AMENDMENT TO SENATE BILL 963

2    AMENDMENT NO. ______. Amend Senate Bill 963 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 12-401 and by adding Section 1-155.7 as
6follows:
 
7    (625 ILCS 5/1-155.7 new)
8    Sec. 1-155.7. Paratransit vehicle. A vehicle used to
9provide specialized transportation services to an individual
10with disabilities who is unable to use fixed route
11transportation systems and who is eligible for specialized
12transportation services for some or all trips under the
13Americans with Disabilities Act of 1990 and its implementing
14regulations.

1    Sec. 12-401. Restriction as to tire equipment. No metal
2tired vehicle, including tractors, motor vehicles of the second
3division, traction engines and other similar vehicles, shall be
4operated over any improved highway of this State, if such
5vehicle has on the periphery of any of the road wheels any
6block, stud, flange, cleat, ridge, lug or any projection of
7metal or wood which projects radially beyond the tread or
8traffic surface of the tire. This prohibition does not apply to
9pneumatic tires with metal studs used on vehicles operated by
10rural letter carriers who are employed or enjoy a contract with
11the United States Postal Service for the purpose of delivering
12mail if such vehicle is actually used for such purpose during
13operations between November 15 of any year and April 1 of the
14following year, or to motor vehicles displaying a disability or
15disabled veteran license plate whose owner resides in an
16unincorporated area located upon a county or township highway
17or road and possesses a valid driver's license and operates the
18vehicle with such tires only during the period heretofore
19described, to paratransit vehicles operated to provide
20transportation for the elderly or disabled residents between
21November 15 of any year and April 1 of the following year, or
22to tracked type motor vehicles when that part of the vehicle
23coming in contact with the road surface does not contain any
24projections of any kind likely to injure the surface of the
25road; however, tractors, traction engines, and similar
26vehicles may be operated which have upon their road wheels

1V-shaped, diagonal or other cleats arranged in such a manner as
2to be continuously in contact with the road surface, provided
3that the gross weight upon such wheels per inch of width of
4such cleats in contact with the road surface, when measured in
5the direction of the axle of the vehicle, does not exceed 800
6pounds.
7    All motor vehicles and all other vehicles in tow thereof,
8or thereunto attached, operating upon any roadway, shall have
9tires of rubber or some material of equal resiliency. Solid
10tires shall be considered defective and shall not be permitted
11to be used if the rubber or other material has been worn or
12otherwise reduced to a thickness of less than three-fourths of
13an undue vibration when the vehicle is in motion or to cause
14undue concentration of the wheel load on the surface of the
15road. The requirements of this Section do not apply to
16agricultural tractors or traction engines or to agricultural
17machinery, including wagons being used for agricultural
18purposes in tow thereof, or to road rollers or road building
19machinery operated at a speed not in excess of 10 miles per
20hour. All motor vehicles of the second division, operating upon
21any roadway shall have pneumatic tires, unless exempted herein.
22    Nothing in this Section shall be deemed to prohibit the use
23of tire chains of reasonable proportion upon any vehicle when
24required for safety because of snow, ice or other conditions
25tending to cause a vehicle to skid.
