AMENDMENT TO SENATE BILL 270

2    AMENDMENT NO. ______. Amend Senate Bill 270, AS AMENDED, as
3follows:
 
4in Section 10, the introductory clause, immediately after
5"19,", by inserting "20,"; and
 
6in Section 10, immediately below the end of Sec. 19, by
7inserting the following:
 
8    "(20 ILCS 1605/20)  (from Ch. 120, par. 1170)
9    Sec. 20. State Lottery Fund.
10    (a) There is created in the State Treasury a special fund
11to be known as the "State Lottery Fund". Such fund shall
12consist of all revenues received from (1) the sale of lottery
13tickets or shares, (net of sales agent commissions, fees
14representing those expenses that are directly proportionate to
15the sale of tickets or shares at the agent location, and prizes

1of less than $600 which have been validly paid at the agent
2level, and any private manager compensation or reimbursements
3due under the management agreement), (2) application fees, and
4(3) all other sources including moneys credited or transferred
5thereto from any other fund or source pursuant to law. Interest
6earnings of the State Lottery Fund shall be credited to the
7Common School Fund.
8    (a-5) If for any reason the General Assembly fails to make
9appropriations of amounts sufficient from the State Lottery
10Fund to the Department for payment of prizes to holders of
11winning lottery tickets or shares, including prizes related to
12Multi-State Lottery games, and payment of promotional or
13incentive prizes associated with the sale of lottery tickets,
14pursuant to the provisions of this Law, then this subsection
15constitutes an irrevocable and continuing appropriation of all
16amounts necessary for that purpose, and the irrevocable and
17continuing authority for and direction to the Comptroller and
18to the Treasurer of the State to make the necessary transfers
19out of and disbursements from the State Lottery Fund for that
20purpose.
21    (b) The receipt and distribution of moneys under Section
2221.5 of this Act shall be in accordance with Section 21.5.
23    (c) The receipt and distribution of moneys under Section
2421.6 of this Act shall be in accordance with Section 21.6.
25    (d) The receipt and distribution of moneys under Section
2621.7 of this Act shall be in accordance with Section 21.7.

1    (e) The receipt and distribution of moneys under Section
221.8 of this Act shall be in accordance with Section 21.8.

6in Section 10, Sec. 29, the last sentence of subsection (c), by
7replacing "Governor's" with "Superintendent's"; and
 
8in in Section 10, Sec. 29, the first sentence of subsection
9(e), by replacing "Governor" with "Superintendent"; and
 
10immediately below the end of Section 25, by inserting the
11following:
 
12    "Section 99. Effective date. This Act takes effect July 1,
132011.".
