AMENDMENT TO HOUSE BILL 5904

2    AMENDMENT NO. ______. Amend House Bill 5904 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-20 as follows:
 
6    (305 ILCS 5/5-20)
7    Sec. 5-20. Electronic health care card. By December 31,
81994, the Illinois Department may develop and implement by rule
9an electronic health information system to process claims
10electronically and to electronically store Medicare and
11Medicaid patient records, medical histories, and billing
12information. The Illinois Department may issue each Medicare
13and Medicaid recipient a health card containing electronically
14coded information that will access the system, verify their
15Medicare or Medicaid status, and display how much the patient
16must pay in deductibles or copayments for a medical procedure.

1The Illinois Department may also develop safeguards to protect
2recipients' health information from misuse or unauthorized
3disclosure.
4    On or before July 1, 2011, the Department shall cease
5issuing monthly MediPlan cards and shall instead issue
6permanent or semi-permanent member cards to individuals
7enrolled for medical assistance. As soon as practicable, the
8member cards shall include safeguards to limit the unauthorized
9use of the medical card by an individual other than the member
10to whom the card has been issued. These safeguards may include,
11but not be limited to, the use of a matrix barcode or related
12technology which allows a medical provider to access data,
13including identifying data of the individual named on the card
14and photographic images maintained by the Secretary of State in
15the driver's registration and State identification databases.
16The Department shall be authorized to enter into contracts with
17other public and private sector entities to maximize the amount
18of relevant information and data available to be accessed
19through the use of these cards. Furthermore, the Department may
20employ any reasonable means by which providers may verify an
21individual's eligibility for medical assistance in place of
22MediPlan cards.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
