be deemed as filed in
5    the order of actual receipt. Where 2 or more petitions are
6    received simultaneously, the State Board of Elections or
7    the various election authorities or local election
8    officials with whom such petitions are filed shall break
9    ties and determine the order of filing, by means of a
10    lottery or other fair and impartial method of random
11    selection approved by the State Board of Elections. Such
12    lottery shall be conducted within 9 days following the last
13    day for petition filing and shall be open to the public.
14    Seven days written notice of the time and place of
15    conducting such random selection shall be given by the
16    State Board of Elections to the chairman of the State
17    central committee of each established political party, and
18    by each election authority or local election official, to
19    the County Chairman of each established political party,
20    and to each organization of citizens within the election
21    jurisdiction which was entitled, under this Article, at the
22    next preceding election, to have pollwatchers present on
23    the day of election. The State Board of Elections, election
24    authority or local election official shall post in a
25    conspicuous, open and public place, at the entrance of the
26    office, notice of the time and place of such lottery. The

1    State Board of Elections shall adopt rules and regulations
2    governing the procedures for the conduct of such lottery.
3    All candidates shall be certified in the order in which
4    their petitions have been filed. Where candidates have
5    filed simultaneously, they shall be certified in the order
6    determined by lot and prior to candidates who filed for the
7    same office at a later time.
8        (7) The State Board of Elections or the appropriate
9    election authority or local election official with whom
10    such a petition for nomination is filed shall notify the
11    person for whom a petition for nomination has been filed of
12    the obligation to file statements of organization, reports
13    of campaign contributions, and annual reports of campaign
14    contributions and expenditures under Article 9 of this Act.
15    Such notice shall be given in the manner prescribed by
16    paragraph (7) of Section 9-16 of this Code.
17        (8) Nomination papers filed under this Section are not
18    valid if the candidate named therein fails to file a
19    statement of economic interests as required by the Illinois
20    Governmental Ethics Act in relation to his candidacy with
21    the appropriate officer by the end of the period for the
22    filing of nomination papers unless he has filed a statement
23    of economic interests in relation to the same governmental
24    unit with that officer within a year preceding the date on
25    which such nomination papers were filed. If the nomination
26    papers of any candidate and the statement of economic

1    interest of that candidate are not required to be filed
2    with the same officer, the candidate must file with the
3    officer with whom the nomination papers are filed a receipt
4    from the officer with whom the statement of economic
5    interests is filed showing the date on which such statement
6    was filed. Such receipt shall be so filed not later than
7    the last day on which nomination papers may be filed.
8        (9) Any person for whom a petition for nomination, or
9    for committeeman or for delegate or alternate delegate to a
10    national nominating convention has been filed may cause his
11    name to be withdrawn by request in writing, signed by him
12    and duly acknowledged before an officer qualified to take
13    acknowledgments of deeds, and filed in the principal or
14    permanent branch office of the State Board of Elections or
15    with the appropriate election authority or local election
16    official, not later than the date of certification of
17    candidates for the consolidated primary or general primary
18    ballot. No names so withdrawn shall be certified or printed
19    on the primary ballot. If petitions for nomination have
20    been filed for the same person with respect to more than
21    one political party, his name shall not be certified nor
22    printed on the primary ballot of any party. If petitions
23    for nomination have been filed for the same person for 2 or
24    more offices which are incompatible so that the same person
25    could not serve in more than one of such offices if
26    elected, that person must withdraw as a candidate for all

1    but one of such offices within the 5 business days
2    following the last day for petition filing. If he fails to
3    withdraw as a candidate for all but one of such offices
4    within such time his name shall not be certified, nor
5    printed on the primary ballot, for any office. For the
6    purpose of the foregoing provisions, an office in a
7    political party is not incompatible with any other office.
8        (10)(a) Notwithstanding the provisions of any other
9    statute, no primary shall be held for an established
10    political party in any township, municipality, or ward
11    thereof, where the nomination of such party for every
12    office to be voted upon by the electors of such township,
13    municipality, or ward thereof, is uncontested. Whenever a
14    political party's nomination of candidates is uncontested
15    as to one or more, but not all, of the offices to be voted
16    upon by the electors of a township, municipality, or ward
17    thereof, then a primary shall be held for that party in
18    such township, municipality, or ward thereof; provided
19    that the primary ballot shall not include those offices
20    within such township, municipality, or ward thereof, for
21    which the nomination is uncontested. For purposes of this
22    Article, the nomination of an established political party
23    of a candidate for election to an office shall be deemed to
24    be uncontested where not more than the number of persons to
25    be nominated have timely filed valid nomination papers
26    seeking the nomination of such party for election to such

1    office.
2        (b) Notwithstanding the provisions of any other
3    statute, no primary election shall be held for an
4    established political party for any special primary
5    election called for the purpose of filling a vacancy in the
6    office of representative in the United States Congress
7    where the nomination of such political party for said
8    office is uncontested. For the purposes of this Article,
9    the nomination of an established political party of a
10    candidate for election to said office shall be deemed to be
11    uncontested where not more than the number of persons to be
12    nominated have timely filed valid nomination papers
13    seeking the nomination of such established party for
14    election to said office. This subsection (b) shall not
15    apply if such primary election is conducted on a regularly
16    scheduled election day.
17        (c) Notwithstanding the provisions in subparagraph (a)
18    and (b) of this paragraph (10), whenever a person who has
19    not timely filed valid nomination papers and who intends to
20    become a write-in candidate for a political party's
21    nomination for any office for which the nomination is
22    uncontested files a written statement or notice of that
23    intent with the State Board of Elections or the local
24    election official with whom nomination papers for such
25    office are filed, a primary ballot shall be prepared and a
26    primary shall be held for that office. Such statement or

1    notice shall be filed on or before the date established in
2    this Article for certifying candidates for the primary
3    ballot. Such statement or notice shall contain (i) the name
4    and address of the person intending to become a write-in
5    candidate, (ii) a statement that the person is a qualified
6    primary elector of the political party from whom the
7    nomination is sought, (iii) a statement that the person
8    intends to become a write-in candidate for the party's
9    nomination, and (iv) the office the person is seeking as a
10    write-in candidate. An election authority shall have no
11    duty to conduct a primary and prepare a primary ballot for
12    any office for which the nomination is uncontested unless a
13    statement or notice meeting the requirements of this
14    Section is filed in a timely manner.
15        (11) If multiple sets of nomination papers are filed
16    for a candidate to the same office, the State Board of
17    Elections, appropriate election authority or local
18    election official where the petitions are filed shall
19    within 2 business days notify the candidate of his or her
20    multiple petition filings and that the candidate has 3
21    business days after receipt of the notice to notify the
22    State Board of Elections, appropriate election authority
23    or local election official that he or she may cancel prior
24    sets of petitions. If the candidate notifies the State
25    Board of Elections, appropriate election authority or
26    local election official, the last set of petitions filed

1    shall be the only petitions to be considered valid by the
2    State Board of Elections, election authority or local
3    election official. If the candidate fails to notify the
4    State Board of Elections, election authority or local
5    election official then only the first set of petitions
6    filed shall be valid and all subsequent petitions shall be
7    void.
8        (12) All nominating petitions shall be available for
9    public inspection and shall be preserved for a period of
10    not less than 6 months.

13    Sec. 7-59. (a) The person receiving the highest number of
14votes at a primary as a candidate of a party for the nomination
15for an office shall be the candidate of that party for such
16office, and his name as such candidate shall be placed on the
17official ballot at the election then next ensuing; provided,
18that where there are two or more persons to be nominated for
19the same office or board, the requisite number of persons
20receiving the highest number of votes shall be nominated and
21their names shall be placed on the official ballot at the
22following election.
23    Except as otherwise provided by Section 7-8 of this Act,
24the person receiving the highest number of votes of his party
25for State central committeeman of his congressional district

1shall be declared elected State central committeeman from said
2congressional district.
3    Unless a national political party specifies that delegates
4and alternate delegates to a National nominating convention be
5allocated by proportional selection representation according
6to the results of a Presidential preference primary, the
7requisite number of persons receiving the highest number of
8votes of their party for delegates and alternate delegates to
9National nominating conventions from the State at large, and
10the requisite number of persons receiving the highest number of
11votes of their party for delegates and alternate delegates to
12National nominating conventions in their respective
13congressional districts shall be declared elected delegates
14and alternate delegates to the National nominating conventions
15of their party.
16    A political party which elects the members to its State
17Central Committee by Alternative B under paragraph (a) of
18Section 7-8 shall select its congressional district delegates
19and alternate delegates to its national nominating convention
20by proportional selection representation according to the
21results of a Presidential preference primary in each
22congressional district in the manner provided by the rules of
23the national political party and the State Central Committee,
24when the rules and policies of the national political party so
25require.
26    A political party which elects the members to its State

1Central Committee by Alternative B under paragraph (a) of
2Section 7-8 shall select its at large delegates and alternate
3delegates to its national nominating convention by
4proportional selection representation according to the results
5of a Presidential preference primary in the whole State in the
6manner provided by the rules of the national political party
7and the State Central Committee, when the rules and policies of
8the national political party so require.
9    The person receiving the highest number of votes of his
10party for precinct committeeman of his precinct shall be
11declared elected precinct committeeman from said precinct.
12    The person receiving the highest number of votes of his
13party for township committeeman of his township or part of a
14township as the case may be, shall be declared elected township
15committeeman from said township or part of a township as the
16case may be. In cities where ward committeemen are elected, the
17person receiving the highest number of votes of his party for
18ward committeeman of his ward shall be declared elected ward
19committeeman from said ward.
20    When two or more persons receive an equal and the highest
21number of votes for the nomination for the same office or for
22committeeman of the same political party, or where more than
23one person of the same political party is to be nominated as a
24candidate for office or committeeman, if it appears that more
25than the number of persons to be nominated for an office or
26elected committeeman have the highest and an equal number of

1votes for the nomination for the same office or for election as
2committeeman, the election authority by which the returns of
3the primary are canvassed shall decide by lot which of said
4persons shall be nominated or elected, as the case may be. In
5such case the election authority shall issue notice in writing
6to such persons of such tie vote stating therein the place, the
7day (which shall not be more than 5 days thereafter) and the
8hour when such nomination or election shall be so determined.
9    (b) Write-in votes shall be counted only for persons who
10have filed notarized declarations of intent to be write-in
11candidates with the proper election authority or authorities
12not later than 68 61 days prior to the primary. However,
13whenever an objection to a candidate's nominating papers or
14petitions for any office is sustained under Section 10-10 after
15the 68th 61st day before the election, then write-in votes
16shall be counted for that candidate if he or she has filed a
17notarized declaration of intent to be a write-in candidate for
18that office with the proper election authority or authorities
19not later than 7 days prior to the election.
20    Forms for the declaration of intent to be a write-in
21candidate shall be supplied by the election authorities. Such
22declaration shall specify the office for which the person seeks
23nomination or election as a write-in candidate.
24    The election authority or authorities shall deliver a list
25of all persons who have filed such declarations to the election
26judges in the appropriate precincts prior to the primary.

1    (c) (1) Notwithstanding any other provisions of this
2Section, where the number of candidates whose names have been
3printed on a party's ballot for nomination for or election to
4an office at a primary is less than the number of persons the
5party is entitled to nominate for or elect to the office at the
6primary, a person whose name was not printed on the party's
7primary ballot as a candidate for nomination for or election to
8the office, is not nominated for or elected to that office as a
9result of a write-in vote at the primary unless the number of
10votes he received equals or exceeds the number of signatures
11required on a petition for nomination for that office; or
12unless the number of votes he receives exceeds the number of
13votes received by at least one of the candidates whose names
14were printed on the primary ballot for nomination for or
15election to the same office.
16    (2) Paragraph (1) of this subsection does not apply where
17the number of candidates whose names have been printed on the
18party's ballot for nomination for or election to the office at
19the primary equals or exceeds the number of persons the party
20is entitled to nominate for or elect to the office at the
21primary.

24    Sec. 7-60. Not less than 74 days before the date of the
25general election, the State Board of Elections shall certify to

1the county clerks the names of each of the candidates who have
2been nominated as shown by the proclamation of the State Board
3of Elections as a canvassing board or who have been nominated
4to fill a vacancy in nomination and direct the election
5authority to place upon the official ballot for the general
6election the names of such candidates in the same manner and in
7the same order as shown upon the certification, except as
8otherwise provided in this Section.
9    Not less than 68 days before the date of the general
10election, each county clerk shall certify the names of each of
11the candidates for county offices who have been nominated as
12shown by the proclamation of the county election authority or
13who have been nominated to fill a vacancy in nomination and
14declare that the names of such candidates for the respective
15offices shall be placed upon the official ballot for the
16general election in the same manner and in the same order as
17shown upon the certification, except as otherwise provided by
18this Section. Each county clerk shall place a copy of the
19certification on file in his or her office and at the same time
20issue to the State Board of Elections a copy of such
21certification. In addition, each county clerk in whose county
22there is a board of election commissioners shall, not less than
2362 68 days before the date of the general election, issue to
24such board a copy of the certification that has been filed in
25the county clerk's office, together with a copy of the
26certification that has been issued to the clerk by the State

1Board of Elections, with directions to the board of election
2commissioners to place upon the official ballot for the general
3election in that election jurisdiction the names of all
4candidates that are listed on such certifications, in the same
5manner and in the same order as shown upon such certifications,
6except as otherwise provided in this Section.
7    Whenever there are two or more persons nominated by the
8same political party for multiple offices for any board, the
9name of the candidate of such party receiving the highest
10number of votes in the primary election as a candidate for such
11office, as shown by the official election returns of the
12primary, shall be certified first under the name of such
13offices, and the names of the remaining candidates of such
14party for such offices shall follow in the order of the number
15of votes received by them respectively at the primary election
16as shown by the official election results.
17    No person who is shown by the final proclamation to have
18been nominated or elected at the primary as a write-in
19candidate shall have his or her name certified unless such
20person shall have filed with the certifying office or board
21within 10 days after the election authority's proclamation a
22statement of candidacy pursuant to Section 7-10, a statement
23pursuant to Section 7-10.1, and a receipt for the filing of a
24statement of economic interests in relation to the unit of
25government to which he or she has been elected or nominated.
26    Each county clerk and board of election commissioners shall

1determine by a fair and impartial method of random selection
2the order of placement of established political party
3candidates for the general election ballot. Such determination
4shall be made within 30 days following the canvass and
5proclamation of the results of the general primary in the
6office of the county clerk or board of election commissioners
7and shall be open to the public. Seven days written notice of
8the time and place of conducting such random selection shall be
9given, by each such election authority, to the County Chairman
10of each established political party, and to each organization
11of citizens within the election jurisdiction which was
12entitled, under this Article, at the next preceding election,
13to have pollwatchers present on the day of election. Each
14election authority shall post in a conspicuous, open and public
15place, at the entrance of the election authority office, notice
16of the time and place of such lottery. However, a board of
17election commissioners may elect to place established
18political party candidates on the general election ballot in
19the same order determined by the county clerk of the county in
20which the city under the jurisdiction of such board is located.
21    Each certification shall indicate, where applicable, the
22following:
23        (1) The political party affiliation of the candidates
24    for the respective offices;
25        (2) If there is to be more than one candidate elected

2        (3) If the voter has the right to vote for more than

4        (4) The term of office, if a vacancy is to be filled

7    The State Board of Elections or the county clerk, as the
8case may be, shall issue an amended certification whenever it
9is discovered that the original certification is in error.

12    Sec. 7-61. Whenever a special election is necessary the
13provisions of this Article are applicable to the nomination of
14candidates to be voted for at such special election.
15    In cases where a primary election is required the officer
16or board or commission whose duty it is under the provisions of
17this Act relating to general elections to call an election,
18shall fix a date for the primary for the nomination of
19candidates to be voted for at such special election. Notice of
20such primary shall be given at least 15 days prior to the
21maximum time provided for the filing of petitions for such a
22primary as provided in Section 7-12.
23    Except in the case of a vacancy in nomination occurring as
24a result of a failure to nominate a candidate at the general

2and prior to certification of candidates by the certifying
3board or officer, must be filled prior to the date of

6shall be filled within 8 days after the event creating the
7vacancy. The resolution filling the vacancy shall be sent by U.
8S. mail or personal delivery to the certifying officer or board
9within 3 days of the action by which the vacancy was filled;
10provided, if such resolution is sent by mail and the U. S.
11postmark on the envelope containing such resolution is dated
12prior to the expiration of such 3 day limit, the resolution
13shall be deemed filed within such 3 day limit. Failure to so
14transmit the resolution within the time specified in this
15Section shall authorize the certifying officer or board to
16certify the original candidate. Vacancies shall be filled by
17the officers of a local municipal or township political party
18as specified in subsection (h) of Section 7-8, other than a
19statewide political party, that is established only within a
20municipality or township and the managing committee (or
21legislative committee in case of a candidate for State Senator
22or representative committee in the case of a candidate for
23State Representative in the General Assembly or State central
24committee in the case of a candidate for statewide office,
25including but not limited to the office of United States
26Senator) of the respective political party for the territorial

1area in which such vacancy occurs.
2    The resolution to fill a vacancy in nomination shall be
3duly acknowledged before an officer qualified to take
4acknowledgements of deeds and shall include, upon its face, the
5following information:
6    (a) the name of the original nominee and the office
7vacated;
8    (b) the date on which the vacancy occurred;
9    (c) the name and address of the nominee selected to fill
10the vacancy and the date of selection.
11    The resolution to fill a vacancy in nomination shall be
12accompanied by a Statement of Candidacy, as prescribed in
13Section 7-10, completed by the selected nominee and a receipt
14indicating that such nominee has filed a statement of economic
15interests as required by the Illinois Governmental Ethics Act.
16    The provisions of Section 10-8 through 10-10.1 relating to
17objections to certificates of nomination and nomination
18papers, hearings on objections, and judicial review, shall
19apply to and govern objections to resolutions for filling a
20vacancy in nomination.
21    Any vacancy in nomination occurring 15 days or less before
22the consolidated election or the general election shall not be
23filled. In this event, the certification of the original
24candidate shall stand and his name shall appear on the official
25ballot to be voted at the general election.
26    A vacancy in nomination occurs when a candidate who has

1been nominated under the provisions of this Article 7 dies
2before the election (whether death occurs prior to, on or after
3the day of the primary), or declines the nomination; provided
4that nominations may become vacant for other reasons.
5    If the name of no established political party candidate was
6printed on the consolidated primary ballot for a particular
7office and if no person was nominated as a write-in candidate
8for such office, a vacancy in nomination shall be created which
9may be filled in accordance with the requirements of this
10Section, except the 3-day transmission requirement shall not
11apply to filling a vacancy due to failure to nominate at a
12primary. If the name of no established political party
13candidate was printed on the general primary ballot for a
14particular office and if no person was nominated as a write-in
15candidate for such office, a vacancy in nomination shall be
16filled only by a person nominated designated by the appropriate
17committee of the political party and only if that designated
18person files nominating petitions with the number of signatures
19required for an established party candidate for that office
20within 75 days after the day of the general primary. The
21circulation period for those petitions begins on the day the
22appropriate committee nominates designates that person. The
23person shall file his or her nominating petitions, statements
24of candidacy, resolution to fill a vacancy in nomination notice
25of appointment by the appropriate committee, and receipt of
26filing his or her statement of economic interests together.

1These documents shall be filed at the same location as provided
2in Section 7-12. The electoral boards having jurisdiction under
3Section 10-9 to hear and pass upon objections to nominating
4petitions also shall hear and pass upon objections to
5nomination petitions filed by candidates under this paragraph.
6For purposes of this Section, the appropriate committees of the
7political parties shall be those committees listed in Section
87-7 of this Code and the legislative committee for the office
9of State Senator and the representative committee for the
10office of State Representative, established by Section 8-5 of
11this Code. Nominations to fill vacancies by the appropriate
12committees shall be in accordance with the provisions of
13Sections 7-8 and 7-8.02, and for vacancies in the office of
14State Senator or State Representative, shall be in accordance
15with Section 8-6 and 8-17.
16    A candidate for whom a nomination paper has been filed as a
17partisan candidate at a primary election, and who is defeated
18for his or her nomination at such primary election, is
19ineligible to be listed on the ballot at that general or
20consolidated election as a candidate of another political
21party.
22    A candidate seeking election to an office for which
23candidates of political parties are nominated by caucus who is
24a participant in the caucus and who is defeated for his or her
25nomination at such caucus, is ineligible to be listed on the
26ballot at that general or consolidated election as a candidate

2    In the proceedings to nominate a candidate to fill a
3vacancy or to fill a vacancy in the nomination, each precinct,
4township, ward, county or congressional district, as the case
5may be, shall through its representative on such central or
6managing committee, be entitled to one vote for each ballot
7voted in such precinct, township, ward, county or congressional
8district, as the case may be, by the primary electors of its
9party at the primary election immediately preceding the meeting
10at which such vacancy is to be filled.
11    For purposes of this Section, the words "certify" and
12"certification" shall refer to the act of officially declaring
13the names of candidates entitled to be printed upon the
14official ballot at an election and directing election
15authorities to place the names of such candidates upon the
16official ballot. "Certifying officers or board" shall refer to
17the local election official, election authority or the State
18Board of Elections, as the case may be, with whom nomination
19papers, including certificates of nomination and resolutions
20to fill vacancies in nomination, are filed and whose duty it is
21to "certify" candidates.

9shall appear upon the primary ballot, the names to appear in
10the order in which petitions have been filed.
11    Not less than 62 55 days prior to the date of the primary,
12the county clerk shall certify to the board of election
13commissioners if there be any such board in his county, the
14names of all candidates so certified to him by the State Board
15of Elections in the districts wholly or partly within the
16jurisdiction of said board and in the order in which such names
17are certified to him.

13    Sec. 10-1. Application of Article to minor political
14parties.
15    (a) Political parties as defined in this Article and
16individual voters to the number and in the manner specified in
17this Article may nominate candidates for public offices whose
18names shall be placed on the ballot to be furnished, as
19provided in this Article. No nominations may be made under this
20Article 10, however, by any established political party which,
21at the general election next preceding, polled more than 5% of
22the entire vote cast in the State, district, or unit of local
23government for which the nomination is made. Those nominations
24provided for in Section 45-5 of the Township Code shall be made
25as prescribed in Sections 45-10 through 45-45 of that Code for

1nominations by established political parties, but minor
2political parties and individual voters are governed by this
3Article. Any convention, caucus, or meeting of qualified voters
4of any established political party as defined in this Article
5may, however, make one nomination for each office therein to be
6filled at any election for officers of a municipality with a
7population of less than 5,000 by causing a certificate of
8nomination to be filed with the municipal clerk no earlier than
9113 78 and no later than 106 71 days before the election at
10which the nominated candidates are to be on the ballot. The
11municipal caucuses shall be conducted on the first Monday in
12December of even-numbered years immediately preceding the
13first day for filing caucus certificates of nomination in each
14year in which municipal officers are to be elected, except
15that, when that Monday is a holiday or the eve of a holiday,
16the caucuses shall be held on the next business day following
17the holiday. Every certificate of nomination shall state the
18facts required in Section 10-5 of this Article and shall be
19signed by the presiding officer and by the secretary of the
20convention, caucus, or meeting, who shall add to their
21signatures their places of residence. The certificates shall be
22sworn to by them to be true to the best of their knowledge and
23belief, and a certificate of the oath shall be annexed to the
24certificate of nomination.
25    (b) Publication of the time and place of holding the caucus
26shall be given by the municipal clerk. For municipalities of

1over 500 population, notice of the caucus shall be published in
2a newspaper published in the municipality. If there is no such
3newspaper, then the notice shall be published in a newspaper
4published in the county and having general circulation in the
5municipality. For municipalities of 500 population or less,
6notice of the caucus shall be given by the municipal clerk by
7posting the notice in 3 of the most public places in the
8municipality. The publication or posting shall be given at
9least 10 days before the caucus.
10    (c) As provided in Sections 3.1-25-20 through 3.1-25-60 of
11the Illinois Municipal Code, a village may adopt a system of
12nonpartisan primary and general elections for the election of
13village officers.
14    (d) Any city, village, or incorporated town with a
15population of 5,000 or less may, by ordinance, determine that
16established political parties shall nominate candidates for
17municipal office in the city, village, or incorporated town by
18primary in accordance with Article 7.
19    (e) Only those voters who reside within the territory for
20which the nomination is made shall be permitted to vote or take
21part in the proceedings of any convention, caucus, or meeting
22of individual voters or of any political party held under this
23Section. No voter shall vote or take part in the proceedings of
24more than one convention, caucus, or meeting to make a
25nomination for the same office.

2    Sec. 10-10. Within 24 hours after the receipt of the

4question of public policy, as the case may be, and the
5objector's petition, the chairman of the electoral board other
6than the State Board of Elections shall send a call by
7registered or certified mail to each of the members of the
8electoral board, and to the objector who filed the objector's
9petition, and either to the candidate whose certificate of
10nomination or nomination papers are objected to or to the
11principal proponent or attorney for proponents of a question of
12public policy, as the case may be, whose petitions are objected
13to, and shall also cause the sheriff of the county or counties
14in which such officers and persons reside to serve a copy of
15such call upon each of such officers and persons, which call
16shall set out the fact that the electoral board is required to
17meet to hear and pass upon the objections to nominations made
18for the office, designating it, and shall state the day, hour
19and place at which the electoral board shall meet for the
20purpose, which place shall be in the county court house in the
21county in the case of the County Officers Electoral Board, the
22Municipal Officers Electoral Board, the Township Officers
23Electoral Board or the Education Officers Electoral Board,
24except that the Municipal Officers Electoral Board, the
25Township Officers Electoral Board, and the Education Officers

1Electoral Board may meet at the location where the governing
2body of the municipality, township, or school or community
3college district, respectively, holds its regularly scheduled
4meetings, if that location is available; provided that voter
5records may be removed from the offices of an election
6authority only at the discretion and under the supervision of
7the election authority. The day of the meeting shall not be
8less than 3 nor more than 5 days after the receipt of the
9certificate of nomination or nomination papers and the
10objector's petition by the chairman of the electoral board. In
11those cases where the State Board of Elections is the electoral
12board designated under Section 10-9, the chairman of the State
13Board of Elections shall, within 24 hours after the receipt of
14the certificate of nomination or nomination papers or petitions
15for a proposed amendment to Article IV of the Constitution or
16proposed statewide question of public policy, send a call by
17registered or certified mail to the objector who files the
18objector's petition, and either to the candidate whose
19certificate of nomination or nomination papers are objected to
20or to the principal proponent or attorney for proponents of the
21proposed Constitutional amendment or statewide question of
22public policy and shall state the day, hour and place at which
23the electoral board shall meet for the purpose, which place may
24be in the Capitol Building or in the principal or permanent
25branch office of the State Board. The day of the meeting of the
26State Board of Elections serving as the electoral board shall

1not be less than 3 nor more than 7 business 5 days after the
2last day to file the objection. receipt of the certificate of
3nomination or nomination papers and the objector's petition by
4the chairman of the electoral board.
5    The electoral board shall have the power to administer
6oaths and to subpoena and examine witnesses and at the request
7of either party the chairman may issue subpoenas requiring the
8attendance of witnesses and subpoenas duces tecum requiring the
9production of such books, papers, records and documents as may
10be evidence of any matter under inquiry before the electoral
11board, in the same manner as witnesses are subpoenaed in the
12Circuit Court.
13    Service of such subpoenas shall be made by any sheriff or
14other person in the same manner as in cases in such court and
15the fees of such sheriff shall be the same as is provided by
16law, and shall be paid by the objector or candidate who causes
17the issuance of the subpoena. In case any person so served
18shall knowingly neglect or refuse to obey any such subpoena, or
19to testify, the electoral board shall at once file a petition
20in the circuit court of the county in which such hearing is to
21be heard, or has been attempted to be heard, setting forth the
22facts, of such knowing refusal or neglect, and accompanying the
23petition with a copy of the citation and the answer, if one has
24been filed, together with a copy of the subpoena and the return
25of service thereon, and shall apply for an order of court
26requiring such person to attend and testify, and forthwith

1produce books and papers, before the electoral board. Any
2circuit court of the state, excluding the judge who is sitting
3on the electoral board, upon such showing shall order such
4person to appear and testify, and to forthwith produce such
5books and papers, before the electoral board at a place to be
6fixed by the court. If such person shall knowingly fail or
7refuse to obey such order of the court without lawful excuse,
8the court shall punish him or her by fine and imprisonment, as
9the nature of the case may require and may be lawful in cases
10of contempt of court.
11    The electoral board on the first day of its meeting shall
12adopt rules of procedure for the introduction of evidence and
13the presentation of arguments and may, in its discretion,
14provide for the filing of briefs by the parties to the
15objection or by other interested persons.
16    In the event of a State Electoral Board hearing on
17objections to a petition for an amendment to Article IV of the
18Constitution pursuant to Section 3 of Article XIV of the
19Constitution, or to a petition for a question of public policy
20to be submitted to the voters of the entire State, the
21certificates of the county clerks and boards of election
22commissioners showing the results of the random sample of
23signatures on the petition shall be prima facie valid and
24accurate, and shall be presumed to establish the number of
25valid and invalid signatures on the petition sheets reviewed in
26the random sample, as prescribed in Section 28-11 and 28-12 of

1this Code. Either party, however, may introduce evidence at
2such hearing to dispute the findings as to particular
3signatures. In addition to the foregoing, in the absence of
4competent evidence presented at such hearing by a party
5substantially challenging the results of a random sample, or
6showing a different result obtained by an additional sample,
7this certificate of a county clerk or board of election
8commissioners shall be presumed to establish the ratio of valid
9to invalid signatures within the particular election
10jurisdiction.
11    The electoral board shall take up the question as to
12whether or not the certificate of nomination or nomination
13papers or petitions are in proper form, and whether or not they
14were filed within the time and under the conditions required by
15law, and whether or not they are the genuine certificate of
16nomination or nomination papers or petitions which they purport
17to be, and whether or not in the case of the certificate of
18nomination in question it represents accurately the decision of
19the caucus or convention issuing it, and in general shall
20decide whether or not the certificate of nomination or
21nominating papers or petitions on file are valid or whether the
22objections thereto should be sustained and the decision of a
23majority of the electoral board shall be final subject to
24judicial review as provided in Section 10-10.1. The electoral
25board must state its findings in writing and must state in
26writing which objections, if any, it has sustained. A copy of

1the decision shall be served upon the parties to the
2proceedings in open proceedings before the electoral board. If
3a party does not appear for receipt of the decision, the
4decision shall be deemed to have been served on the absent
5party on the date when a copy of the decision is personally
6delivered or on the date when a copy of the decision is
7deposited in the Unites States mail, in a sealed envelope or
8package, with postage prepaid, addressed to each party affected
9by the decision or to such party's attorney of record, if any,
10at the address on record for such person in the files of the
11electoral board. In cases in which the State Board of Elections
12serves as the electoral board, the board may serve a copy of
13the decision in open proceedings before the electoral board or
14transmit the decision electronically or via facsimile
15transmission to the parties within 24 hours following the
16meeting at which a final decision has been reached.
17    Upon the expiration of the period within which a proceeding
18for judicial review must be commenced under Section 10--10.1,
19the electoral board shall, unless a proceeding for judicial
20review has been commenced within such period, transmit, by
21registered or certified mail, a certified copy of its ruling,
22together with the original certificate of nomination or
23nomination papers or petitions and the original objector's
24petition, to the officer or board with whom the certificate of
25nomination or nomination papers or petitions, as objected to,
26were on file, and such officer or board shall abide by and

4    Sec. 10-11.1. Whenever a vacancy in the office of State
5Senator is to be filled by election pursuant to Article IV,
6Section 2(d) of the Constitution and Section 25-6 of this Code,
7nominations shall be made pursuant to this Section:
8        (1) If the vacancy in office occurs before the first
9    date provided in Section 10-6 10-3 for filing nomination
10    papers for the general election in the next even-numbered

18    for the general election in the next even-numbered year
19    following the commencement of the term, independent
20    candidates for such office shall file their nomination
21    papers during the filing period set forth in Section 10-6
22    for new political party candidates.
23        (3) (Blank). If a vacancy in office occurs prior to the
24    first day provided in Section 10-6 for filing nomination
25    papers for new political party candidates for the next

1    ensuing general election, new political party candidates
2    for such office shall file their nomination papers during
3    the filing period as set forth in Section 10-6 as otherwise
4    provided in this Article.
5        (4) If the vacancy in office occurs during the time
6    provided in Section 10-6 for filing nomination papers for
7    new political party candidates for the next ensuing general
8    election, the time for independent and new political party
9    candidates to file nomination papers for such office shall
10    be not more than 92 days nor less than 85 days prior to the
11    date of the general election.
12        (5) If the vacancy in office occurs after the last day
13    provided in Section 10-6 for filing nomination papers for
14    new political party candidates, independent and new
15    political party candidates shall be nominated as provided
16    by rules and regulations of the State Board of Elections.
17    The provisions of Sections 10-8 and 10-10.1 relating to
18objections to nomination papers, hearings on objections and
19judicial review, shall also apply to and govern objections to
20nomination papers filed pursuant to this Section.
21    Unless otherwise specified herein, the nomination and
22election provided for in this Section shall be governed by this
23Code.

1    Sec. 10-14. Not less than 74 days before the date of the
2general election the State Board of Elections shall certify to
3the county clerk of each county the name of each candidate
4whose nomination papers, certificate of nomination or
5resolution to fill a vacancy in nomination has been filed with
6the State Board of Elections and direct the county clerk to
7place upon the official ballot for the general election the
8names of such candidates in the same manner and in the same
9order as shown upon the certification. The name of no candidate
10for an office to be filled by the electors of the entire state
11shall be placed upon the official ballot unless his name is
12duly certified to the county clerk upon a certificate signed by
13the members of the State Board of Elections. The names of group
14candidates on petitions shall be certified to the several
15county clerks in the order in which such names appear on such
16petitions filed with the State Board of Elections.
17    Not less than 68 days before the date of the general
18election, each county clerk shall certify the names of each of
19the candidates for county offices whose nomination papers,
20certificates of nomination or resolutions to fill a vacancy in
21nomination have been filed with such clerk and declare that the

24same manner and in the same order as shown upon the

2certification. In addition, each county clerk in whose county
3there is a board of election commissioners shall, not less than
462 69 days before the election, certify to the board of
5election commissioners the name of the person or persons
6nominated for such office as shown by the certificate of the
7State Board of Elections, together with the names of all other
8candidates as shown by the certification of county officers on
9file in the clerk's office, and in the order so certified. The
10county clerk or board of election commissioners shall print the
11names of the nominees on the ballot for each office in the
12order in which they are certified to or filed with the county
13clerk; provided, that in printing the name of nominees for any
14office, if any of such nominees have also been nominated by one
15or more political parties pursuant to this Act, the location of
16the name of such candidate on the ballot for nominations made
17under this Article shall be precisely in the same order in
18which it appears on the certification of the State Board of
19Elections to the county clerk.
20    For the general election, the candidates of new political
21parties shall be placed on the ballot for said election after
22the established political party candidates and in the order of
23new political party petition filings.
24    Each certification shall indicate, where applicable, the
25following:
26        (1) The political party affiliation if any, of the

1    candidates for the respective offices;
2        (2) If there is to be more than one candidate elected
3    to an office from the State, political subdivision or
4    district;
5        (3) If the voter has the right to vote for more than

8    for less than a full term or if the offices to be filled in
9    a political subdivision are for different terms.
10    The State Board of Elections or the county clerk, as the
11case may be, shall issue an amended certification whenever it
12is discovered that the original certification is in error.

630 days before the date set by the circuit court for the
7conduct of an emergency referendum pursuant to Section 2A-1.4,
8the circuit court clerk shall certify the public question as
9herein required.
10    Local election officials and circuit court clerks shall
11make their certifications, as required by this Section, to each
12election authority having jurisdiction over any of the
13territory of the respective political subdivision in which the
14public question is to be submitted to referendum.
15    Not less than 68 61 days before the next regular election,
16the county clerk shall certify the public questions to be
17submitted to the voters of the entire county at that election,
18which have been initiated by petitions filed in his office or
19by action of the county board, to the board of election
20commissioners, if any, in his county.
21    Not less than 74 67 days before the general election, the
22State Board of Elections shall certify any questions proposing
23an amendment to Article IV of the Constitution pursuant to
24Section 3, Article XIV of the Constitution and any advisory
25public questions to be submitted to the voters of the entire
26State, which have been initiated by petitions received or filed

1at its office, to the respective county clerks. Not less than
262 61 days before the general election, the county clerk shall
3certify such questions to the board of election commissioners,
4if any, in his county.
5    The certifications shall include the form of the public
6question to be placed on the ballot, the date on which the
7public question was initiated by either the filing of a
8petition or the adoption of a resolution or ordinance by a
9governing body, as the case may be, and a certified copy of any
10court order or political subdivision resolution or ordinance
11requiring the submission of the public question.
12Certifications of propositions for annexation to,
13disconnection from, or formation of political subdivisions or
14for other purposes shall include a description of the territory
15in which the proposition is required to be submitted, whenever
16such territory is not coterminous with an existing political
17subdivision.
18    The certification of a public question described in
19subsection (b) of Section 28-6 shall include the precincts
20included in the territory concerning which the public question
21is to be submitted, as well as a common description of such
22territory, in plain and nonlegal language, and specify the
23election at which the question is to be submitted. The
24description of the territory shall be prepared by the local
25election official as set forth in the resolution or ordinance
26initiating the public question.

1    Whenever a local election official, an election authority,
2or the State Board of Elections is in receipt of an initiating
3petition, or a certification for the submission of a public
4question at an election at which the public question may not be
5placed on the ballot or submitted because of the limitations of
6Section 28-1, such officer or board shall give notice of such
7prohibition, by registered mail, as follows:
8        (a) in the case of a petition, to any person designated
9    on a certificate attached thereto as the proponent or as
10    the proponents' attorney for purposes of notice of
11    objections;
12        (b) in the case of a certificate from a local election
13    authority, to such local election authority, who shall
14    thereupon give notice as provided in subparagraph (a), or
15    notify the governing board which adopted the initiating
16    resolution or ordinance;
17        (c) in the case of a certification from a circuit court
18    clerk of a court order, to such court, which shall
19    thereupon give notice as provided in subparagraph (a) and
20    shall modify its order in accordance with the provisions of
21    this Act.
22    If the petition, resolution or ordinance initiating such
23prohibited public question did not specify a particular
24election for its submission, the officer or board responsible
25for certifying the question to the election authorities shall
26certify or recertify the question, in the manner required

1herein, for submission on the ballot at the next regular
2election no more than one year, or 15 months in the case of a
3back door referendum as defined in subsection (f) of Section
428-2, subsequent to the filing of the initiating petition or

6which the public question may be submitted, and the appropriate
7election authorities shall submit the question at such
8election, unless the public question is ordered submitted as an
9emergency referendum pursuant to Section 2A-1.4 or is withdrawn
10as may be provided by law.

3    (a) On the first second Tuesday in December January
4preceding the date of the regular township election, a caucus
5shall be held by the voters of each established political party
6in a township to nominate its candidates for the various
7offices to be filled at the election. Notice of the caucus
8shall be given at least 10 days before it is held by
9publication in some newspaper having a general circulation in
10the township. Not less than 30 days before the caucus, the
11township clerk shall notify the chairman or membership of each
12township central committee by first-class mail of the
13chairman's or membership's obligation to report the time and
14location of the political party's caucus. Not less than 20 days
15before the caucus, each chairman of the township central
16committee shall notify the township clerk by first-class mail
17of the time and location of the political party's caucus. If
18the time and location of 2 or more political party caucuses
19conflict, the township clerk shall establish, by a fair and
20impartial public lottery, the time and location for each
21caucus.
22    (b) Except as provided in this Section, the township board
23shall cause notices of the caucuses to be published. The notice
24shall state the time and place where the caucus for each
25political party will be held. The board shall fix a place
26within the township for holding the caucus for each established

2Section 10-25, the county board shall cause notice of the

19filed in the office of the township clerk, except that if the
20township is entirely within the corporate limits of a city,
21village, or incorporated town under the jurisdiction of a board
22of election commissioners, the nomination papers shall be filed
23in the office of the board of election commissioners instead of
24the township clerk.

7    (a) On the first second Wednesday in December January
8preceding the date of any election at which township officers

12    (b) For purposes of this Code, the multi-township central
13committee of each established political party shall consist of
14the elected or appointed precinct committeemen of each
15established political party within the multi-township district
16and shall promulgate rules of procedure under Section 45-50.
17    (c) The multi-township central committee of each
18established political party shall cause notices of the caucuses
19to be published. The notices shall state the time and place
20where the caucus for each established political party will be
21held within the multi-township district and shall be published
22in a newspaper of general circulation in the district 10 days
23before the caucuses are held. Not less than 30 days before the
24caucus, the multi-township clerk shall notify the chairman or
25membership of each multi-township central committee by

4township collectors were elected in the year 1937, no township
5collectors shall be elected unless the proposition to elect
6those officers has first been submitted to the electors of the
7county and approved in the manner provided in this Section.
8    (b) Whenever a petition for referendum, signed by at least
910% of the total number of voters voting at the last general
10election at which any county officer was elected, is filed with
11the county clerk not less than 92 78 days before a regular
12election, the county clerk shall certify for submission the
13proposition of electing township collectors in townships in
14counties described in subsection (a) in accordance with the
15general election law. The proposition shall be in substantially
16the following form:
17        Shall township collectors be elected for the several
18    townships of (name of county) under Section 50-25 of the
19    Township Code?
20The votes shall be recorded as "Yes" or "No".
21    (c) If a majority of the voters voting on the proposition
22vote in favor of it, there shall be elected in each township in
23the county at the next regular election for township offices
24one township collector. The collector shall hold office until
25the date of the expiration of the term of office of township
26collectors in Cook County as provided in Section 50-10, and

20any county officer was elected and requesting submission to the
21voters of the county of the proposition of discontinuing the
22office of the township collector in the county, is filed with
23the county clerk not less than 92 78 days before a regular
24election, the county clerk shall submit the proposition in

8collector, no township collectors shall thereafter be elected
9in the county unless there has again been submitted to the
10voters of the county and approved by them a proposition to
11establish the office of township collector.

14changing Sections 3.1-10-50, 3.1-20-45, 3.1-25-20, 3.1-25-60,

19    (a) Vacancy by resignation. A resignation is not effective
20unless it is in writing, signed by the person holding the
21elective office, and notarized.
22        (1) Unconditional resignation. An unconditional
23    resignation by a person holding the elective office may
24    specify a future date, not later than 60 days after the

1    date the resignation is received by the officer authorized
2    to fill the vacancy, at which time it becomes operative,
3    but the resignation may not be withdrawn after it is
4    received by the officer authorized to fill the vacancy. The
5    effective date of a resignation that does not specify a
6    future date at which it becomes operative is the date the
7    resignation is received by the officer authorized to fill
8    the vacancy. The effective date of a resignation that has a
9    specified future effective date is that specified future
10    date or the date the resignation is received by the officer
11    authorized to fill the vacancy, whichever date occurs
12    later.
13        (2) Conditional resignation. A resignation that does
14    not become effective unless a specified event occurs can be
15    withdrawn at any time prior to the occurrence of the
16    specified event, but if not withdrawn, the effective date
17    of the resignation is the date of the occurrence of the
18    specified event or the date the resignation is received by
19    the officer authorized to fill the vacancy, whichever date
20    occurs later.
21        (3) Vacancy upon the effective date. For the purpose of
22    determining the time period that would require an election
23    to fill the vacancy by resignation or the commencement of
24    the 60-day time period referred to in subsection (e), the
25    resignation of an elected officer is deemed to have created
26    a vacancy as of the effective date of the resignation.

1        (4) Duty of the clerk. If a resignation is delivered to
2    the clerk of the municipality, the clerk shall forward a
3    certified copy of the written resignation to the official
4    who is authorized to fill the vacancy within 7 business
5    days after receipt of the resignation.
6    (b) Vacancy by death or disability. A vacancy occurs in an
7office by reason of the death of the incumbent. The date of the
8death may be established by the date shown on the death
9certificate. A vacancy occurs in an office by permanent
10physical or mental disability rendering the person incapable of
11performing the duties of the office. The corporate authorities
12have the authority to make the determination whether an officer
13is incapable of performing the duties of the office because of
14a permanent physical or mental disability. A finding of mental
15disability shall not be made prior to the appointment by a
16court of a guardian ad litem for the officer or until a duly
17licensed doctor certifies, in writing, that the officer is
18mentally impaired to the extent that the officer is unable to
19effectively perform the duties of the office. If the corporate
20authorities find that an officer is incapable of performing the
21duties of the office due to permanent physical or mental
22disability, that person is removed from the office and the
23vacancy of the office occurs on the date of the determination.
24    (c) Vacancy by other causes.
25        (1) Abandonment and other causes. A vacancy occurs in
26    an office by reason of abandonment of office; removal from

1    office; or failure to qualify; or more than temporary
2    removal of residence from the municipality; or in the case
3    of an alderman of a ward or councilman or trustee of a
4    district, more than temporary removal of residence from the
5    ward or district, as the case may be. The corporate
6    authorities have the authority to determine whether a
7    vacancy under this subsection has occurred. If the
8    corporate authorities determine that a vacancy exists, the
9    office is deemed vacant as of the date of that
10    determination for all purposes including the calculation
11    under subsections (e), (f), and (g).
12        (2) Guilty of a criminal offense. An admission of guilt
13    of a criminal offense that upon conviction would disqualify
14    the municipal officer from holding the office, in the form
15    of a written agreement with State or federal prosecutors to
16    plead guilty to a felony, bribery, perjury, or other
17    infamous crime under State or federal law, constitutes a
18    resignation from that office, effective on the date the
19    plea agreement is made. For purposes of this Section, a
20    conviction for an offense that disqualifies a municipal
21    officer from holding that office occurs on the date of the
22    return of a guilty verdict or, in the case of a trial by
23    the court, on the entry of a finding of guilt.
24        (3) Election declared void. A vacancy occurs on the
25    date of the decision of a competent tribunal declaring the
26    election of the officer void.

1    (d) Election of an acting mayor or acting president. The
2election of an acting mayor or acting president pursuant to
3subsection (f) or (g) does not create a vacancy in the original
4office of the person on the city council or as a trustee, as
5the case may be, unless the person resigns from the original
6office following election as acting mayor or acting president.
7If the person resigns from the original office following
8election as acting mayor or acting president, then the original
9office must be filled pursuant to the terms of this Section and
10the acting mayor or acting president shall exercise the powers
11of the mayor or president and shall vote and have veto power in
12the manner provided by law for a mayor or president. If the
13person does not resign from the original office following
14election as acting mayor or acting president, then the acting
15mayor or acting president shall exercise the powers of the
16mayor or president but shall be entitled to vote only in the
17manner provided for as the holder of the original office and
18shall not have the power to veto. If the person does not resign
19from the original office following election as acting mayor or
20acting president, and if that person's original term of office
21has not expired when a mayor or president is elected and has
22qualified for office, the acting mayor or acting-president
23shall return to the original office for the remainder of the
24term thereof.
25    (e) Appointment to fill alderman or trustee vacancy. An

1president, as the case may be, of a qualified person as
2described in Section 3.1-10-5 of this Code to fill a vacancy in
3the office of alderman or trustee must be made within 60 days
4after the vacancy occurs. Once the appointment of the qualified
5person has been forwarded to the corporate authorities, the
6corporate authorities shall act upon the appointment within 30
7days. If the appointment fails to receive the advice and
8consent of the corporate authorities within 30 days, the mayor
9or president or acting mayor or acting president shall appoint
10and forward to the corporate authorities a second qualified
11person as described in Section 3.1-10-5. Once the appointment
12of the second qualified person has been forwarded to the
13corporate authorities, the corporate authorities shall act
14upon the appointment within 30 days. If the appointment of the
15second qualified person also fails to receive the advice and
16consent of the corporate authorities, then the mayor or
17president or acting mayor or acting president, without the
18advice and consent of the corporate authorities, may make a
19temporary appointment from those persons who were appointed but
20whose appointments failed to receive the advice and consent of
21the corporate authorities. The person receiving the temporary
22appointment shall serve until an appointment has received the
23advice and consent and the appointee has qualified or until a
24person has been elected and has qualified, whichever first
25occurs.
26    (f) Election to fill vacancies in municipal offices with

14-year terms. If a vacancy occurs in an elective municipal
2office with a 4-year term and there remains an unexpired
3portion of the term of at least 28 months, and the vacancy
4occurs at least 130 days before the general municipal election
5next scheduled under the general election law, then the vacancy
6shall be filled for the remainder of the term at that general
7municipal election. Whenever an election is held for this
8purpose, the municipal clerk shall certify the office to be
9filled and the candidates for the office to the proper election
10authorities as provided in the general election law. If a
11vacancy occurs with less than 28 months remaining in the
12unexpired portion of the term or less than 130 days before the
13general municipal election, then:
14        (1) Mayor or president. If the vacancy is in the office
15    of mayor or president, the vacancy must be filled by the
16    corporate authorities electing one of their members as
17    acting mayor or acting president. Except as set forth in
18    subsection (d), the acting mayor or acting president shall
19    perform the duties and possess all the rights and powers of
20    the mayor or president until a mayor or president is
21    elected at the next general municipal election and has
22    qualified. However, in villages with a population of less
23    than 5,000, if each of the trustees either declines the
24    election as acting president or is not elected by a
25    majority vote of the trustees presently holding office,
26    then the trustees may elect, as acting president, any other

1    village resident who is qualified to hold municipal office,
2    and the acting president shall exercise the powers of the
3    president and shall vote and have veto power in the manner
4    provided by law for a president.
5        (2) Alderman or trustee. If the vacancy is in the
6    office of alderman or trustee, the vacancy must be filled
7    by the mayor or president or acting mayor or acting
8    president, as the case may be, in accordance with
9    subsection (e).
10        (3) Other elective office. If the vacancy is in any
11    elective municipal office other than mayor or president or
12    alderman or trustee, the mayor or president or acting mayor
13    or acting president, as the case may be, must appoint a
14    qualified person to hold the office until the office is
15    filled by election, subject to the advice and consent of
16    the city council or the board of trustees, as the case may
17    be.
18    (g) Vacancies in municipal offices with 2-year terms. In
19the case of an elective municipal office with a 2-year term, if
20the vacancy occurs at least 165 130 days before the general
21municipal election next scheduled under the general election
22law, the vacancy shall be filled for the remainder of the term
23at that general municipal election. If the vacancy occurs less
24than 165 130 days before the general municipal election, then:
25        (1) Mayor or president. If the vacancy is in the office
26    of mayor or president, the vacancy must be filled by the

2    acting mayor or acting president. Except as set forth in
3    subsection (d), the acting mayor or acting president shall

2    be.
3    (h) In cases of vacancies arising by reason of an election
4being declared void pursuant to paragraph (3) of subsection
5(c), persons holding elective office prior thereto shall hold
6office until their successors are elected and qualified or
7appointed and confirmed by advice and consent, as the case may
8be.
9    (i) This Section applies only to municipalities with
10populations under 500,000.

13    Sec. 3.1-20-45. Nonpartisan primary elections; uncontested
14office. A city incorporated under this Code that elects
15municipal officers at nonpartisan primary and general
16elections shall conduct the elections as provided in the
17Election Code, except that no office for which nomination is
18uncontested shall be included on the primary ballot and no
19primary shall be held for that office. For the purposes of this
20Section, an office is uncontested when not more than 4 persons
21to be nominated for each office have timely filed valid
22nominating papers seeking nomination for the election to that
23office.
24    Notwithstanding the preceding paragraph, when a person (i)
25who has not timely filed valid nomination papers and (ii) who

1intends to become a write-in candidate for nomination for any
2office for which nomination is uncontested files a written
3statement or notice of that intent with the proper election
4official with whom the nomination papers for that office are
5filed, if the write-in candidate becomes the fifth candidate
6filed, a primary ballot must be prepared and a primary must be
7held for the office. The statement or notice must be filed on
8or before the certification date provided in the Election Code
961st day before the consolidated primary election. The
10statement must contain (i) the name and address of the person
11intending to become a write-in candidate, (ii) a statement that
12the person intends to become a write-in candidate, and (iii)
13the office the person is seeking as a write-in candidate. An
14election authority has no duty to conduct a primary election or
15prepare a primary ballot unless a statement meeting the
16requirements of this paragraph is filed in a timely manner.

19    Sec. 3.1-25-20. Primary election. A village incorporated
20under this Code shall nominate and elect candidates for
21president and trustees in nonpartisan primary and general
22elections as provided in Sections 3.1-25-20 through 3.1-25-55
23until the electors of the village vote to require the partisan
24election of the president and trustees at a referendum in the
25manner provided in Section 3.1-25-65 after January 1, 1992. The

2to all villages incorporated under this Code that have operated
3under those Sections without the adoption of those provisions
4by the referendum provided in Section 3.1-25-60 as well as
5those villages that have adopted those provisions by the
6referendum provided in Section 3.1-25-60 until the electors of
7those villages vote to require the partisan election of the
8president and trustees in the manner provided in Section
93.1-25-65. Villages that have nominated and elected candidates
10for president and trustees in partisan elections prior to
11January 1, 1992, may continue to hold partisan elections
12without conducting a referendum in the manner provided in
13Section 3.1-25-65. All candidates for nomination to be voted
14for at all general municipal elections at which a president or
15trustees, or both, are to be elected under this Article shall
16be nominated from the village at large by a primary election.
17    Notwithstanding any other provision of law, no primary
18shall be held in any village when the nomination for every
19office to be voted upon by the electors of the village is
20uncontested. If the nomination of candidates is uncontested as
21to one or more, but not all, of the offices to be voted upon by
22the electors of the village, then a primary must be held in the
23village, provided that the primary ballot shall not include
24those offices in the village for which the nomination is
25uncontested. For the purposes of this Section, an office is
26uncontested when not more than the number of persons to be

2papers seeking nomination for election to that office.
3    Notwithstanding the preceding paragraph, when a person (i)

8within the municipality shall be effective until the day after
9the date of the primary or general election, as the case may

13authorities at least 92 90 days prior to the next election at
14which such proposition may be voted upon. The petition may
15specify whether the transportation system financed by a tax
16levy under this Section is to serve only the municipality
17levying such tax or specified regions outside the corporate
18boundaries of such municipality in addition thereto. The

20transportation-related services for the purposes of this
21Section. Municipalities should utilize where possible existing
22facilities and systems already operating for the purposes
23outlined in this Section.
24    (c) Taxes authorized under this Section may be used only
25for the purpose of financing a transportation system for
26elderly and handicapped persons as authorized in this Section.

1    (d) For purposes of this Section, "handicapped person"
2means any individual who, by reason of illness, injury, age,
3congenital malfunction, or other permanent or temporary
4disability, is unable without special public transportation
5facilities or special planning or design to utilize ordinary
6public transportation facilities and services as effectively
7as persons who are not so affected.
8"Public transportation for elderly and handicapped" means a
9transportation system for persons who have mental or physical
10difficulty in accessing or using the conventional public mass
11transportation system, or for any other reason.

13    Section 30. The Park District Code is amended by changing
14Section 2-25 as follows:

21to perform the duties of his or her office or attend meetings
22of the board for the length of time as the board fixes by
23ordinance, or (viii) for any other reason specified by law,

2board. Any person so appointed shall hold his or her office

7    remaining in the term, the person appointed to fill the
8    vacancy shall hold his or her office until the expiration
9    of the term for which he or she has been appointed, and no
10    election to fill the vacancy shall be held.
11        (2) If the vacancy occurs with more than 28 months left
12    in the term, but less than 123 88 days before the next
13    regularly scheduled election for this office, the person
14    appointed to fill the vacancy shall hold his or her office
15    until the second regularly scheduled election for the
16    office following the appointment, at which a member shall
17    be elected to fill the vacancy for the unexpired term.

5levied by the district. Absence without cause from all regular
6board meetings for a period of one year shall be a basis for
7declaring a vacancy.
8    (b) All vacancies shall be filled by appointment by the
9remaining trustees until the next regular library election, at
10which time a trustee shall be elected for the remainder of the
11unexpired term. If, however, the vacancy occurs with less than
1228 months remaining in the term, and if the vacancy occurs less
13than 123 88 days before the next regular scheduled election for
14this office, then the person so appointed shall serve the
15remainder of the unexpired term and no election to fill the
16vacancy shall be held. If the vacancy is in the office of a
17trustee of a library district with an appointed board, the
18vacancy shall be filled by appointment by the remaining
19trustees. Vacancies shall be filled forthwith.

2more than 500,000 inhabitants, as ascertained by any special or
3general census, and not governed by special Acts, shall be
4governed by a board of education consisting of 7 members,
5serving without compensation except as herein provided. Each
6member shall be elected for a term of 4 years for the initial
7members of the board of education of a combined school district
8to which that subsection applies. If 5 members are elected in
91983 pursuant to the extension of terms provided by law for
10transition to the consolidated election schedule under the
11general election law, 2 of those members shall be elected to
12serve terms of 2 years and 3 shall be elected to serve terms of
134 years; their successors shall serve for a 4 year term. When
14the voters of a district have voted to elect members of the
15board of education for 6 year terms, as provided in Section
169-5, the terms of office of members of the board of education
17of that district expire when their successors assume office but
18not later than 7 days after such election. If at the regular
19school election held in the first odd-numbered year after the
20determination to elect members for 6 year terms 2 members are
21elected, they shall serve for a 6 year term; and of the members
22elected at the next regular school election 3 shall serve for a
23term of 6 years and 2 shall serve a term of 2 years. Thereafter
24members elected in such districts shall be elected to a 6 year
25term. If at the regular school election held in the first
26odd-numbered year after the determination to elect members for

16 year terms 3 members are elected, they shall serve for a 6
2year term; and of the members elected at the next regular
3school election 2 shall serve for a term of 2 years and 2 shall

6school election held in the first odd-numbered year after the
7determination to elect members for 6 year terms 4 members are
8elected, 3 shall serve for a term of 6 years and one shall
9serve for a term of 2 years; and of the members elected at the
10next regular school election 2 shall serve for terms of 6 years
11and 2 shall serve for terms of 2 years. Thereafter members
12elected in such districts shall be elected to a 6 year term. If
13at the regular school election held in the first odd-numbered
14year after the determination to elect members for a 6 year term
155 members are elected, 3 shall serve for a term of 6 years and 2
16shall serve for a term of 2 years; and of the members elected
17at the next regular school election 2 shall serve for terms of
186 years and 2 shall serve for terms of 2 years. Thereafter
19members elected in such districts shall be elected to a 6 year
20term. An election for board members shall not be held in school
21districts which by consolidation, annexation or otherwise
22shall cease to exist as a school district within 6 months after
23the election date, and the term of all board members which
24would otherwise terminate shall be continued until such
25district shall cease to exist. Each member, on the date of his
26or her election, shall be a citizen of the United States of the

1age of 18 years or over, shall be a resident of the State and
2the territory of the district for at least one year immediately
3preceding his or her election, shall be a registered voter as
4provided in the general election law, shall not be a school
5trustee, and shall not be a child sex offender as defined in
6Section 11-9.3 of the Criminal Code of 1961. When the board of
7education is the successor of the school directors, all rights
8of property, and all rights regarding causes of action existing
9or vested in such directors, shall vest in it as fully as they
10were vested in the school directors. Terms of members are
11subject to Section 2A-54 of the Election Code.
12    Nomination papers filed under this Section are not valid
13unless the candidate named therein files with the secretary of
14the board of education or with a person designated by the board
15to receive nominating petitions a receipt from the county clerk
16showing that the candidate has filed a statement of economic
17interests as required by the Illinois Governmental Ethics Act.
18Such receipt shall be so filed either previously during the
19calendar year in which his nomination papers were filed or
20within the period for the filing of nomination papers in
21accordance with the general election law.
22    Whenever a vacancy occurs, the remaining members shall
23notify the regional superintendent of that vacancy within 5
24days after its occurrence and shall proceed to fill the vacancy
25until the next regular school election, at which election a
26successor shall be elected to serve the remainder of the

1unexpired term. However, if the vacancy occurs with less than
2868 days remaining in the term, or if the vacancy occurs less
3than 123 88 days before the next regularly scheduled election
4for this office then the person so appointed shall serve the
5remainder of the unexpired term, and no election to fill the
6vacancy shall be held. Should they fail so to act, within 45
7days after the vacancy occurs, the regional superintendent of
8schools under whose supervision and control the district is
9operating, as defined in Section 3-14.2 of this Act, shall
10within 30 days after the remaining members have failed to fill
11the vacancy, fill the vacancy as provided for herein. Upon the
12regional superintendent's failure to fill the vacancy, the
13vacancy shall be filled at the next regularly scheduled
14election. Whether elected or appointed by the remaining members
15or regional superintendent, the successor shall be an
16inhabitant of the particular area from which his or her
17predecessor was elected if the residential requirements
18contained in Section 10-10.5 or 12-2 of this Code apply.
19    A board of education may appoint a student to the board to
20serve in an advisory capacity. The student member shall serve
21for a term as determined by the board. The board may not grant
22the student member any voting privileges, but shall consider
23the student member as an advisor. The student member may not
24participate in or attend any executive session of the board.

1    Section 45. The Public Community College Act is amended by
2changing Section 3-7 as follows:
 
3    (110 ILCS 805/3-7)  (from Ch. 122, par. 103-7)
4    Sec. 3-7. (a) The election of the members of the board of
5trustees shall be nonpartisan and shall be held at the time and
6in the manner provided in the general election law.
7    (b) Unless otherwise provided in this Act, members shall be
8elected to serve 6 year terms. The term of members elected in
91985 and thereafter shall be from the date the member is
10officially determined to be elected to the board by a canvass
11conducted pursuant to the Election Code, to the date that the
12winner of the seat is officially determined by the canvass
13conducted pursuant to the Election Code the next time the seat
14on the board is to be filled by election.
15    (c) A board of trustees of a community college district
16which is contiguous or has been contiguous to an experimental
17community college district as authorized and defined by Article
18IV of this Act may, on its own motion, or shall, upon the
19petition of the lesser of 1/10 or 2,000 of the voters
20registered in the district, order submitted to the voters of
21the district at the next general election the proposition for
22the election of board members by trustee district rather than
23at large, and such proposition shall thereupon be certified by
24the secretary of the board to the proper election authority in
25accordance with the general election law for submission.

1    If the proposition is approved by a majority of those
2voting on the proposition, the State Board of Elections, in
31991, shall reapportion the trustee districts to reflect the
4results of the last decennial census, and shall divide the
5community college district into 7 trustee districts, each of
6which shall be compact, contiguous and substantially equal in
7population to each other district. In 2001, and in the year
8following each decennial census thereafter, the board of
9trustees of community college District #522 shall reapportion
10the trustee districts to reflect the results of the census, and
11shall divide the community college district into 7 trustee
12districts, each of which shall be compact, contiguous, and
13substantially equal in population to each other district. The
14division of the community college district into trustee
15districts shall be completed and formally approved by a
16majority of the members of the board of trustees of community
17college District #522 in 2001 and in the year following each
18decennial census. At the same meeting of the board of trustees,
19the board shall, publicly by lot, divide the trustee districts
20as equally as possible into 2 groups. Beginning in 2003 and
21every 10 years thereafter, trustees or their successors from
22one group shall be elected for successive terms of 4 years and
236 years; and members or their successors from the second group
24shall be elected for successive terms of 6 years and 4 years.
25One member shall be elected from each such trustee district.
26Each member elected in 2001 shall be elected at the 2001

1consolidated election from the trustee districts established
2in 1991. The term of each member elected in 2001 shall end on
3the date that the trustees elected in 2003 are officially
4determined by a canvass conducted pursuant to the Election
5Code.
6    (d) In Community College District No. 526, the election of
7board members shall be by trustee district rather than at large
8beginning with the consolidated election in 2005.
9    For the 2005, 2007, and 2009 consolidated elections, the
10community college district is divided into 7 trustee districts
11as follows:

1The term "tract" means census tract. Trustee districts created
2by this subsection (d) for the purpose of electing board
3members shall not be altered by operation of any other statute,
4ordinance, or resolution. Any part of the community college
5district that has not been described as included in one of the
6trustee districts described in this subsection (d) is included
7within the trustee district that (i) is contiguous to the part
8and (ii) contains the least population of all trustee districts
9contiguous to the part according to the 2000 decennial census
10of Illinois. If any part of the community college district is
11described in this subsection (d) as being in more than one
12trustee district, the part is included within the trustee
13district that (i) is one of the trustee districts in which that
14part is listed in this subsection (d), (ii) is contiguous to
15that part, and (iii) contains the least population according to
16the 2000 decennial census of Illinois. If any part of the
17community college district (i) is described in this subsection
18(d) as being in one trustee district and (ii) is entirely
19surrounded by another trustee district, then the part shall be
20incorporated into the trustee district that surrounds the part.
21If any part of the community college district (i) is described
22in this subsection (d) as being in one trustee district and
23(ii) is not contiguous to another part of that trustee
24district, then the part is included within the contiguous
25trustee district that contains the least population according
26to the 2000 decennial census of Illinois. The Speaker of the

1House, the Minority Leader of the House, the President of the
2Senate, and the Minority Leader of the Senate shall by joint
3letter of transmittal present to the Secretary of State for
4deposit into the State Archives an official set of United
5States Bureau of the Census maps and descriptions used for
6conducting the 2000 census, and those maps shall serve as the
7official record of all counties, townships, census tracts,
8block groups, and blocks referred to in this subsection (d).
9The State Board of Elections shall prepare and make available
10to the public a metes and bounds description of the trustee
11districts created under this subsection (d). The State Board of
12Elections shall adjust census tract boundaries, municipal and
13township annexations, and natural boundaries to make compact
14and contiguous districts.
15    For each at-large seat on the board that is to be filled by
16election in 2005 or 2007, the seat shall be filled by a trustee
17elected from a trustee district. The State Board shall
18determine which trustee district seat is to replace which
19at-large seat by lot. The term of each trustee elected at the
202005 or 2007 consolidated election shall end on the date that
21the trustees elected in 2009 are officially determined by a
22canvass conducted pursuant to the Election Code. For the 2009
23consolidated election, one trustee shall be elected from each
24trustee district to serve a 4-year term.
25    At least one year prior to the 2013 consolidated election,
26the board shall meet to, publicly by lot, divide the trustee

1districts as equally as possible into 3 groups. Beginning with
2the 2013 consolidated election and the consolidated election
3every 10 years thereafter, trustees or their successors from
4the first group shall be elected for successive terms of 2
5years, 4 years, and 4 years; trustees or their successors from
6the second group shall be elected for successive terms of 4
7years, 2 years, and 4 years; and trustees or their successors
8from the third group shall be elected for successive terms of 4
9years, 4 years, and 2 years.
10    (e) Each member must on the date of his election be a
11citizen of the United States, of the age of 18 years or over,
12and a resident of the State and the territory which on the date
13of the election is included in the community college district
14for at least one year immediately preceding his election. In
15Community College District No. 526, each member elected at the
16consolidated election in 2005 or thereafter must also be a
17resident of the trustee district he or she represents for at
18least one year immediately preceding his or her election,
19except that in the first consolidated election for each trustee
20district following reapportionment by the General Assembly, a
21candidate for the board may be elected from any trustee
22district that contains a part of the trustee district in which
23he or she resided at the time of the reapportionment and may be
24reelected if a resident of the new trustee district he or she
25represents for one year prior to reelection. In the event a
26person who is a member of a common school board is elected or

1appointed to a board of trustees of a community college
2district, that person shall be permitted to serve the remainder
3of his or her term of office as a member of the common school
4board. Upon the expiration of the common school board term,
5that person shall not be eligible for election or appointment
6to a common school board during the term of office with the
7community college district board of trustees.
8    (f) Whenever a vacancy occurs, the remaining members shall
9fill the vacancy, and the person so appointed shall serve until
10a successor is elected at the next regular election for board
11members and is certified in accordance with Sections 22-17 and
1222-18 of the Election Code. If the remaining members fail so to
13act within 60 days after the vacancy occurs, the chairman of
14the State Board shall fill that vacancy, and the person so
15appointed shall serve until a successor is elected at the next
16regular election for board members and is certified in
17accordance with Sections 22-17 and 22-18 of the Election Code.
18The person appointed to fill the vacancy shall have the same
19residential qualifications as his predecessor in office was
20required to have. In either instance, if the vacancy occurs
21with less than 5 4 months remaining before the next scheduled
22consolidated election, and the term of office of the board
23member vacating the position is not scheduled to expire at that
24election, then the term of the person so appointed shall extend
25through that election and until the succeeding consolidated
26election. If the term of office of the board member vacating

1the position is scheduled to expire at the upcoming
2consolidated election, the appointed member shall serve only
3until a successor is elected and qualified at that election.
4    (g) Members of the board shall serve without compensation
5but shall be reimbursed for their reasonable expenses incurred
6in connection with their service as members. Compensation, for
7purposes of this Section, means any salary or other benefits
8not expressly authorized by this Act to be provided or paid to,
9for or on behalf of members of the board. The board of each
10community college district may adopt a policy providing for the
11issuance of bank credit cards, for use by any board member who
12requests the same in writing and agrees to use the card only
13for the reasonable expenses which he or she incurs in
14connection with his or her service as a board member. Expenses
15charged to such credit cards shall be accounted for separately
16and shall be submitted to the chief financial officer of the
17district for review prior to being reported to the board at its
18next regular meeting.
19    (h) Except in an election of the initial board for a new
20community college district created pursuant to Section 6-6.1,
21the ballot for the election of members of the board for a
22community college district shall indicate the length of term
23for each office to be filled. In the election of a board for
24any community college district, the ballot shall not contain
25any political party designation.

1    Section 50. The Liquor Control Act of 1934 is amended by
2changing Sections 9-2 and 9-10 as follows:
 
3    (235 ILCS 5/9-2)  (from Ch. 43, par. 167)
4    Sec. 9-2. When any legal voters of a precinct in any city,
5village or incorporated town of more than 200,000 inhabitants,
6as determined by the last preceding Federal census, desire to
7pass upon the question of whether the sale at retail of
8alcoholic liquor shall be prohibited in the precinct or at a
9particular street address within the precinct, they shall, at
10least 104 days before an election, file in the office of the
11clerk of such city, village or incorporated town, a petition
12directed to the clerk, containing the signatures of not less
13than 25% of the legal voters registered with the board of
14election commissioners or county clerk, as the case may be,
15from the precinct. Provided, however, that when the petition
16seeks to prohibit the sale at retail of alcoholic liquor at a
17particular street address of a licensed establishment within
18the precinct the petition shall contain the signatures of not
19less than 40% of the legal voters requested from that precinct.
20The petition shall request that the proposition "Shall the sale
21at retail of alcoholic liquor be prohibited in (or at) ....?"
22be submitted to the voters of the precinct at the next ensuing
23election at which such proposition may be voted upon. The
24submission of the question to the voters of such precinct at

1such election shall be mandatory when the petition has been
2filed in proper form with the clerk. If more than one set of
3petitions are presented to the clerk for submission at the same
4election, the petition presented first shall be given
5preference; however, the clerk shall provisionally accept any
6other set of petitions setting forth the same (or substantially
7the same) proposition. If the first set of petitions for a
8proposition is found to be in proper form and is not found to
9be invalid, it shall be accepted by the clerk and all
10provisionally accepted sets of petitions setting forth the same
11(or substantially the same) proposition shall be rejected by
12the clerk. If the first set of petitions for a proposition is
13found not to be in proper form or is found to be invalid, the
14clerk shall (i) reject the first set of petitions, (ii) accept
15the first provisionally accepted set of petitions that is in
16proper form and is not found to be invalid, and (iii) reject
17all other provisionally accepted sets of petitions setting
18forth the same (or substantially the same) proposition. Notice
19of the filing of the petition and the result of the election
20shall be given to the Secretary of State at his offices in
21both, Chicago and Springfield, Illinois. A return of the result
22of the election shall be made to the clerk of the city, village
23or incorporated town in which the precinct is located. If a
24majority of the voters voting upon such proposition vote "YES",
25the sale at retail of alcoholic liquor shall be prohibited in
26the precinct or at the street address. If the sale at retail of

1alcoholic liquor at a particular street address is prohibited
2pursuant to this Section, the license for any establishment at
3that street address shall be void, and no person may apply for
4a license for the sale at retail of alcoholic liquor at an
5establishment at that street address unless such prohibition is
6discontinued pursuant to Section 9-10.
7    In cities, villages and incorporated towns of 200,000 or
8less population, as determined by the last preceding Federal
9census, the vote upon the question of prohibiting the sale at
10retail of alcoholic liquor, or alcoholic liquor other than beer
11containing not more than 4% of alcohol by volume, or alcoholic
12liquor containing more than 4% of alcohol by weight in the
13original package and not for consumption on the premises, shall
14be by the voters of the political subdivision as a unit. When
15any legal voters of such a city, village or incorporated town
16desire to pass upon the question of whether the sale at retail
17of alcoholic liquor shall be prohibited in the municipality,
18they shall, at least 104 days before an election, file in the
19office of the clerk of the municipality, a petition directed to
20the clerk, containing the signatures of not less than 25% of
21the legal voters registered with the board of election
22commissioners or county clerk, as the case may be, from the
23municipality. The petition shall request that the proposition,
24"Shall the sale at retail of alcoholic liquor be prohibited
25in....?" be submitted to the voters of the municipality at the
26next ensuing election at which the proposition may be voted

7given preference and the clerk shall refuse to accept any other
8set of petitions. Notice of the filing of the petition and the
9result of the election shall be given to the Secretary of State
10at his offices in both Chicago and Springfield, Illinois. A
11return of the result of the election shall be made to the clerk
12of the city, village or incorporated town. If a majority of the
13voters voting upon the proposition vote "Yes", the sale at
14retail of alcoholic liquor shall be prohibited in the
15municipality.
16    In the event a municipality does not vote to prohibit the
17sale at retail of alcoholic liquor, the council or governing
18body shall ascertain and determine what portions of the
19municipality are predominantly residence districts. No license
20permitting the sale of alcoholic liquors shall be issued by the
21local liquor commissioner or licensing officer permitting the
22sale of alcoholic liquors at any place within the residence
23district so determined, unless the owner or owners of at least
24two-thirds of the frontage, 200 feet in each direction along
25the street and streets adjacent to the place of business for
26which a license is sought, file with the local liquor

1commissioner or licensing officer, his or their written consent
2to the use of such place for the sale of alcoholic liquors.
3    In each township or road district lying outside the
4corporate limits of a city, village or incorporated town, or in
5a part of a township or road district lying partly within and
6partly outside a city, village or incorporated town, the vote
7of such township, road district or part thereof, shall be as a
8unit. When any legal voters of any such township, or part
9thereof, in counties under township organization, or any legal
10voters of such road district or part thereof, in counties not
11under township organization, desire to vote upon the
12proposition as to whether the sale at retail of alcoholic
13liquor shall be prohibited in such township or road district or
14part thereof, they shall, at least 104 90 days before an
15election, file in the office of the township or road district
16clerk, of the township or road district within which the
17election is to be held, a petition directed to the clerk and
18containing the signatures of not less than 25% of the legal
19voters registered with the county clerk from such township or
20road district or part thereof. The submission of the question
21to the voters of the township, road district or part thereof,
22at the next ensuing election shall be mandatory when the
23petition has been filed in proper form with the clerk. If more
24than one set of petitions are presented to the clerk for
25submission at the same election, setting forth the same or
26different propositions, the petition presented first shall be

1given preference and the clerk shall refuse to accept any other
2set of petitions. A return of the result of such election shall
3be made to the clerk of the township or road district in which
4the territory is situated, and shall also be made to the
5Secretary of State at his offices in both Chicago and
6Springfield, Illinois.

9    Sec. 9-10. Upon the filing in the office of the clerk, at
10least 104 90 days before an election in any political
11subdivision or precinct, as the case may be, of a petition
12directed to such clerk, containing the signatures of not less
13than 25% or 40% of the legal voters of the territory which has
14prohibited the sale at retail of alcoholic liquor or the sale
15at retail of alcoholic liquor other than beer containing not
16more than 4% of alcohol by weight or the sale at retail of
17alcoholic liquor containing more than 4% of alcohol by weight
18except in the original package and not for consumption on the
19premises, or a petition directed to such clerk containing the
20signatures of not less than 25% of the legal voters of a
21municipality within which such territory is located, to submit
22to the voters thereof the proposition to continue such
23prohibition, the clerk shall certify such proposition to the
24proper election officials, who shall submit the proposition at
25such election to the voters of such political subdivision or

1precinct. Where such proposition is submitted pursuant to a
2petition signed by not less than 25% of the legal voters of a
3municipality within which such territory is located, the legal
4voters of the entire municipality may vote on the proposition.
5For the purposes of this Section, the number of legal voters
6shall be computed upon the same basis as is provided in Section
79-2 for the filing of a petition for referendum on the question
8of whether the sale at retail of alcoholic liquor shall be
9prohibited. So far as applicable, the provisions of Sections
109-1, 9-4, 9-5, 9-6 and 9-7 shall apply. The proposition shall
11be in the following form:

1official or adopted from the description on the petition,
2unless the election official responsible for conducting the
3election determines that a description cannot be included
4within the space limitations on the ballots to be used in the
5election. If the description is not to be included on the
6ballot, the clerk shall prepare large printed copies of the
7description of the precinct together with a notice of the
8proposition which shall be prominently displayed in the
9precinct polling place at the election. If a majority of the
10voters voting upon such last mentioned proposition in any such
11political subdivision or precinct vote "NO", such prohibition
12shall cease in such political subdivision or precinct or at the
13applicable licensed establishment; and where such political
14subdivision or precinct is a city, village or incorporated town
15situated wholly or partly within the boundaries of a township
16or road district having a similar prohibition, a majority vote
17of the voters voting "NO" upon such proposition as above
18described will result in the prohibition ceasing in that part
19of the township or road district situated within such city,
20village or incorporated town. In the event the boundaries of
21such political subdivision or precinct have been altered or the
22numbers of any precincts have been changed subsequent to the
23original election making the territory prohibited territory
24and prior to the filing of such petition for resubmission of
25the question, only those voters actually residing in the
26prohibited territory shall be eligible as signers of such

1resubmission petition, except that this limitation shall not
2apply in the case of a resubmission petition signed by at least
325% of the legal voters of a municipality in which the
4prohibited territory is located. The petition mentioned in this
5Section shall be a public document and shall be subject to
6inspection by the public.
