AMENDMENT TO SENATE BILL 1321

2    AMENDMENT NO. ______. Amend Senate Bill 1321 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 5.786 as follows:
 
6    (30 ILCS 105/5.786 new)
7    Sec. 5.786. The Premise Alert Program Fund.
 
8    Section 10. The Illinois Premise Alert Program (PAP) Act is
9amended by changing Sections 10 and 15 as follows:
 
10    (430 ILCS 132/10)
11    Sec. 10. Definitions. As used in this Act:
12    "Disability" means an individual's physical or mental
13impairment that substantially limits one or more of the major
14life activities; a record of such impairment; or when the

1individual is regarded as having such an impairment.
2"Disability" includes, but is not limited to, a medical
3impairment that requires the use of pressurized oxygen.
4    "Special needs individuals" means those individuals who
5have or are at increased risk for a chronic physical,
6developmental, behavioral, or emotional condition and who also
7require health and related services of a type or amount beyond
8that required by individuals generally. "Special needs
9individual" includes, but is not limited to, an individual with
10a medical impairment that requires the use of pressurized
11oxygen.
12    "Public safety agency" means a functional division of a
13public agency that provides firefighting, police, medical, or
14other emergency services.
15    "Computer aided dispatch" or "CAD" means a database
16maintained by the public safety agency or public safety
17answering point used in conjunction with 9-1-1 caller data.
18    "Premise Alert Program" or "PAP" means a computer aided
19dispatch database of individuals with special needs maintained
20by public safety agencies.

23    Sec. 15. Reporting of Special Needs Individuals.
24    (a) Public safety agencies and suppliers of oxygen
25containers used for medical purposes shall make reasonable

1efforts to publicize the Premise Alert Program (PAP) database.
2Means of publicizing the database include, but are not limited
3to, pamphlets and websites.
4    (b) Families, caregivers, or the individuals with
5disabilities or special needs may contact their local law
6enforcement agency or fire department or fire protection
7district.
8    (c) Public safety workers are to be cognizant cognitive of
9special needs individuals they may come across when they
10respond to calls. If workers are able to identify individuals
11who have special needs, they shall try to ascertain as
12specifically as possible what that special need might be. The
13public safety worker should attempt to verify the special need
14as provided in item (2) of subsection (d).
15    (d) The disabled individual's name, date of birth, phone
16number, and residential address or place of employment, and a
17description of whether oxygen canisters are kept at that
18location for medical purposes should also be obtained for
19possible entry into the PAP database.
20        (1) Whenever possible, it is preferable that written
21    permission is obtained from a parent, guardian, family
22    member, or caregiver of the individual themselves prior to
23    being entered into the PAP database.
24        (2) No individual may be entered into a PAP database
25    unless the special need has been verified. Acceptable means
26    of verifying a special need for purposes of this program

1    shall include statements by:
2            (A) the individual,
3            (B) family members,
4            (C) friends,
5            (D) caregivers, or
6            (E) medical personnel familiar with the
7        individual.
8    (e) For public safety agencies that share the same CAD
9database, information collected by one agency serviced by the
10CAD database is to be disseminated to all agencies utilizing
11that database.
12    (f) Information received at an incorrect public safety
13agency shall be accepted and forwarded to the correct agency as
14soon as possible.
15    (g) All information entered into the PAP database must be
16updated every 2 years or when such information changes.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
