1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Community Services Act is amended by
5changing Section 4.6a as follows:
 
6    (405 ILCS 30/4.6a)
7    Sec. 4.6a. Reduction in patient population in
8developmental disabilities facility.
9    Whenever a State developmental disabilities facility
10operated by the Department of Human Services is scheduled to
11have or has a reduction in the number of individuals receiving
12care in an amount equal to or greater than 10% of the
13facility's prior highest population during the preceding
1412-month period, the Department of Human Services shall file a
15report with the General Assembly specifying the:
16        (1) Total change in resident population for the
17    facility.
18        (2) Anticipated new venues for care by venue category,
19    in the aggregate, for the individuals no longer receiving
20    care in the facility.
21        (3) Estimated corresponding changes in appropriation
22    level necessary for the facility reducing population as
23    well as additional appropriation authority required for

1    other facilities or community care alternatives which are
2    expected to experience an increase in the number of
3    individuals served.
4    The report required under this Section shall be given to
5the General Assembly within 30 days of when a decision by the
6Secretary of the Department of Human Services is made to
7decrease the population of a facility by 10% or more, or in
8cases where population changes are due to unplanned caseload
9changes, within 30 days of the actual change in population by
1010% or more.
11    Notwithstanding any provision of the law to the contrary,
12including, but not limited to, Section 13.2 of the State
13Finance Act, based Based on information contained in the
14reports required under this Section, the Department, at the
15direction of the Governor, shall transfer funds from the
16facility realizing a reduction in the number of individuals
17served to the appropriate line item providing appropriation
18authority for the new venues of care, as necessary to carry out
19the objectives of the Governor's long-term care rebalancing
20efforts or to otherwise facilitate the transition of services
21to the new venues of care, provided that the new venue of care
22is a Department of Human Services funded provider or facility.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.
