    Amends the School Code. Prohibits the State Board of Education, by rule, from defining a general education classroom as a classroom that is composed of a certain percentage of students with individualized education programs (IEPs). Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
514-2 as follows:
 
6    (105 ILCS 5/14-2)
7    Sec. 14-2. Definition of general education classroom for
8special education students receiving services in the general
9education classroom. The State Board of Education may not, by
10(a) With respect to any State statute or administrative rule,
11define that defines a general education classroom as a
12classroom that is to be composed of a certain percentage of
13students with individualized education programs (IEPs),
14students with individualized education programs shall exclude
15students receiving only speech services outside of the general
16education classroom, provided that the instruction the
17students receive in the general education classroom does not
18require modification.
19    (b) In every instance, a school district must ensure that
20composition of the general education classroom does not
21interfere with the provision of a free and appropriate public
22education to any student.
