AMENDMENT TO SENATE BILL 171

2    AMENDMENT NO. ______. Amend Senate Bill 171 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Township Code is amended by adding the
5heading of Article 27 and Sections 27-5, 27-10, and 27-15 as
6follows:

ARTICLE 27. DISCONTINUANCE OF CERTAIN TOWNSHIP OFFICES

 
9    (60 ILCS 1/27-5 new)
10    Sec. 27-5. Referendum to discontinue township
11organization. By petition of at least 10% of the registered
12voters of a township, as determined on the date registration
13closed before the regular election next preceding the last day
14on which the petition may be filed, of a county that has
15adopted township organization, or upon ordinance or resolution

1adopted by the township board, the township board shall certify
2and cause to be submitted to the voters of the township, at the
3next election, the questions of the continuance of the office
4of Highway Commissioner and the office of Township Assessor. A
5signature on a petition shall not be valid or counted in
6considering the petition unless the form requirements are
7complied with and the date of each signature is less than 90
8days before the last day for filing the petition. The statement
9of the person who circulates the petition must include an
10attestation (i) indicating the dates on which that sheet was
11circulated, (ii) indicating the first and last date on which
12that sheet was circulated, or (iii) certifying that none of the
13signatures on the sheet was signed more than 90 days before the
14last day for filing the petition. The petition shall be treated
15and the propositions certified in the manner provided by the
16general election law.
17    The propositions shall be in substantially the following
18form:
19        Shall the office of Highway Commissioner be continued
20    in (name of township)?
21        Shall the office of Township Assessor be continued in
22    (name of township)?
23    The votes shall be recorded as "Yes" or "No".

25    Sec. 27-10. Cessation of offices in a township. If a

1majority of the votes of the township cast on the question of
2the continuance of the office of Highway Commissioner or the
3office of Township Assessor at the election are against either
4of the proposed options for continuance, then the office of
5Highway Commissioner, the office of Township Assessor, or both,
6as applicable, shall cease in the township at the end of the
7current term of office. If the office of the Highway
8Commissioner ceases, then the county superintendent of
9highways or the county engineer, as applicable, shall assume
10the duties of Highway Commissioner under the Illinois Highway
11Code. If the office of Township Assessor ceases, then (i) the
12county supervisor of assessments or county assessor, as
13applicable, shall assume the duties of the Township Assessor
14under the Property Tax Code, (ii) the county board members
15shall be the board of health for the public health district
16under the Public Health District Act, and (iii) the Office of
17the Township Collector shall also cease.

19    Sec. 27-15. Township assets. If the office of Highway
20Commissioner is discontinued, then the assets of that office
21shall be appraised and distributed equally between the county
22and the township.
 
23    Section 10. The Property Tax Code is amended by adding
24Section 3-70 as follows:

2    Sec. 3-70. Cessation of Township Assessor. If the office of
3Township Assessor ceases as provided in Article 27 of the
4Township Code, then the Supervisor of Assessments or County
5Assessor, as applicable, shall assume the duties of the
6Township Assessor under this Code.
 
7    Section 15. The Public Health District Act is amended by
8adding Section 25 as follows:

10    Sec. 25. Cessation of Township Assessor. If the office of
11Township Assessor ceases as provided in Article 27 of the
12Township Code, then the county board members shall be the board
13of health for the public health district under this Act.
 
14    Section 20. The Illinois Highway Code is amended by adding
15Section 5-205.10 as follows:
 
16    (605 ILCS 5/5-205.10 new)
17    Sec. 5-205.10. Cessation of township Highway Commissioner.
18If the office of Highway Commissioner ceases as provided in
19Article 27 of the Township Code, then the county superintendent
20of highways or the county engineer, as applicable, shall assume
21the duties of Highway Commissioner under this Code.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
